Request for Proposal Environmental Compliance Training 2021 – 2026

Section B. Services and Prices

Delivery of training to Fish and Wildlife Service’s (Service) employees and contractors.

Background: The Service manages millions of acres of property in the public trust and is responsible for performing operations that are subject to regulation by state, federal, Tribal, and local agencies. The Service has the responsibility of providing high-quality training to its employees and contractors, through formal classroom presentations, webinars, video media, information briefs, and other mechanisms.

Work Description: The contractor will be responsible for coordinating with the Service on providing environmental compliance and other training, as necessary. Such training may take several forms, such as classroom sessions, field training, webinars, and studio training in audio and video formats.

The purpose of Environmental Compliance Training (training) is to:

1. Provide training to new employees and contractors on the applicability of environmental regulations to their facilities and their specific duties;

2. Provide refresher training to existing employees on the applicability of environmental regulations to their facilities and their specific duties within specified periods; and

3. Provide training on various topics that affect Service facility operations. The Service may augment training presentations and provide necessary support materials for inclusion in the training manual.

Types of Training

The Environmental Compliance Training 2-Day Class may be provided in several formats.

Traditionally, is provided in a classroom format. We try to schedule the classes in the

Service’s Legacy Regions (i.e., the Regin designation [Regions 1 through 8] used until the Department of the Interior’s revised Regional structure was introduced in 2018) at a facility with a classroom large enough to accommodate at least 40 students.

Due to recent constrictions, this class has been provided via a Webinar format.

Consequently, the contractor must be able to conduct training through Microsoft TEAMS (the current format), or other formats that may be utilized by the Service. The inability of the contractor to use any Service-required meeting and presentation software would be terms for termination of the contractor.

The material covered in the 2-day training class covers the bulk of the requirements to meet the Occupational Safety and Health Administration (OSHAs) standard 29 CFR Part 1910.120 Hazardous Waste Operations and Emergency Response (HAZWOPER) 8-hour Refresher Training. The contractor must be able to meet the requirement to cover the materials listed in the class Syllabus (attached).

At the end of the second day’s training, students who opt to be recertified for HAZWOPER remain after the other students are released. The contractor must be certified to be able to conduct the 8-hour refresher training and will provide the material that is missing in the full class. Typically, this training lasts approximately two hours and is considered as part of the training day. No extra fee is paid for providing this training.

The Service may off other additional training. Currently, we provide an additional half-day of transportation-related training for students who require U.S. Department of Transportation (DOT) training on the shipment of hazardous materials and hazardous waste. These Service employees and contractors are generally located at remote facilities, and the Service will specify whether we will be adding this or other additional training to a particular class.

The Service has also provided the HAZWOPER 40-hour and 24-hour training under this contract. The contractor must be certified to provide this training and have a facility available that is adequate to conduct the training.

Other environmental training may be provided under this contract, and we require a contractor with a broad set of environmental compliance, site investigation, and remediation knowledge and experience. The contractor must be able to provide any emergency training or be able to subcontract with an adequate certified contractor who can provide the training.

Conditions:

1. This contract shall be in the form of an Indefinite Delivery, Indefinite Quantity (IDIQ) contract.

2. The IDIQ shall be for a fixed price as described in Section M except for the costs of travel, lodging, and miscellaneous expense that may vary for each class. The travel and miscellaneous expenses must be estimated by the Contractor before each Task Order for a class.

3. All Contractor travel shall receive prior approval by the COR.

4. The Task order process shall be as follows:

• The COR shall issue a scope of work for the task to the contractor.

• The Contractor shall respond within 10 calendar days with a proposal, which shall include a cost schedule as well as responding to any requirements specified in the Task Order.

• The Service shall respond to the Contractor’s proposal by either accepting, rejecting, or asking for revisions or clarifications.

• Once the Service has signed the Contractor’s proposal, it shall be binding on both parties.

5. All electronic course materials shall be returned to the Service at the conclusion of the contract.

6. A table of an escalation rate for each of the five years of the contract will be included. The escalation rate shall be for 2% over the previous year’s rate. This rate will be approved at the beginning of each contract year by the COR, and such approval shall be based on the satisfactory completion of all tasks the previous year; it may be denied due to unsatisfactory performance. The determination of extending the escalator shall be the at the discretion of the COR.

