Patrol Officer Response to Street Drugs Training
1.0 General:
1.1 Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary, except as specified in Paragraph 3.0 as Government Furnished, to design, develop and instruct a Basic Narcotics Investigations course for Western Regional Counterdrug Training Center (WRCTC), as defined in this
PWS.
1.2 Background: The Western Regional Counterdrug Training Center (WRCTC) is one of five (5) National Guard Counterdrug training programs that provides relevant curriculum focused on counter-narcotics and counter transnational organized crime.
WRCTC is located at Camp Murray in Tacoma, WA. WRCTC provides courses that support National Drug Control Strategies and positively impact the performance of federal, state, and local law enforcement agencies (LEA), community-based organizations (CBO), and military professionals directly involved in counter-narcotics missions. Course curriculum focuses on illicit narcotics interdiction, disruption of drug trafficking organizations, intelligence and analysis, narco-terrorism, homeland security, civil operations, and anti-drug coalition fundamentals. Each course is designed to support the objectives of the Assistant Secretary of Defense for Counter-narcotics and Global Threats (DASD-CN), Office of National Drug Control Policy (ONDCP), National Northern Border, National Southwest Border, and Caribbean Border counternarcotics strategies and to increase national security. WRCTC supports federal, state, and local agencies with current and relevant training, maximized by the experiences of subject matter experts in their fields. All training events are designed to not only offer world class instruction, but to break down jurisdictional barriers and offer a unique opportunity for officials across the law enforcement and prevention spectrum to network and share ideas in person. Planning and prioritization of training is aligned to strategy, policy, and guidance pursuant to Public Law 109-469. This law authorizes National Guard Counterdrug Schools to train federal, state, local, and tribal agencies in drug interdiction and Counterdrug activities and other non-federal governmental and private entities and organizations engaged in such activities. Strategic guidance that the WRCTC adheres to includes Department of Defense (DoD) Counter-narcotics and Global Threats (DASD-CN/GT) Strategy and annual guidance, the National Drug Control Strategy, regional operational needs assessments, current and emerging threats, and training requests from agencies involved in counterdrug activities as outlined in public law.
2.0 Requirements:
2.1 Course Schedule: The contractor shall provide 4-day (32-hour) Patrol Officer Response to Street Drugs course(s). Dates and locations for each course iteration are selected based on training requests submitted by law enforcement agencies.
2.2 Course Description: This course is designed to enhance the ability and skills of all attendees to identify, detect, apprehend, and successfully articulate the drug trafficker, distributor, and the drug impaired person. This includes calls for service where persons are involved in disturbances; juveniles using drugs on school grounds or domestic violence; it should be used on the confidential informant being utilized in a narcotic investigation and all other enforcement needs where the person or persons are under the influence of a drug. The concept and strategy in this program of instruction uses the structured, in-depth coverage of the 8 drug categories, to include the Drug Abuse Recognition system and other advanced techniques as a means of legally apprehending the drug manufacturer, distributor and specifically the user.
2.3 Course Content:

2.4 Target Audience: Law enforcement officers, detectives, agents, supervisors, and analysts assigned to narcotics, gangs, human trafficking, or specialized units.
2.5 Delivery Method: Presentation capabilities must allow for in-person and/or virtual delivery.
2.5.1 1:40 instructor to student ratio for in-person deliveries
2.5.2 1:75 instructor to student ratio for virtual deliveries
2.5.3 The delivery method is determined by the WRCTC Commandant and instructions will be provided to the vendor by the Contracting Officer or authorized representative
2.5.4 Quotes for in-person delivery of training must also include a quote for virtual delivery. In the event in-person training is not possible/feasible, the WRCTC Commandant may direct the training be delivered virtually. In this case, only the amount proposed for virtual delivery will be invoiced.
2.6 Must use data sets relevant to law enforcement investigations. Content must be updated to reflect geographic location considerations.
3.0 Minimum Instructor Qualifications:
3.0.1 Recent and relevant narcotics officer experience (or related expertise).
3.0.2 Must have recent instructor experience, supporting documentation/explanation of previous experience must be provided at the time of quote (to include POC for verification).
3.0.3 Must provide lesson plan, agenda, course outline, and previous reviews.
3.0.4 Must provide virtual training platform with access for at least 75 students for all virtual delivered courses (to be approved by WRCTC prior to contract award).
3.0.5 Must provide virtual delivery link to WRCTC OPS 48 hours prior to training and allow WRCTC OPS to be co-host with admin access to audit course.
3.0.6 Must provide the verified roster on the final day of training to WRCTC OPS personnel at info@wrctc.org.
3.0.7 Must complete invoicing through WAWF within 5 days of the completion of training.
3.0.8 Successful vendors/instructors must complete a post-award telephone/teleconference (up to 1 hour) with WRCTC OPS to review training and admin requirements.
4.0 Minimum Previous Training Experience: Must have recent and relevant experience instructing law enforcement / military audiences. Submit verification of experience.
5.0 Preferred Qualifications: Instructors with recent/relevant narcotics officer experience and proven success delivering virtual and in-person training (references must be provided with quote submission).
6.0 Administrative Requirements/Student Rosters:
6.0.1 Course rosters will be provided by WRCTC.
6.0.2 Contractor will ensure students sign-in on the block next to their name on the course roster(s).
6.0.3 Course rosters will be reviewed for accuracy and verified by the contractor.
6.0.4 Course rosters must be submitted to info@wrctc.org within 24 hours of the course completion.
6.0.5 Students that are not on the roster, provided by WRCTC, are not approved to attend the course. If the perspective student registers at wrctc.org and there are available seats, once approved they are authorized to attend.
6.0.6 If the course is conducted virtually the vendor is required to verify each student’s attendance.
6.0.7 Course critiques will be done by the students at wrctc.org in order to receive their certificates.
7.0 Periods/Places of Performance: The Period of Performance (PoP) for this IDIQ shall be 15 February 2023 – 14 February 2028. Task orders will provide specific delivery dates and locations for each training event.
8.0 General Information:
8.1 Quality Control (QC): The contractor shall develop and maintain an effective QC Plan (QCP) to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s QCP is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the contractor shall develop QC procedures that address the areas identified in Technical Exhibit 1, Performance Requirements Summary (PRS).
8.2 Quality Assurance (QA): The Government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP).
This plan is primarily focused on what the Government will do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) or defect rate(s).
8.3 Protection of Personally Identifiable Information (PII). The contractor shall protect all PII encountered in the performance of services in accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 224.103 Personally Identifiable Information and Department of Defense Directive (DoDD) 5400.11, Department of Defense Privacy Program, and DoD 5400.11-R. If a PII breach results from the contractor’s violation of the aforementioned policies, the contractor shall bear all notification costs, call-center support costs, and credit monitoring service costs for all individuals whose PII has been compromised.
8.4 OPSEC SOP/Plan. (No Social Media Posts) The contractor shall develop an OPSEC Standard Operating Procedure (SOP)/Plan and provide it to the COR within 90 calendar days of contract award to be reviewed and approved by the responsible Government OPSEC officer, per AR 530-1, Operations Security. This SOP/Plan shall include a process to identify the Government's critical information, why it needs to be protected, where it is located, who is responsible for it, and how to protect it. The contractor shall implement OPSEC measures as required by the Government. In addition, the contractor shall identify an individual who will be an OPSEC Coordinator.
The contractor shall ensure this individual becomes OPSEC Level II certified within 90 days of appointment as OPSEC coordinator in accordance with AR 530-1. Contractor shall provide a copy of the certification to the COR NLT 15 days after completion.
8.5 Identification of Contractor/Vendor Employees: At no time shall Contractor/Vendor personnel represent themselves as government employees. Contractor/Vendor personnel shall wear identification badges distinguishing themselves as such. The badges shall have the company name, employee name and the word “contractor” displayed.
8.6 Combating Trafficking in Persons: The United States Government has adopted a zero-tolerance policy regarding trafficking in persons. Contractors and contractor employees shall not engage in severe forms of trafficking in persons during the period of performance of the contract; procure commercial sex acts during the period of performance of the contract; or use forced labor in the performance of the contract. The Contractor shall notify its employees of the United States Government’s zero tolerance policy, the actions that will be taken against employees for violations of this policy. The contractor shall take appropriate action, up to and including termination, against employees or subcontractors that violate the US Government policy as described at
FAR 22.17.
8.7 Organizational Conflicts of Interest (OCI): The contractor and subcontractor personnel performing services under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications, or work statements, etc.) or perform evaluation services which may create a current or subsequent OCIs, as defined in FAR Subpart 9.5. The contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO. In the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may impose other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.

9.0 Definitions and Acronyms:
9.1 Definitions:
9.1.2 Contractor: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
9.1.3 Contracting Officer (KO): A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
9.1.4 Government Representative: An employee of the U.S. Government designated by the KO to monitor contractor performance. Such appointment will be in writing and will state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
9.1.5 Defective Service: A service output that does not meet the standard of performance associated with the PWS.
9.1.6 Deliverable: Anything that can be physically delivered and includes non-manufactured things such as meeting minutes or reports.
9.1.7 Key Personnel: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
9.1.8 Quality Assurance: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
9.1.9 Quality Assurance Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
9.1.10 Quality Control: All necessary measures taken by the Contractor to ensure that the quality of an end product or service shall meet contract requirements.
9.1.11 Subcontractor: One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

10.0 Government Furnished Property, Material, Equipment and Services (GFP/M/E/S):
The Government will provide the property, material, equipment, and/or services listed below solely for the purpose of performance under this contract:
10.1 Property: The Government will furnish a classroom of adequate size to accommodate the number of students registered for each iteration of the course.
10.2 Materials: The government will furnish course rosters and completion certificates.
The rosters will be verified by the vendor each day of the course delivery. A scanned course roster must be submitted to info@wrctc.org within 24 hours of the course completion.
10.3 Equipment: The Government will furnish Audio-Visual equipment in the classroom, for in-person deliveries only.
10.4 Services: NONE
11.0 Contractor Furnished Property, Materials, and Equipment (CFP/M/E):
11.1 General: Except for those items specifically stated to be Government-Furnished in Paragraph 10.0, the contractor shall furnish everything required to perform these services as indicated in Paragraph 1.1. Minimum materials and equipment to be provided by the Contractor are:
11.1.1 Student manual outlining specific course content. Student manual is intended to be a reference/resource for students to use after completing the course and must be provided to each student. Student manual shall be:
11.1.1.1 Professionally and thoroughly researched and developed

11.2 Expenses. All expenses for materials, equipment or services required to conduct the course shall be borne by the contractor and shall be included in the firm fixed price of each offer (on a task order basis). Expenses include, but are not limited to:

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.216-18 ORDERING. (AUG 2020)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 22 February 2023through 21 February 2028.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) A delivery order or task order is considered "issued" when--
(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;
(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or
(3) If sent electronically, the Government either--
(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or
(ii) Distributes the delivery order or task order via email to the Contractor's email address.
(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.
52.216-19 ORDER LIMITATIONS (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor -
(1) Any order for a single item in excess of $100,000;
(2) Any order for a combination of items in excess of $100,000; or
(3) A series of orders from the same ordering office within 90 days that together call for quantities exceeding the limitation in paragraph (b) (1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
