# Question Answer

Per page 64, Section: Proposal Organization, we are to organize our Volume I in the following format: Table of Contents, Executive Summary, Technical Capability, Key Personnel Resume, Quality Control Plan, Past Performance, Glossary. However, in Section M: Evaluation Factors, there is a different sequence for the Volume I submittal and separated by factors (aka. Factor 1, Factor 2). Please clarify what should be included in Volume I: Management Plan and Technical Approach proposal and how should it be organized.

Proposal organization and evaluation factors are not one in the same.

The evaluation factors detail how proposals will be evaluated. Please follow the instructions of section L regarding proposal organization.

2 Per page 64, Section: Proposal Organization and Section M: Evaluation Factors, there is no reference of a Subcontracting Plan. However, on page 60 of the RFP, 2452.219-73 – Incorporation of Subcontracting Plan, we are required to submit a Subcontracting Plan. Are we to assume that we will need to submit a Subcontracting Plan after award, or is it required at the time of submission? If it is required with submission, please clarify where we are to include it (Volume I or Volume II)?

This clause will be removed. A subcontracting plan is not required.

3 In the organization of the Volume I and Volume II included in Section: Proposal Organization on page 64 of the RFP, it is not clear where we should include the SF 1449 form. Are we to submit the 1449 form in Volume I or Volume II of our submittal?

Submit the SF1449 & amendments (if any) on top of Volume I.

Per page 64, Section: Proposal Organization, there are specifications to page limit, font size and paper size for Volume I. Is there a requirement for double-sided vs. single sided pages?

The page limitation of 80 pages has been added, which includes either single or double sided pages.

5 Per page 64, Section: Proposal Organization, letter (c), are we to provide two CDs, one with Volume I and the other with Volume II, or one CD with two separate files?

Either way is acceptable.

6 Per page 64, Section: Proposal Organization, letter (c), mentioned that “electronic copies of the proposal should be submitted in a format readable by Microsoft Office Word, MS Office Excel, MS Office Project, and MS Office Power Point”, is it possible to submit our electronic submission as a PDF file?

Files can be submitted in PDF however, the price /cost proposal must be submitted In MS Office Excel.

7 We noticed that this solicitation is procured as best value rather than by the qualifications-based Brooks Act (per FAR 36.6). Our understanding is that services classified as engineering (NAICS 541330) are required to be procured using procedures in FAR 36.6. Specifically, FAR 36.601-3 Applicable contracting procedures states that “ (b) Sources for contracts for architect-engineer services shall be selected in accordance with the procedures in this

The requirements of this procurement do not require us to follow the procedures of FAR 36 – Construction & Architecture-Engineer Contracts. We understand how industry could conclude using NAICS Code 541330 can cause some confusion. The NAICS code purpose on RFP/RFQ is for Small Business Size Determination (http://www.sba.gov/sites/default/files/files/Size_Standards_Table.pdf) http://www.sba.gov/sites/default/files/files/Size_Standards_Table.pdf

Attachment 005: Solicitation Questions & Answers May 21, 2013 subpart rather than the solicitation or source selection procedures prescribed in Parts 13, 14, and 15 of this regulation. “

Since NAICS 541330 is classified as engineering services shouldn’t this acquisition be governed by FAR 36.6?

only. The PSC code reference is what determines what type of services that is being procured and it is correct on the RFQ/RFP. So to clarify and mitigate the confusion, the NAICS codes has been changed from 541330 (Engineering Services) to 541618 (Other Management Consulting Services) to better align with the PSC Code and to mitigate any other potential confusion or misunderstanding. Additionally, the NAICS code is the standard used by Federal statistical agencies in classifying business establishments for the purpose of collecting, analyzing, and publishing statistical data related to the U.S. business economy. The NAICS code used does not determine the procurement or contract type used.

The services impact public safety and should be performed or supervised by a registered professional engineer. FAR 36.6 requires such services be selected based on qualifications. What are you referring to as professional engineers?

All engineers that are registered professionals are covered under architect engineering services. Systems and software engineers are not registered professionals. NAICS Code 541330 engineering services are included in FAR 36.6

See the response to question number 7 above.

9 The solicitation was posted as “Draft”. We assume this was done to allow interested contractors an opportunity to submit final questions specific to the solicitation. We would greatly appreciate an opportunity to submit clarifying questions. Could HUD please provide the procedure and schedule for question submissions?

The draft is a system error on FBO website. The FBO system administrator was notified of the glitch and they could not resolve the problem. The files listed under draft are finalized documents. Please disregard the “draft”.

10 An extension of the solicitation due date to provide interested firms ample time to produce a competitive response. We respectfully request a 30 day response period.

The first sentence is not a complete sentence.

The proposal due date has been extended to June 3, 2013.