7. The escalator rate may be modified due to the inflation rate. Should the inflation rate exceed 2% per annum, the escalator rate table may be modified each year to match the applicable

The application conditions of the modified escalator table shall be subject to the other conditions stated in Condition 6., above.

Section C. Requirements and Documents.

1. The successful offeror must be able to demonstrate possession of the following knowledge and abilities;

a. Knowledge of the Department of the Interior’s (Department) and Service training policies and procedures.

b. Experience developing and narrating Service or similar agency audio, video, and classroom training.

c. Knowledge of pertinent Occupational, Safety, and Health (OSHA) regulations.

d. Knowledge and use of U.S. DOT hazard classes, labels, and placards.

e. Knowledge and use of National Fire Protection Association (NFPA) 704 System labels.

f. Knowledge of the Globally Harmonized System (SHS) labels.

g. Knowledge and use of Hazardous Materials Identification System (HMIS) labels and placards.

h. Familiar with the Service’s compliance audit program and the connection between the training and auditing programs to maintain compliance Service-wide.

i. Department and Service Environmental Management Systems (EMS) implementation strategies.

j. Be able to produce an environmental compliance and hazardous materials identification training manual for review as part of the selection process. This manual may of similar training provided to other government agencies. The manual may be provided as a hyperlink to a document that may be accessed by the Government.

k. Posses the ability to host a large webinar using the Service’s current webinar platform;

currently they are MS TEAMS, Cisco Webex, and MyMeetings (audio).

The specific skills and knowledge required are listed in Section M.4., Factor 3.

2. The Service expects that most classes will have 40 or fewer students; however, it is possible that larger may classes occur, especially in the webinar format.

3. The Service expects that all classes will be located within the United States and Territories and Possessions.

4. The contractor must be able to conduct the webinar training from their location, thereby eliminating travel costs, and at sites determined by the Service. Travel costs are subject to General Services Administration (GSA) travel and per diem requirements.

5. Offerors must provide references to previous training experience, such as:

Access to (such as on-line viewing reviewing) class manuals and other class materials developed, including videos, handouts, etc. (It is not necessary to submit hard copies;

Lists of customers, including their training requirements;

Copies of any recommendations from previous or current clients.

Copies of any student evaluations.

Notifications of unsatisfactory performance from any previous client.

6. The contractor must be able to print original copies of any Service training materials, including manuals and handouts. The Service will provide original electronic files in commonly available software. They may not be “copied”; all images must be clear and legible (hence the requirement to be originals). The copies handed out to students may be copies of the original produced either by the COR or the Contractor. Relevant sections must be in color, as directed by the Service’s Contacting Officer’s Representative (COR).

7. The contractor will submit an estimate of the costs of each course and be approved by the COR prior to conducting each course. The cost of the class shall be a fixed price fully burdened rate. Additional instrument fee per attendee may be included if appropriate. The costs for travel, meals, and incidentals may vary for each course, reflecting the relative per diem cost of the course location. All travel must be in accordance with FAR 31.205-46 and the COR must provide prior approval. The COR will notify the contractor by e-mail of the approval or disapproval of the cost proposal.

8. The contractor will develop and use a class attendance list. The contractor will prepare course completion certificates after each course and save them in the PDF format. The PDFs of the certificates will be provided to the students by the contractor within 10 calendar days after the completion of the course.

9. The contractor will assist the Service develop training media that can be sent to prospective students unable to attend the classroom sessions. Such media may include video presentations of the class materials in CD, DVD, or other electronic formats. The contractor will assist the Service develop the presentation of the materials and consult with the COR on depth of subject coverage. All media must comply with Section 508 for visually and hearing impaired and for any accessibility impairment such as launching the video without the use of a mouse. See https://www.section508.gov/for more information. The Service reserves full usage rights to all media developed under this contract.

10. The contractor shall be prepared to provide additional training products to the Service, as required.

Section F. Deliverables.

1. The contractor will assist development of new training materials when requested. At present, all the materials listed below are current.:

Deliver the non-governmental portion of training classes, based upon the labor rate specified under the Fee Table in the Contract.

Revise the existing class manual as directed by the COR. This process will begin with review of the existing class manual, and in consultation with the COR, determine which portions of it will be revised. The COR will provide direction on additional topics to be discussed and based upon the labor rate specified in CLIN 0030.

