Amendment A0002

SF 30, Block 14 - Description of Amendment/Modification (continued)

Introduction:

I. The purpose of this amendment is to make the following changes to the Solicitation, and to provide responses to questions submitted concerning the subject Solicitation.

Part I of this amendment consists of changes to the subject solicitation.

I. G.4 Task Orders Issued Under Multiple Award Contracts, A.7, (pg 24) is hereby revised to read as follows:

In accordance with section 1331 of Public Law 111-240 (15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility identified in FAR Part 19 apply.

II. L.3.C. COPIES, (pg 72) is hereby revised to read as follows:

Offerors must submit (1) Original and two (2) copies of the Cost and Business Proposal (Volume I) and one (1) Original and five (5) copies each of the Technical Proposal (Volume II). The Cost and Business Proposal must also be submitted on a virus-free CD in Microsoft Office 2007 compatible format. Offerors should ensure that their subcontractor(s) also submit the required number of copies even if the subcontractor sends its proprietary proposal data directly to the Government.

III. L.3.D. Proposal Format, 6.Title Page, (pgs 72, 73) is hereby revised to read as follows:

The title page, which shall not count against the page limitation of the proposal of each volume, shall include the following:

a. Title of proposal

b. Volume number and title

c. RFP number

d. Name, company address, and telephone number of the Offeror

e. Authorized signatures (The title page for each volume shall be signed by an official authorized to bind the Offeror)

IV. L.4.D. Section II- Information Other Than Cost and Pricing Data, Subcontracts, (pgs 78, 79) is hereby revised to read as follows:

The guidance in FAR Part 16 should be followed. For example, those Offerors contemplating Time and Material (T&M) or Labor Hour subcontracts shall follow the procedures specified in FAR Subpart 16.6. The Government anticipates that subcontracts will be predominantly Cost- Plus-Fixed-Fee except for consultants which will be either T&M or Labor Hour.

The Offeror must address all aspects of anticipated subcontract consent. Offerors should consider what type of consent each subcontractor is eligible for when establishing subcontracting teams. A subcontractor’s accounting system must have been reviewed by a Federal Government audit agency (such as the DCAA or DCMA) and determined by the CO to be adequate for determining costs under a cost reimbursement contract before consent may be given for a cost- type subcontract. The Government may obtain accounting system reviews for cost-type subcontractors after task order award, but those reviews could take a minimum of 120 days. In the interim, the CO may consent to a time-and-materials subcontract until the acceptability of the accounting system can be established. Offerors should consider what type of consent each subcontractor is eligible for when establishing subcontracting teams. If a subcontractor’s accounting system has been reviewed by a Government audit agency (such as the DCAA or DCMA) and determined by the CO to be adequate for determining costs under a cost reimbursement contract, the subcontractor’s proposal must be submitted as a CPFF type subcontract.

Cost-Plus-Fixed-Fee subcontractors should submit proposals in accordance with the Cost and Business Proposal instructions in this section except subcontractors DO NOT use Schedules 3, 4, 7, and 9.

V. L.4.D. Section II- Information Other Than Cost and Pricing Data, Subcontracts, Schedule 4 – Establishment of Maximum Factors and Calculation of Proposed Amounts For Fixed Fee, (pg 86) and Profit is hereby revised to read as follows:

Offeror Name:

Fixed Fee Estimated

Cost Percentage

(3) Fixed Fee Dollars

Subcontracts, Equipment, Travel Cost, Offeror-estimated ODCs, and RFP-stipulated ODCs (1)

All Other Costs from Schedule 2 (2)

TOTAL $

TOTAL FIXED FEE

DOLLARS (4)

Profit Estimated

Cost Percentage

(3) Profit Dollars

Subcontracts, Equipment, Travel Cost, Offeror-estimated ODCs, and RFP-stipulated ODCs (1)

All Other Costs from Schedule 3 (2)

TOTAL $

TOTAL PROFIT

DOLLARS (4)

(1) "Subcontracts, Equipment, Travel Cost, Offeror-estimated ODCs, and RFP-stipulated ODCs” should not include any Prime indirect burden.

