Re: Response to Questions; Northeast Region Multifamily Construction Inspection Services Request for Proposal DU205NC-15-R-0011

Prospective Offerors, The government is providing Responses to the following questions:

Question #1: Please confirm that an 8a firm that meets the size standard requirement may joint venture with an experienced firm that is not required to meet the size standard requirement and therefore may exceed the $7.5 standard size requirement.

Response: Title 13 U.S.C. § 124.513, Under what circumstances can a joint venture be awarded an

8(a) contract? reads:

(2) For sole source and competitive 8(a) procurements that do not exceed the dollar levels identified in paragraph (b)(1) of this section ($10M), an 8(a) Participant entering into a joint venture agreement with another concern is considered to be affiliated for size purposes with the other concern with respect to performance of the 8(a) contract. The combined annual receipts or employees of the concerns entering into the joint venture must meet the size standard for the NAICS code assigned to the

8(a) contract.

The response is “No.” The concern entering into the joint venture must meet the size standard of $7.5M.

Note: Solicitation Section L provision Addendum to FAR 52.212 – Instructions to Offerors—

Commercial Items reads in part:

JOINT VENTURE AGREEMENTS:… “If you are contemplating a joint venture on this project, you must advise your assigned SBA Business Opportunity Specialist (BOS) as soon as possible.”

Question #2: File decompression applications are required to be compatible with the government’s

Windows Operating System. What version of the Windows Operating System does the government use?

Response: The Windows Operating System is Windows 7 Enterprise.

Question #3: Item 3 of the proposal format states that the response must be “Printed or Copied Double

Sided on Postconsumer Fiber Content Paper.” It is unclear as to whether the copy paper already in our inventory and specified for use with our printer meets this requirement. Is this permissible to use the copy paper in our inventory and specified by Hewlett Packard for use in our printer?

Response: The government will be amending the solicitation. Solicitation provision ADDENDA TO

52.212-1 Proposal Preparation Instructions, is changed to read:

Offerors are encouraged to use recycled paper and to use both sides of the paper (see

FAR § 52.204-4, Printed or Copied Double-Sided on Postconsumer Fiber Content Paper).

Question #4: Paragraph (e) of page 74 of 97 states that “Multiple offers are deleted from the solicitation.” May the Offeror bid [proposal] on more than one (1) Region for “Construction Inspection

Services for Multifamily Properties” such as placing a bid [proposal] for each region?

Response: Solicitation Section L provision Addendum to FAR 52.212.-1 – Commercial Items pertains to solicitation DU205NC-15-R-0011, Northeast Region. This provision does not prevent a contractor from submitting a proposal for solicitation’s DU205NC-15-R-0009 (Southeast Region), DU205NC-15-R-

0010 (Southwest Region), or DU205NC-15-R-0012 (West Region).

Thank you for your interest in HUD contracting.

Sincerely, Gene Hamilton Jackson

Contracting Officer
