I. Agency and Contracting Activity.

460th Contracting Flight, Buckley SFB, CO

II. Nature and/or description of the action being approved.

The system currently suffers from slow network speeds (10 MBS), lack of memory, and poor communication. No replacement parts exist for the outdated, existing Delta Controls DCU-050 components. Therefore, to prevent impact to the facilities outlined in the Statement of Work, an replacement/upgrade is recommended in case of system failure. The Delta Controls EnteliBUS line of managers and controllers would allow for a simpler plug-and-play installation and enhance communication by increasing the network speeds to 100 MBS.

III. Description of supplies/services required to meet agency needs.

Replacement of existing Delta Controls DCU-050 with Delta Controls EnteliBUS line of managers and controllers in eleven

(11) facilities. The existing building graphics will have to be relinked to the new controller address. The contractor shall provide as-built drawings.

IV. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above.

The two local companies that were contacted for market research about the requirement are able to meet the needs. The equipment has to be brand name (which, both contractors can meet). See below information in section V giving details and an example as to why Delta Controls must be used.

V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under

FAR 5.202 applies.

In accordance with FAR 6.302-1(a)(2)(iii)(B), this requirement can reasonably be fulfilled only by the original source item because an award containing any other item would result in unacceptable costs and delays in fulfilling the agency's requirements: a seamless replacement of the existing DCU-050's. Introduction of third-party software (in this case, a brand other than Delta Controls) would result in equipment (chillers, for example) being unable to communicate with the Emergency Management Control System (EMCS) network. Bottom line: any equipment procured that does not tie-in with the EMCS will not meet the agency's requirements. See example below.

An Allerton-brand controller was installed within the Restricted Area. This equipment does not communicate with the existing Delta Controls in EMCS; 90 CES are unable to remotely control the cooling and must manually activate the equipment inside. The alarm shop subject matter experts stated that one brand should be used to avoid these problems in the future as 90 CES does not have the resources to observe/maintain any additional manually-activated equipment, nor the capability to re-program/repair third-party software that is unable to communicate with the EMCS. Additionally, conversion of the EMCS to a different software to match the managers/controllers procured through this requirement would require a costly overhaul of re-wiring and installation of additional sensors basewide, which is unfeasible at this time.

A notice will be published.

VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer anticipates the costs for this effort will be fair and reasonable. The Contracting Officer will make a determination as to the price fairness and reasonableness based on, but not limited to, the following recommendations:

Program Office technical evaluations; historical cost information, competitive quotes, and the Independent Government Estimate (IGE).

VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

There are at least two control system companies in the Denver Metro area that can provide the Delta Controls: ATS Rocky Mountain (large business) and Setpoint Systems (small business). Both have the capabilities to meet the requirement for 90

CES.

VIII. Any other facts supporting the use of Other Than Full and Open Competition.

Introduction of third-party software (any brand other than Delta Controls) would result in equipment being unable to communicate with the Emergency Management Control System (EMCS) network. The anticipated award of this contract will ensure continuation of critical mission essential services at BSFB.

IX. List of any sources that expressed, in writing, an interest in the acquisition.

Two local companies (SAM registered) expressed interest, and provided a quote to 90 CES that was used in the IGE provided to 460 CONS. The two businesses are Rocky Mountain ATS, and Setpoint Systems who are both listed under vendor information in the Market Research Report (MRR).

X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.

Market Research found one of the vendors contacted was a Small Business and the other was a Large Business. identifying that this Delta Controls requirement is Brand Name, their SAM registration information was looked up. Delta Controls (CAGE L5261) is listed as a Large Business in SAM, thus requiring this acquisiton to be full and open competition due to the non-manufacture rule.

XI. Certification by the Contracting Officer.

As evidenced by my signature above, I certify that this justification is accurate and complete to the best of my knowledge and belief.

XII. Certification by the technical/requirements personnel.

As evidenced by my (our) signature(s) above, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
