Questions / Clarifications

The following questions and issues were submitted via email at eflhd.contracts@dot.gov. The Government response or clarification is provided. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised and some questions have not been included. The Government’s direct response to the sender may also have been updated below for better clarity.

1. The timeframe to complete this project (125 Calendar Days) is very aggressive with the constraints of the project (number of soldier piles, number of tiebacks, cobbles and boulders;

limited working area and probable tree interference. Please consider allowing more time to complete this project. If the Contractor fails to complete the project on time; what penalties is he responsible for (Liquidated Damages, Administrative Costs?) Please clarify amounts Contractor will be penalized.

Response: The roadway is closed to traffic and there are no work restrictions related to days or times. We do not intend to add extra time to the contract's timeframe. Liquidated damages are based on the original contract price, administered according to Subsection

108.04 of the FP, and cannot be determined until contract award. Please refer to Subsection 108.04 for further information.

Moreover, as stated in the B Page Instructions, the purpose of using a Contract Administrative Cost is strictly for the evaluation and ranking of the bids received during the solicitation and award process. The assigned price, in this case $2,700 per calendar day bid, is the price per day that the Government has determined that the Government will have to incur if the Contractor completes the work after the contract's performance period ends. The cost is a "cost to the Government" not a contractor cost. The Contract Administrative Cost is not intended for bidders to use in their bid pricing or their own administration or management costs.

The Contract Administrative Cost will not be included in the award amount of the contract. The Contract Administrative cost is not a substitution for liquidated damages nor is it an addition to liquidated damages.

2. Is this project tax exempt?

Response: Refer to Federal Acquisition Regulation (FAR) Clause 52.229-3 Federal State and Local Taxes, for tax requirements.

3. Is there a location in the park to dump the concrete, asphalt, trees, or brush that will be removed?

Response: No. There is no location in the Park to dump the concrete, asphalt, trees or brush that are removed. The Contractor will be responsible for disposing of materials outside of the Park according to Subsection 203.05(a).

4. It states on the plans that the Rumble Strip can be found in Detail 401-A but I cannot locate this detail in the specs supplied with this project or the US DOT standards. Please advise.

Response: Please refer to Plan Sheet S06 (Detail #E401-A - Rumble Strips).

5. Is there a planting schedule? The specs only specify the types of plants and the line items only specify the amount, but no quantities of each type are found.

Response: There is no planting schedule. Refer to Subsection 626.03 for requirements.

6. Does this project have a Veteran requirement?

Response: This Solicitation has a Veteran’s Employment Reporting Requirement. Refer to FAR clause 52.222-38 Compliance with Veterans’ Employment Reporting Requirement.

Instructions are provided in the Notice to Bidders and the Checklist for bid submission.

Eastern Federal Lands Highway Division (EFLHD) has included a copy of the VETS 100A form with the bid documents online. Contractors still are required to complete this form and submit per the instructions to Veterans’ Employment and Training Service website.

Provide EFLHD with a copy of the fax sheet or e-mail showing the report has been submitted to VETS 100 as required.

7. Is there a specification for the Anti-Graffiti coating?

Response: Refer to Subsections 552.16(f) and 725.30 for graffiti-guard requirements.

8. There is no bid item for the Geocomposite Sheet drain for the wall. Which bid Item should this item be included in?

On Plan Sheet R09 at the bottom it show a detail with 1” Geocomposite Sheet Drain installed on the back of the precast lagging panels; what is the width of this material? 4’ is a standard width;

please advise.

Response: Geocomposite drain is not required for this project. Revised Plan Sheets R09 and R10 have been included in Amendment 2.

9. Can excavated materials that are excavated under the subexcavation item 20402-0000 be used in the embankment construction within the prism of the roadway?

Can milled asphalt be used in the embankment construction within the prism of the roadway?

Can milled asphalt be used to fill in the subexcavation area within the prism of the roadway?

Can crushed concrete be used to fill in the subexcavation area within the prism of the roadway?

Response: No.

Questions/Clarifications Page 3 of 6

10. Can excavated materials that are excavated under the subexcavation item 20402-0000 be used in the embankment construction outside the prism of the roadway?

Can milled asphalt be used in the embankment construction outside the prism of the roadway?

Can crushed concrete be used in the embankment construction outside the prism of the roadway?

Response: If the roadway material meets the requirements for embankment material it can be used for embankment. See Subsections 204.03 and 204.10 for embankment material requirements.

11. The drawing R10 shows that the precast concrete lagging below the ground anchor will be full sized panels while the panels that are at level with the ground anchor will be shorter as to allow movement past the anchor. The lower panels will not be able to be installed past the tie backs after they have been installed if they are full width and if they are to be installed prior to the tie backs, damage may occur. Should the lower panels all be the shorter width?

Response: The lagging panels below the ground anchor should remain the full sized width. The diagonal dimension of the panel is less than the clear distance between the soldier pile webs, which means the panel can be angled to fit past the ground anchor interference, and then straightened to fit between the webs as shown on Plan Sheet R10.

12. Are any permits needed for this project?

Response: All environmental related permits have been obtained by the Government.

Depending on the Contractor's means and methods to perform the work, the permits listed in Subsection 107.01 may be required for the project, and are the Contractor's responsibility to obtain. See 107.01 of the FP and SCR's for further details.

13. The estimated quantity of cedar rail fence is shown as 475 LF on sheet C01 in the estimated quantities column. On the plans, using the stations on drawings D01 – D02, there is a total of 632 LF. Please clarify.