(2) “All Other Costs” should include all remaining costs from Schedule 2 and 3 except cost of money if proposed.

(3) “Percentage” is the fee or profit percentage the Offeror uses to develop fixed fee and profit. The percentages will be incorporated into Paragraph H.8 of a resultant contract and will be used to calculate maximum fixed fee and profit that an Offeror may propose at the task order level. Offerors may always bid less than the calculated maximum.

(4) Fixed fee, and profit on Schedules 2 and 3 should be calculated on the tables above.

VI. L.5.D. Parts Of The Technical Proposal, Part B – Past Performance (Volume II), the second paragraph of page 98 is hereby revised to read as follows:

Offerors must send a Client Authorization Letter (Exhibit C) and a Past Performance Questionnaire (Attachment J.4), to all non-Federal Government references listed in the five most relevant sources to assist in the timely processing of past performance evaluations. Client Authorization Letters must be mailed (or sent electronically by e-mail) to individual references in sufficient time to allow completed past performance evaluations to be received by the Volpe Center by the due date of the Offeror’s Technical Proposal. Offerors are responsible for ensuring that Client Authorization Letters and Past Performance Questionnaires are completed and returned to the Volpe Center CO no later than the proposal due date. Offerors shall also include a copy of all completed Client Authorization Letters or e-mails as part of your Past Performance submission. Attachment J.4 will be posted to Federal Business Opportunities as part of Amendment A0002.

Part II of this amendment consists of responses to questions submitted concerning the subject solicitation.

Q1: RFP Part B – Past Performance (Volume II) on page 97 indicates that the Volpe Center uses the Contractor Performance Assessment Report System (CPARS) as its primary method to enter past performance information. Unfortunately, our customers do not and have not utilized CPARS as a performance reporting tool and we are not in a position to require them to do so. With this in mind, would the Volpe Center consider alternative methods for gathering and reviewing past performance information such as a Past Performance Questionnaire completed by our customers and returned directly to the Volpe Center Contracting Officer? If so, can the Volpe Center provide a Past Performance Questionnaire form that we can use.

A1: Offerors shall comply with Part B – Past Performance (Volume II). In addition please see Part I, roman numeral VI of this amendment.

Q2: Please confirm that an OCI plan needs to be submitted by each sub. (L.4.E, page 93) A2: Please see Exhibit B: Checklist for Schedules (pg 82) for guidance.

Q3: Please confirm that G&A and Fixed Fee should not be calculated against the subcontractor costs and subcontractor burden in Schedule 2. (Schedule 2, page 84) A3: The Government cannot respond to this question. The Government cannot comment on an Offeror’s accounting system practices.

Q4: Please confirm that the subcontractor costs in Schedule 2 should only be burdened with the prime’s subcontractor burden. (Schedule 2, page 84) A4: The Government cannot respond to this question. The Government cannot comment on an Offeror’s accounting system practices.

Q5: Section L.4.A states the period of performance for this will be 4/1/14 - 3/31/15 L.4.D "Labor Escalation" instructs to escalate to the performance mid point. Based on L.4.A the mid point of performance would be 10/1/14. Schedule 6 - requires offeror to escalate labor to Contract Year one. Please clarify?

A5: Yes, 10/01/2014 is the contract year one (1) mid-point.

Q6: Section G.4 para A. 7 – The last sentence is not complete. It currently reads .. “When setting aside orders for small business concerns, the specific small business program eligibility …” Please clarify?

A6: Please see Part I, roman numeral I of this amendment.

Q7: Section L.4.d "Subcontracts" - please clarify if the government "will" or "may" obtain accounting systems review on cost reimbursement subcontracts.

A7: Please see Part I, roman numeral IV of this amendment.

Q8: Section M.3 states that Cost Realism will be conducted on all CLINs. CLIN 0101 is a Firm- FixedPrice CLIN FAR 15.304(d)(3) allows for COST REALISM ANALYSIS to be performed on “competitive fixed-price-type contracts when new requirements may not be fully understood by competing offerors, there are quality concerns, or past experience indicates that contractors’ proposed costs have resulted in quality or service shortfalls.” Can you confirm that this is why you are referring to in the RFP? If so, how will this be evaluated? Will it be used in assigning performance risk and/or responsibility determinations?