Develop a new class manual. The COR will specify what tasks are to be performed. The contractor will submit a cost estimate for approval to the COR, based upon the labor rate specified in CLIN 0030.

Webinars. The contractor shall be prepared to assist in the development of new or revised webinar materials, including scripts, topics for discussion, and participation in the presentation of the webinar based upon the labor rate specified under CLINs 0010, 0050, or 0060.

Assist revisions to the 2-day Webinar PowerPoint presentation. The presentation will include videos inserted into the presentation, photographs to illustrate points being made in the audio portion, PowerPoint animation of many slides, and other PowerPoint features as directed by the Service based upon the labor rate specified in CLIN 0030.

Video presentations. The contractor will assist the COR develop video scripts and scenarios, travel to any shooting site, and participate as required, including being a presenter based upon the labor rate specified in CLINs 0020 or 0030.

Hazardous Waste Operations and Emergency Response (HAZWOPER) and other specialty environmental training. In some cases, there may be very short lead time between a call for this training and providing it. Such training will be performed based upon the labor rate in CLINs 0010, 0050, or 0060.

Other materials. The contractor shall be prepared to assist in the development of new or revised materials, such as Fact Sheets or other materials based upon the labor rate specified in CLINs 0020 or 0030.

2. The contractor must be prepared to deliver a cost estimate for all activities under this contract within 10 calendar days of notification of the course site by the COR.

3. The contractor must be prepared to deliver classroom or webinar presentations within 14 calendar days of the Service approving the course cost estimates.

4. The contractor shall revise any course materials with changes directed by the Service. These changes will be provided to the contractor within 30 calendar days prior to the scheduled course offering. The contractor will provide the COR with either an electronic or a printed copy of the final course materials 14 calendar days prior to the scheduled course offering.

5. It is not anticipated that a test will be administered for successful completion of the class;

however, the contractor should be prepared to develop and administer a test if directed by the COR for the environmental compliance training class as well as other training performed under this contract.

6. The contractor may be asked to distribute course materials to students and maintain an inventory of class materials, such as Fact Sheets, etc. The fee is based upon the labor rate specified in CLIN 0040. These materials will be provided by the COR.

7. Technical consulting. The contractor may be called upon to provide technical expertise and advice to the Service when required. The fee for these consulting costs based upon the labor rate in CLIN 0070. These fees must be approved by the COR.

8. All dates herein specified may be altered at the convenience of the Service.

Section G. Contract Administration.

Include payment information, such as where and how to submit an invoice.

Section L. Instructions, Conditions, and Notices to Offerors or Respondents.

Section M. Evaluation Factors.

1. Award will be made on the basis of the best value trade off evaluation meeting the technically acceptable standards of all the non-price factors. The evaluation factors other than cost or price when combined, are significantly more important than cost or price. The Government intends to select the Best Value offer on the basis of initial offers received, without discussions. Offerors may be given the opportunity to clarify certain aspects of quotes (e.g., the relevance of an offeror's information to resolve minor or clerical errors.)

2. Factor 1. “Past Performance.” Demonstrate experience conducting environmental compliance training to professional field staff and managers. Experience should include conducting training of at least 2 days duration in both classroom and webinar formats.

Provide a list of clients for whom training has been successfully conducted, including any comments received from the client on specific training. Be specific with client names, dates, class content, and client contact information and include any comments received, both favorable and unfavorable. If you have not conducted environmental compliance training, demonstrate successful equivalent training that your firm has conducted, including a discussion on how the training provided demonstrates your competence in conducting environmental compliance training, in a classroom setting, as a webinar, or other means of training delivery.

3. Factor 2. “Technical knowledge.” Demonstrate knowledge of environmental statutes and operations, such as (but not limited to):

• The Resource Conservation and Recovery Act (RCRA);

• The Clean Water Act (CWA), including Oil Pollution Prevention;

• The Clean Air Act (CAA);

• The Safe Drinking Water Act (SDWA);

The National Pollution Discharge Elimination System (NPDES);

The Underground Injection Control (UIC) program;

The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA);

The Occupational Safety and Health Act (OSHA) (specifically regarding the worker right-to-know section and HAZWOPER);

The Comprehensive Environmental Response, Compensation, and Liability Act

(CERCLA);

The Toxic Substances Control Act (TSCA), specifically regarding PCBs, asbestos, radon, and lead-based paint);

The Oil Pollution Act (OPA);

The Spill Prevention Control and Countermeasure (SPCC) Plan requirements;

The Underground Storage Tank (UST); and hazardous materials management programs;

The Safety Data Sheet (SDS) format and use; and Universal Waste requirements.