Response: The quantity of cedar rail fence is incorrect on Solicitation B Pages and Plan Sheet C01. Revised Solicitation B Pages and Plan Sheet C01 have been included in Amendment 2.

14. Please confirm that the pay quantity for Item 55201-0200 Structural Concrete, Class A (AE) will be the actual Cubic Yards of concrete in the precast concrete lagging panels use in the wall.

Response: Yes, this item is only to account for the concrete in the lagging panels.

15. Please clarify/confirm that Item 55215-0000 - Concrete Color Finish is to compensate for the INTEGRAL concrete coloring required for the precast lagging panels. In addition; please

Questions/Clarifications Page 4 of 6 clarify pay limits for this item; is it the actual surface area of the precast concrete lagging panels used? Please confirm/clarify.

Response: Refer Subsection 552.03 for requirements. The pay limits are the surface area of the concrete panels.

16. For Item 55212-000 - Clean Concrete Surface (Graffiti Guard) please clarify the limits to be coated and the pay limits for this item. Is Graffiti Guard being applied to the soldier piles themselves and if so is this part of the pay quantity. Please clarify.

Response: Refer to Subsection 552.16(f) for requirements. Apply graffiti guard to all surfaces above the finished grade.

17. Follow up to response to question 5. in Amendment No. 1: The response states that “If large trees are required to be removed, they are only allowed to be removed between 4-1 and 9- 30; this is in direct conflict to the contract documents; which is correct, please advise.

Response: The original contract documents are correct. Large trees are NOT to be removed from April 1 to Sept 30.

18. Follow up to Question 5. In Amendment No. 1: Will overhanging branches/limbs that interfere with installation of drilled shafts and/or installation of the permanent ground anchor be allowed to be cut/removed on this project which will be in the restricted time of 4-1 to 9-30;

please clarify. In addition; if there is interference with limbs/branches/trees that cannot be removed; will the Contractor be liable for the tree related penalties outlined in Section 107 on pages J-8 and J-9; please advice. It is a situation that the Contractor can’t do the work and possibly being penalized for something he has no control over; please clarify

Response: For a complete response, please see Question #5 included with Amendment 1 and as summarized here: Removal of small trees, stumps, shrubs, branches etc., required to perform the work, will be allowed inside the project limits. Large trees within the limits of excavation have already been removed.

Tree damage related penalties will apply as stated in Section 107.

19. Follow up to Question No. 15 in Amendment 1: How is the underdrain outlet quantity being paid for?

Response: The underdrain outlet will be paid for under Pay Item 60501-0000 - Standard Underdrain System.

20. Follow up to response to Question No. 20 in Amendment 1: The response indicates that the pay quantity for Subexcavation is the limits outlined on the cross sections by the dashed lines. It appears that the plan quantity is overstated; please check quantity and revise as required. Please confirm that the pay quantity to the left of the new wall is the vertical line 3’ behind the new wall

Questions/Clarifications Page 5 of 6 for areas outside the existing wall and the face of the existing wall (vertical) and down 6’ and then horizontal over to the back of the Select Granular Fill. Please confirm.

Response: The subexcavation pay quantity and limits have changed. All excavation to the right of the new wall will be subexcavation. All excavation to the left of the wall will be subsidiary to the work required for the contract. Please see Subsection 109.05 of the FP for further details and explanation.

The quantity of subexcavation has been revised in the Solicitation B Pages and Plan Sheets C01 and CO3, and have been included in Amendment 2.

21. Please advise if the area in front of the existing wall, between the existing wall and the back of the select granular backfill and below existing grade that is shown to be excavated as part of Subexcavation; will be paid and is part of the Embankment quantity (Item 20420-000) when it is replaced when the new retaining wall is backfilled; please clarify.

Response: Please see response for Question #20 for further information.

22. How will excavation and/or benching excavation required either to bring a section to grade or bench for embankment construction be paid for? There is no Roadway Excavation pay item;

please clarify.

Response: Please see response for Question #20 for further information.

23. Will material that is excavated on the project that is required for ultimate Embankment Construction but can’t be placed until a later date from when it is excavated; be allowed to be stockpiled on the existing paved areas beyond the end of the project for later use? Please advise.

Response: Stockpiled material can be placed on roadway beyond the end of the project in a location approved by the CO. Pavement damaged as a result of the Contractor’s operations will be required to be repaired.

24. Please clarify if PA APPROVED Materials will be acceptable for the aggregates required for the products. The materials in the specifications are not virgin to northern Pennsylvania, and will not pass the tests that are required. The specifications are written for material out of the geographic region of this project. Please advise, I would assume if the material is acceptable to the Pennsylvania Department of Transportation, and the project is a state road, this would be acceptable.

Response: For a complete response, please see Question #10 included with Amendment 1 and as summarized here: A state approved asphalt mix design can be submitted for approval during construction.

25. If the Pennsylvania Department of Transportation has approved the said materials, will the stringent testing be required to have these aggregate materials retested?

Questions/Clarifications Page 6 of 6

Response: All material will be required to meet the specifications of Sections 105, 153, and 154, and as described in the "Acceptance" Subsection of the Section calling for the work.

26. What is the maintenance period associated with the Maintenance Bond?

Response: Maintenance Bonds are not required; Bid Bond requirements are in section C of the solicitation and must be completed and returned with your bid. Also the Contractor that the contract is awarded to will be required to provide Performance and Payment Bonds for the full contracted amount within 14 days after the awarded date.
