About this file
This is a Justification and Approval (J&A) document for use of other than full and open competition in federal procurement. The Naval Surface Warfare Center Port Hueneme Division (NSWC PHD) seeks to award a firm-fixed-price contract to Aircraft Rubber Manufacturing Division of Fuel Safe Systems (CAGE 3YJU7) for eight hanging bladder assemblies (part number H365727-1) required to support the NATO Sea Sparrow Surface Missile System (NSSMS) MK29 ESSM ORDALT Launcher upgrade onboard naval ships. The contract covers a base quantity and four option quantities with delivery through September 2025. Estimated dollar values for fiscal years 2021–2025 are included in a table but are redacted in the document.
The justification for sole-source procurement under 10 U.S.C. 2304(c)(1) and FAR 6.302-1 is based on the fact that Aircraft Rubber Manufacturing Division is the only approved manufacturer on drawing H365727 and is the original equipment manufacturer. The document notes that qualifying alternative vendors would require form, fit, and function compatibility testing estimated to cost substantially more with no guarantee of qualification, would cause unacceptable delays to scheduled installations, and would jeopardize ships' operational commitments. An extensive search of Navy supply systems, GSA Advantage, NAVSUP One Touch, Ability One, and Federal Prison Industries confirmed no alternative sources or available assets exist. The contracting officer is responsible for determining fair and reasonable costs, and the document includes certifications from technical, requirements, legal, and contracting officer personnel affirming the justification's accuracy and legal sufficiency.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
Naval Surface Warfare Center Port Hueneme Division (NSWC PHD).
2. Description of the Action Being Approved
NSWC PHD intends to award a firm-fixed-price contract to Aircraft Rubber Manufacturing Division of Fuel Safe Systems (CAGE 3YJU7) on the basis of other than full and open competition for eight
(8) hanging bladder assemblies required support the NATOSEASPARROW Surface Missile System (NSSMS) MK29 ESSM ORDALT Launcher upgrade onboard naval ships.
3. Description of Supplies/Services
Estimated Value is for a base quantity and four option quantities for delivery thorough September 2025 as shown in the following table. The certifying technical and requirements personnel have verified the Government's minimum needs.
4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other suppliers or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
The hanging bladder assembly part number H365727-1 is identified on , H365727 Bladder Assembly. Only the items described on the drawing when procured from the supplier listed is approved by the cognizant design activity for use. Aircraft Rubber Manufacturing Division of Fuel Safe Systems (CAGE 3YJU7) is the only approved manufacturer on drawing H365727. This bladder assembly is a direct replacement

These components are compatible in all aspects (form, fit, function) with existing systems presently installed.
Qualifying and procuring any other bladder assembly in the future would require vendors of the bladder assembly to manufacture form, fit and function components and undergo first article testing as an assembly to verify compatibility with
. Total testing to qualify other vendor hanging bladder assembly products is estimated to cost and to exceed hours of collaboration across multiple organizations to test with no guarantee of qualification. This estimate is based on qualification testing performed for similar NSSMS assemblies and represents a substantial duplication of cost that is not expected to be recovered through competition and an unacceptable delay that would jeopardize scheduled ESSM ORDALT installations and ships' operational commitments.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
IHS Haystack defense parts and logistics management system confirmed National Stock Numbers (NSN) and US Navy management does not exist for this bladder assembly. An extensive search of Navy ERP, NAVSUP One Touch, Ability One, GSA Advantage and UNICOR Federal Prison Industries were unsuccessful, no available assets exist.
After exhausting available Navy supply resources for the Aircraft Rubber Manufacturing Division of Fuel Safe Systems (CAGE 3YJU7) hanging bladder assembly, a current cognizant design activity approved supplier quote was obtained directly from Aircraft Rubber Manufacturing Division of Fuel Safe Systems who is the original equipment manufacturer. The manufacturer does not sell or distribute industrial products like these bladder assemblies through a distribution network.
7. Determination of Fair and Reasonable Costs
The Contracting Officer shall determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC PHD has no plans at this time to compete future contracts for the types of

supplies covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