Demonstrate knowledge of Tribal, state, and local governmental participation in regulation and enforcement of environmental regulations.

Discuss the specific content of your proposed training class and webinar. This content should address issues that are currently an issue with the Service, as well as suggestions for additional content. These topics could change at the discretion of the Service. Currently, the training addresses the following topics:

Hazard communications program, including Hazard Communications (HAZCOM) Plans;

Labeling systems (Hazardous Materials Identification System (HMIS), National Fire

Protection Association (NFPA), and U.S. Department of Transportation (DOT));

Shipping requirements, both hazardous and non-hazardous materials and wastes;

Hazardous and non-hazardous solid waste management (RCRA);

Toxicity Reduction – Green Purchasing Recycling and the reduction of waste generation;

Asbestos management;

Lead-based paint in Quarters (housing) management;

Radon;

Recycling and the reduction of non-hazardous waste generation;

Emergency Planning and Community Right-to-know Act (EPCRA);

Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA);

Polychlorinated Biphenyl (PCB) management;

Universal Waste;

Used Oil management;

Listed and characteristic hazardous wastes;

Storage, segregation, and shipping;

Hazardous materials table (49 CFR 172.101);

Emergency response to spills; Service-allowed actions by Service personnel (see Service

Manual Chapters 241 FW 3 and 561 FW 17);

Spill reporting;

Air pollution, especially open burning;

Reduction in the use of toxic and hazardous materials;

Safety Data Sheets (SDSs), including the difference between SDSs and MSDSs;

Munitions and Explosives of Concern (MEC) and UXO safety and actions when discovered;

Drinking water and the Safe Drinking Water Act (SDWA);

Wastewater and the National Pollution Discharge Elimination System (NPDES) permits;

Environmental reporting, sampling, and testing;

Class V Underground Injection Control (UIC) wells;

Managing unknowns;

Audits – both Service- and regulator-conducted;

Spill Prevention, Control, and Countermeasure (SPCC) Plans;

The Service’s Environmental Management System (EMS) implementation; and Service resources available to facilities to assist with environmental compliance.

4. Factor 3. “Price.” The cost of providing high-quality training to the service is important. A blank Fee Schedule is provided. Proposal shall include this table being completed with your fee proposals. This is for the proposed cost of the training; travel expenses, including air fare, per diem expenses, lodging, and car rental are not included; they are understood to be variable. Please note: all travel expenses must meet the GSA per diem rates.

Key:

CLIN 0010 – This is the cost of providing a training class at a Service site, such as a Refuge or Regional office. It includes conducting the training by Webinar format. and the fee granted for participating in Service-directed training activities, such as participating in a training video.

CLIN 0020 – This the fee, per hour, for assisting the Service develop training materials, such as revising the Class manual or webinar presentation.

CLIN 0030 – This fee is what the contractor would charge, per day, to develop major portions of the training materials.

CLIN 0040 – This is the fee granted for mailing materials to students via FedEx or UPS. Using the U.S. Postal Service (USPS), as directed by the COR, will be at the USPS rate, not the rate in this CLIN.

CLIN 0050 – This is the cost of providing a half day of the training class at a Service site, such as a Refuge or Regional office. It includes conducting the training by Webinar format and the fee granted for participating in Service-directed training activities, such as participating in a training video. This is ½ of the CLIN 0010 rate.

CLIN 0060 - This is the hourly cost of providing the training class at a Service site, such as a Refuge or Regional office. It includes conducting the training by Webinar format and the fee granted for participating in Service-directed training activities, such as participating in a training video. This is ⅛ of the CLIN 0010 rate.

CLIN 0070 – This is the hourly rate for providing technical consulting as requested by the Service. This must be approved by the COR.

CLIN 0080 - This is the additional per day fee if travel to provide training exceeds one day, thereby causing the Contractor to lose otherwise billable time.

CLIN 0090 – This is the additional per-hour fee if travel to provide training exceeds one day, thereby causing the Contractor to lose otherwise billable time. The per-hour fee would only apply if a portion of the day can be charged for Service training. This is ⅛ of the CLIN 0100 rate.
