LIMITED SOURCES JUSTIFICATION (FAR 8.405-6)

Justification

The acquisition referenced herein is conducted under the authority of the Multiple Award Schedule Program.

I. Contracting Activity:

Washington Headquarters Services/Acquisition & Directorate (WHS/AD) 1155 Defense Pentagon Washington, DC 20301-1155

Requiring Activity: DAU

II. Description of Action for Approval Brand name approval of RedHat’s Jboss Enterprise Application Platform (EAP) software with managed support service. The estimated value is $58,000.

III. Description of Services Same as above.

IV. Statutory Authority and Rationale for Authority Cited:

FAR 8.405-6 (b) Items peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.

FAR 8.405-6 (b) (2) Documentation.

(i) For proposed orders or BPAs with an estimated value exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold, the ordering activity contracting officer shall document the basis for restricting consideration to an item peculiar to one manufacturer.

DAU’s Business Systems web application was built on Java Enterprise standards and RedHat JBoss Enterprise Application Platform (EAP). The purchase of expanded subscription licenses provides DAU with the latest security patches, as well as vendor support in the event an issue is encountered. DAU requires a subscription to support expanding current RedHat Jboss processor cores. Switching to alternative products or running mixed environments could lead to migration complexities, learning curves, tool limitations, application limitations, and initial set-up and in-house expertise support requirements that are likely to drive up costs.

The RedHat compatibility with existing applications is a feature that is essential to the Government’s requirements, and therefore, justifies the brand name restriction.

V. Best Value Determination and Price Reasonableness.

Market Research indicates that use of ESI is a required source, DFARS 208.7402. The ordering activity has determined RedHat products are available on ESI. ESI has two licensed resellers. Use of ESI’s BPA represents the best value to the government consistent with FAR 8.404(d).

Because the Government anticipates adequate price competition, the price will be fair and reasonable. See A49 (Decision Memo).

VI. Market Research

Market Research indicates that use of ESI is a required source, DFARS 208.7402. ESI has two licensed resellers of RedHat products: Carahsoft and DLT Solutions.

VII. Actions to Increase Competition

DAU is resolved in continuing to monitoring the market to determine the existence of other potential sources/supplies that can meet their requirements. In support of this resolve, this LSJ is for a period of one year.

VIII. Any addition information: N/A
