OPOAM 3016.505-90(a)(2)(iii) Justification for Brand Name Exception to Fair Opportunity
JEFO No. FY20-00133
JEFO No.: FY20-00133
Date: 5/13/2020 PR Number: RCCA-20-00078
1. Nature and/or description of the item/service being procured and anticipated cost:
The Department of Homeland Security, Office of Procurement Operations, prepared this justification for an exception to fair opportunity for procurement of thirty-six (36) Rumba software licenses. The anticipated cost is $
2. Statutory Exception and rationale for brand name. Only one awardee is capable of providing the supplies required at the level of quality required because the supplies are unique or highly specialized pursuant to FAR 16.505(a)(4) and is an item peculiar to one manufacturer:
OPO intends to procure thirty-six (36) Rumba software licenses on a brand-name basis in accordance with FAR 16.505(a)(4)(i) or (ii). The exception is based on FAR 16.505(a)(4), only one source is capable of providing the software licenses because the Rumba software is unique or highly specialized and is a brand name item peculiar to the Original Equipment Manufacturer (OEM).
The Department of Homeland Security (DHS) is seeking to renew Rumba Software licenses currently in use within Cybersecurity and Infrastructure Security Agency (CISA)’s Office of Human Capital (OHC). Rumba software is used by the OHC to access and manipulate National Finance Center’s (NFC) data. This is necessary in order for CISA to ensure personnel actions and payroll are complete and accurate. Additionally, Rumba software is the only software NFC has integrated with their system and it is the only software DHS has approved for use on the A-LAN network to access data coming from/to the NFC. As a result there are no alternative software capable of meeting DHS’s needs.
Failure to maintain active Rumba licenses will result in CISA being unable to verify CISA employee pay has been processed accurately, as required by Federal and DHS regulation and policy. This may cause over/under pay situations to go undetected, which will adversely affect CISA’s employees and DHS’ audit opinion.
Renewal of Rumba license was found to be available on a limited competition basis from multiple small businesses under DHS Strategic Source vehicle First Source II. Rumba software licenses is a commercial off-the-shelf product only from authorized sellers. DHS intend to competitively solicit this requirement under a First Source II in order to ensure a fair and reasonable price.
3. DHS intends to post this requirement on FedBizOpps pursuant to FAR 16.505(b)(2)(ii)(D).