A8: As discussed in FAR 15.404-1(d) cost realism will be conducted on all CLINS.

Q9: Will the government provide copies of task order SOWs issued under the existing contracts?

A9: No, the Government will not provide copies or task order statement of works (SOW’s) issued under the existing contracts.

Q10: Section "6. Title Page" on Pg. 73 of the RFP mentions including an "index" on the title page of the proposal. We are not exactly sure what the government is looking for with an “index.” Please clarify and/or describe further.

A10: Please see Part I, roman numeral III of this amendment.

Q11: Section "Resume Format" on page 96 of the RFP states,"Relevant dates and names and addresses of educational institutions and employers must be provided for all experience, education, and specialized training claimed." Typically the Government only requires city and state not the entire address. Is the requirement to provide the entire address including number, street name, city, state, and zip code?

A11: The solicitation is asking for addresses of educational institutes and employers, not an entire address.

Q12: Will there be any Sample Task Orders for this evaluation?

A12: No.

Q13: What are the current or planned task orders that may be solicited under this contract?

A13: At this time the Government will not disclose any information on potential task order requirements.

Q14: Who are the contractors currently performing this work today at Volpe?

A14: The CNS & ATMS contracts will be the successors to the Communication Navigation Surveillance Systems and Transportation Traffic Management (TTM) Support contracts awarded by the Volpe Center in 2009. The below links provide the award information for the CNS/TTM contracts.

Q15: Can you provide the years of experience and education requirements for the Senior Staff, Middle Staff, Staff, and Junior Staff.

A15: Reference Attachment J.2 – Labor Category Qualifications (pg 108).

Q16: Do subcontractors with approved cost accounting system fill out all of the items identified in the Cost type Subcontractor column on page 82?

A16: Reference Exhibit B: Checklist For Schedules (pg 82).

Q17: In Schedule 8, can you please clarify Proposed Rate/Factor." Is Proposed Rate per hour? Is Factor a percentage? Can Offerors provide either a Proposed Rate or percentage or must they provide both?

A17: Offeror is not required to provide both (rate/factor); proposed rate/factor listed depends on Offeror’s accounting system.

Q18: Instructions indicate the Cost and Business Proposal (Volume I) must be submitted in a format compatible with Excel 2007. Do you require all of Volume I including submitted narrative in Excel 2007?

A18: Please see Part I, roman numeral II of this amendment.

Q19: In the "Profit" portion of Schedule 4, in the 2nd row, the wording in first column, reads, "All Other Costs from Schedule 4 (2)." Should that read, "All Other Costs from Schedule 3 (2)"?

A19: Please see Part I, roman numeral V of this amendment.

Q20: The labor category for JUNIOR STAFF reads, “- to perform successfully in this capacity, the individual must have a combination of education and experience totaling eight (8) years in a technical area directly related to the SOW.” The Summary Table notes state,“ • A Bachelor’s degree in a directly related discipline to the SOW is equivalent to eight (8) years of professional experience.” If someone is performing work in the technical area but has a four year degree in another discipline, can that degree be equivalent to 4 years of professional experience? This would be applicable to all labor categories where education is used to determine experience.

A20: No.

Q21: Part B, Paragraph 1, Page 96, of the RFP says that offerors shall submit their past performance information as a separate part of their proposal for both the Offeror and major (over 20 percent of the hours in the Cost and Business Proposal) proposed subcontractor(s). How many past performance reports are required for major subcontractors? Are major subcontractors also expected to submit five evaluation reports of their own as well as a list of all relevant contracts over $500,000?

A21: In response to the first part of the question, from the list of contracts provided the Offeror shall determine the five most relevant contracts that demonstrate its ability to perform the proposed effort. In response to the second part of the question the answer is No.

