NIST Response:

NIST does intend for offerors to break down their proposed pricing by task in the MS Excel Pricing Worksheet. NIST will take this under advisement and consider making the necessary changes to the Pricing Worksheet for the official RFP.

NIST Response:

Contractors often have different fully burdened hourly rates for work performed at Government facilities (onsite) vs work performed off site at Contractor facilities. Typically, contractor overhead costs are not applied to Government onsite work, as overhead costs may include facilities expenses, training, supplies, software, recruiting, etc, as the Government is providing the facility and usually supplies. However, it is up to the offeror whether they propose different onsite vs offsite rates.

NIST Response:

The NAICS code assigned to this acquisition is 541519-Other Computer Related Services. In order to meet the small business requirement for this procurement, the contractor must be small under the applicable size standard which is establshed at $30 million dollars of average annual receipts. Contractors need not have this NAICS code listed in their SAM profile to be eligible, but contractors must meet the small business size standard of this NAICS code.

This is in line with how most Start-up and large tech companies develop software. This Task should require that the contractor implement an Agile development process with a Scrum Master to lead the effort and follow the standards of SDLC.

NIST Response:

NIST is tasking one key personnel and is not looking to fund a team of software "developers" through a formal Agile development process including a Scrum Master to lead the effort. If the key personnel should have such skills, they would be welcomed. The key points of the overview list common practices of source code maintenance (via Github) and using Docker images as described.

The Government has determined that based on market research, the strategy to set aside for small businesses is most appropriate without specificying specific award tracks within different socio-econimic categories. However, small businesses of any socio-economic category may submit a proposal for consideration if meeting the applicable size standard.

Considering that the government intends to do Past Performance Evaluations using the PPQs, does the government require Past Performance narratives in Volume 1 – Non-Price Volume – Base IDIQ? If so, does the government intend to specify how long each narrative should be?

NIST Response:

Please refer to page 65 of the SF1449. Specifically, the Proposal cover page, executive summary, definitions for acronyms page, Table of Contents, resumes, Schedule of Labor Categories, and completed Past Performance Questionnaires (PPQs) will not count towards the page limits listed for Volumes I & II. Additionally, refer to the instructions for "3) Past Performance" beginning at the end of page 66 of the SF1449. The Government does intend for offerors to submit past performance info via the PPQ, or via official CPARS assessments in place of the PPQ format. However, in addition to these submissions Offerors may also provide a narrative(s) of their past performance within Volume I of the proposal. Just note that only the PPQ submissions (or official CPARS assessments) are excluded from the Volume I page limit and would be submitted as attachments to Volume I. While the Government does expect that offerors may provide some form of narrative regarding their past performance in Volume I, any narrative outside of the PPQ attachments will be subject to the page limits of Volume I.

The government recommends that Offerors provide at least 3 to 5 Past Performance Questionnaires for services similar in size and scope to those of this requirement, for work completed or substantially completed within the last five (5) years. Considering the size of the IDIQ to be $45 Million, it will be very difficult for small businesses to provide past performances of that size. Considering this, can the government clearly specify a dollar threshold that is much lower than $45M for the past performances? Will the government be willing to accept our recommendation that such dollar values should be in the $5-10 Million range?

NIST Response:

Please refer to page 67 of the SF1449, while it is "recommended" the contractor provide at least 3 to 5 PPQ's for services similar in size and scope of this requirment, it is not required to have services performed at the $45 million dollar level.

Please also note that this acquisition not only includes the base IDIQ contract with a $45M ceiling, but it also includes many individual task orders with much lower dollar values (such as the Mock Task Orders).

The Government does intend to consider Offeror's past performance with ordering type contracts such as the anticipated $45M IDIQ contract, but will also consider Offeror's past performance performing work similar in size and scope to the Mock Task Orders included in the Draft RFP.

The payment schedules are typically tied to the deliverables in the PWS of each mock task order. The contractor may add the payment schedules based on the delvierables to the appropriate mock task order tab in the pricing worksheet.

NIST is indicating that Letters of Commitment are required for key personnel for Mock TOs. However, because NIST does not intend on awarding these Mock TOs, it will be difficult to get an LOC from a candidate since it is not tied to real work. Can NIST please waive the LOC requirement?

NIST Response:

NIST intends to revise the referenced section of the Instructions to Offerors to remove the requirement for letters of commitment for Key Personnel proposed for each Mock Task Order. However, note that per page 73 of the Draft RFP SF1449, NIST reserves the right to convert any of the Mock Task Order into an actual, awarded task order based on the evaluation of proposals received. Therefore, Offerors must propose Key Personnel candidates that are actually available to commit in the event that the task order is awarded. Also note that in future task order RFQs, NIST may require letters of commitment.

For multiple qualifications for the key personnel, NIST provides several examples (e.g. for Web Development, NIST lists examples such as Spring, Primefaces, JSF2, JSP, HTML, JQuery, Tomcat). Please confirm that experience in at least one of these examples (e.g., the candidate has five years’ experience in HTML) will cover the overall requirement for the key personnel position?

NIST Response:

The response shall include what the minimum years’ experience includes.

For example in the case referenced in the question (Web Development) the respondent shall provide the experience (in using various technologies) for the what is listed. The Government's list of minimum experience is expected to provide requirements in which the responder addresses all listed, unless the requirement is listed as examples (such as "Minimum 7 years’ experience in Development Process: (Examples include JUnit, Maven, Hudson, Redmine, and Design Pattern)."- for this requirement the respondent would provide the Development Process technology experience over the minimum of 7 years.
