About this file

This is a Sole Source Justification memorandum issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) for the acquisition of Mine Countermeasures (MCM) targets and associated shipping crates from Robbins Metal Fab LLC.

The procurement requires fabrication of 3 units of Target Mk 53 Mod 0 (Part #7449523) and 3 units of Crate Shipping and Storage Mk 120 Mod 0 (Part #8904289). The total acquisition value falls above micro-purchase levels but does not exceed the simplified acquisition threshold of $350,000.00, allowing use of simplified acquisition procedures. Robbins Metal Fab LLC is located at 5814 Merritt Brown Road, Panama City, Florida. The justification asserts that Robbins is the sole source reasonably available to meet government requirements because the company is currently fabricating similar targets and crates (Mk 51, Mk 52 targets and Mk 117, Mk 118 crates) under existing contract N61331-24-D-0001 awarded May 17, 2022. The Mk 53 cylindrical moored targets require specialized tooling, fixtures, and processes identical to those already in use by Robbins, and the company is the only contractor currently mobilized to deliver within the required timeframe. The justification emphasizes that these targets directly support mine warfare system development, testing and evaluation, and fleet training worldwide, with critical applications in mine hunting, mine avoidance, mine neutralization, and data collection. The contracting officer has determined the sole source award represents best value and the lowest overall cost alternative to meet government needs.

MEMORANDUM

Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE MK53 TARGETS SUPPORT

FROM ROBBINS METAL FAB

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

2. Description of the Action Being Approved:

Authorization to solicit, on a sole source basis, Robbins Metal Fab LLC 5814 Merritt Brown Road, Panama City, FL, for the fabrication of Mk 53 Mod 0 Targets and Mk 120 Mod 0 Crates.

The MCM Targets Program provides threat representative mine replicas known as "Mine Targets" that function with the same physical and functional characteristics as the threats to the U.S. Navy Mine Targets.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

This procurement is for the following:

Line# Part # Description Qty Unit Price Amount

1 7449523 Target Mk 53 Mod 0 3 $ $

2 8904289 Crate Shipping and Storage Mk 120 Mod 0

3 $ $

The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $350,000.00. .

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. This acquisition is conducted under the authority of FAR 12.102(a), Restricting Competition for Commercial Acquisitions Below the Simplified Acquisition Threshold. The determination has been made that only one source is reasonably available to meet the Government's minimum needs.

This requirement is to fill an immediate need to provide MCM targets to the fleet. Robbins is currently fabricating Mk 51 and Mk 52 targets and Mk 117 and Mk 118 crates under contract N61331-24-D-0001, awarded 17 May 2022. Fabrication and assembly of the Mk 53 Targets and Mk 120 Crates requires specialized tooling, fixtures and processes identical to those used by Robbins under the above contract effort. Robbins Metal Fab is the only contractor currently mobilized and capable of providing the highly specialized skills to perform this effort within the required time frame. The Mk 53 cylindrical moored target shapes support all mine warfare system Development, Testing & Evaluation, and Fleet Training & Exercises throughout the world. The production efforts here in Panama City are derived by Policy & Guidance Reference under OPNAVINST 3110.18 - Navy Target Program and Allocation Process. MCM Mk 53 target capabilities will be used to support Mine Hunting (acoustically, visually, optically, & thermally), Mine Avoidance, Mine Neutralization and data collection events that directly correlate to Fleet and Research and Development Activities to increase the warfighters performance capabilities. Failure to have an adequate number of targets on-hand will greatly impact the following mission critical actions:

(1) Fleet efficiency in conducting minehunting operations on this target type resulting in increased Fleet operational risk.

(2) Review and approve T&E master plans and test plans of combat and weapons system acquisition programs to validate target support requirements.

(3) Review and validate all test target requirements from COMNAVSEASYSCOM, COMNAVAIRSYSCOM, and COMOPTEVOR by type and quantity to support test events including developmental test, operational test, integrated test, follow-on T&E, operational evaluation, quick reaction assessments, and urgent operational need statements.

(4) Identify new T&E target capability requirements.

(5) For new T&E targets, draft and coordinate staffing of new program capability development documents and Joint Capabilities Integration and Development System documents.

(6) Reduction of any of these services will directly reflect fleet readiness. Therefore, it is imperative that this purchase order is awarded to Robbins Metal Fab immediately.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 12.102(a).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

As stated in paragraph 4 above, Robbins Metal Fab is the only company that can meet the Government’s requirements

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Robbins Metal Fab is the only company that can meet the Government’s requirements within the timeframe mandated by Fleet and T&E requirements.