Q22: Section I. 5, paragraph 4, of the RFP mentions that Program Manager and Task Area Managers are to be specified at time of award of contract (p. 55). However, Section L.5.D, paragraph 1 under Task Area Manager(s), on page 95 says the Program Manger and Task Area Manger must be identified and their resumes submitted with the proposal in Volume II. We assume that the latter is correct, but can the government clarify this discrepancy?

A22: There is no discrepancy. The Government will list in Section I.5 Key Personnel, the approved Key Personnel at time of contract award.

Q23: Section L.3.C, Paragraph 1, Page 72 of the RFP specifies that the cost and business proposal “be submitted on a CD in a virus-free format compatible with Microsoft Excel Version 2007.” If this version of the application is no longer available to an offeror, is it permissible to use Excel (2010) but save the final file to be compatible to Excel (97–2003)?

A23: Yes, this is acceptable as long as the submitted format is compatible with Microsoft Office 2007. Additionally, please see answer to Q18:

Q24: The RFP specifies in Section L. 5. B., Paragraph 1, on p. 94 that past performance “submittals are subject to the same font size and margins as noted in Section L.3.D – Proposal Format.” The Contractor Performance Report format found at the PPIRS website does not meet the proposal font or margin requirement. Does the font and margin requirement apply to past performance evaluation reports?

A24: No, font and margin requirements do not apply to performance evaluations using the Contractor Performance Assessment Report System.

Q25: With regard to past performance in Section L.5.D., Part B, Past performance, on page 96, if the offeror includes a subcontract (where the offeror functioned as a subcontractor) as one of the five most relevant contracts, can the prime complete the past performance report?

A25: No, please review information contained in Part B – Past Performance (Volume II)

Q26: Section L.5.D., Paragraph 1 under Resume Format on Page 96 of the RFP states that “relevant dates and names and addresses of educational institutions and employers must be provided for all experience, education, and specialized training claimed.” What should the offeror do if the address information is no longer available because a previous employer or a special training program no longer exists?

A26: Offeror shall provide information that corresponds to the requirements of the solicitation.

Q27: Section L.3.D, the 6th item under 6. Title Page, on page 73: Please explain what index is required on the title page.

A27: Please see response to Q10.

Q28: Section L.5.D page 102 states “Offeror may bring no more than six persons to the oral presentation, plus no more than two non-presenting Offeror officials or employees.” We would like to confirm this means a maximum of eight Offeror representatives are allowed at the oral presentation?

A28: Please review instructions in Part C – Oral Presentation for information on attendees.

Q29: In section L.5.D page 96 it states “Offerors shall submit their past performance information as a separate part of their proposal for both the Offeror and major (over 20 percent of the hours in the Cost and Business Proposal) proposed subcontractor(s).” Can past performance information for non-major (less than 20 percent of hours in the Cost and Business Proposal) subcontractors be used?

A29: No, Offeror shall comply with solicitation instructions.

Q30: Section L.5.D page 96 states that “In addition, the list [of past performance contracts] must include those applicable contracts reflecting the involvement of the proposed Program Manager or Task Area Managers.” If these individuals are from non-major subcontractors, then should those relevant contracts also be included on the requested past performance contract list?

A30: No.

Q31: Section L.3.D page 72 states that “The proposal pages shall be numbered and printed doubled side.” Elsewhere double sided printing seems to be an option. Is it a requirement that all proposal content be printed double sided?

A31: Submittals must follow guidelines in Section L.3.D – Proposal Format and L.5.B. Page Limits.

Q32: Would it be beneficial to provide an acronym list to the evaluators, but not have it included in the page count?

A32: The Government cannot provide a response to this question.

Q33: Section L.3.D page 73 states that the Title Page content under “Item f” would contain an “Index”. Does this mean a separate Index for the volume is required or that an actual Index must be included on the title page? Our interpretation is that we are to include a table of Contents (index) in the volume and that it is required to be on the Title Page. We are requesting that the TOC (index) be a separate page.

A33: Please see response to Q10.

Please acknowledge receipt of this amendment with the submission of your proposal.

All other terms and conditions of the solicitation remain unchanged.
