STATEMENT OF WORK
TRASH REMOVAL AND DISPOSAL
West Point Commissary US Military Academy Building 1200, West Point, NY 10996
1. CONTRACTOR’S RESPONSIBILITY: The Contractor shall provide all personnel, supervision, equipment, tools, parts, transportation, and other items necessary to perform removal, pickup and disposal of trash at the commissary location covered by this contract.
The Contractor is required to provide container(s) in accordance with the Equipment paragraph below.
The Contractor is required to comply with all local, state and federal regulations applicable to the removal, transportation and disposal of solid waste. All charges pertaining to the removal and transportation including but not limited to maintaining, emptying, transporting and dumping such containers and all state and local feed for the proper disposal of the waste shall be included in the Contractor’s price for this solid waste services.
The Contractor shall pickup from the facilities based on the frequency schedule identified below and in the schedule to this contract with the exception of holidays specified in the contract. Normal pickups for the West Point commissary shall be made three (3) days per week on Monday, Wednesday, and Friday during the normal business hours of the commissary, as stated in the contract and shall not interfere with the normal commissary operations.
2. NOTIFICATION: Upon notification of contract award, the Contractor shall provide the
Store Director* with a point of contact and phone number to receive service calls. The Contractor’s representative shall coordinate with the Store Director for services under this contract.
3. PERSONNEL: Contractor personnel must be recognizable while on Government property by means of uniform or identification badge or patch.
4. COMPLIANCE WITH ENVIRONMENTAL PROTECTION AGENCY (EPA)
AND ASSOCIATED
FEES: The Contractor shall comply with all applicable EPA guidelines and procedures during the performance of this contract. The Contractor shall, without additional effort by or cost to the Government, maintain and acquire all permits in accordance with local, state, and federal regulations applicable to removal, transportation and disposal of refuse.
Disposal shall be at an off-base location. The Government will assume no liability or responsibility for the Contractor’s compliance or noncompliance with such responsibilities. All charges pertaining to providing, maintaining, emptying, transporting and dumping containers and refuse shall be included in the contactor’s price for services.
5. EQUIPMENT AND PICKUP: The Contractor shall provide all equipment necessary for the performance of this contract. Roll-offs shall meet industry standards and shall be leak proof. For this contract there are two types of containers (temporary roll offs and government owned trash compactor).
Government owned: For normal solid waste pickups there is a government owned eight (8) cubic yard trash compactor. The Contractor is required to empty the trash compactor three (3) days per week; see Item 1 above for specific pick up days, estimated annual cubic yards is 1,248. The Contractor is not responsible for routine compactor maintenance. However, the Contractor is responsible for any damages caused by the Contractor while providing service, transportation and cleaning of compactor.
Contractor provided equipment: A 40 cubic yard roll-off for a period of one week twice during each year of performance. The commissary needs to contact the Contractor and request the temporary roll-offs. The purpose of the roll offs and for semi-annual and annual commissary cleanup.
NOTE: The government reserves the right to reduce the number of containers and the frequency of pickups during the performance of the contract. The government will provide 30 days’ notice to the Contractor and issue a modification to the Contractor indicating the necessary changes.
6. SANITATION AND MAINTENANCE: All equipment, including trucks and roll-offs will be serviceable, clean and well-maintained condition.
a. Although the compactor is government-owned, the Contractor is responsible to remove and thoroughly power wash the compactor two (2) times per year. The Contractor is responsible to remove, transport and return the compactor on the same business day. The compactor will be cleaned to include the blade with soap or detergent, removing all trash debris and be free of unpleasant odors. The Contractor must ensure compactor is operational prior to leaving the commissary and is responsible for any damage during the removal, transportation and cleaning of the compactor. The commissary is responsible to notify the Contractor and coordinate the compactor cleaning service.
b. The temporary roll-off containers will be serviceable and leak proof.
c. The Contractor shall not collect or dispose of any material which has obvious value and appears to have been inadvertently placed near the collection point unless such material is designated as refuse by the Store Director.
d. The Contractor shall be responsible for the cleaning of any spillage that occurs during the transport of the solid waste from the commissary location as well as in and around all facilities, roads and highways while in route to the solid waste disposal location.
7. VEHICLES: The Contractor shall provide all vehicles required to fulfill the requirement. Vehicles shall be in operable condition; meet all local, state and federal safety requirements; painted or present a neat appearance; and shall bear the Contractor’s name on both sides. The Contractor is responsible for obtaining pass/identification forms and ID from the installation and shall comply with posted speed limits and base safety regulations while on post grounds.
8. BASE ACCESS – SECURITY (Reference clause 52.204-4500):
a. The Contractor shall be responsible for obtaining installation access as required for all Contractor employees authorized to work at the site, and shall ensure that sufficient personnel have proper access to ensure compliance of contract delivery and service schedule. It is not the responsibility of the commissary employees to escort the contract personnel performing the services onto the base.
b. The Contractor shall be responsible for ensuring full compliance with all installation access procedures. Installation access includes, but is not limited to, obtaining applicable installation passes and inspections for vehicles and personnel. Contractor employees may also be subject to background security checks/clearances in order to obtain credentials for passes. Some installations are using programs, such as RAPIDGate, which may result in a cost to the Contractor. Any costs associated with such programs or with obtaining passes, will not be reimbursed separately and should be included in the Contractor's proposed pricing for the product or services being acquired.
9. INCLEMENT WEATHER SCHEDULE: The Contractor shall collect refuse during the periods of inclement weather. Exceptions to this may be authorized by the Store Director in cases of unduly severe weather. When exceptions are granted, the Contractor shall accomplish all collections for each day missed within 24 hours after the severe weather has terminated. Rescheduling to provide make-up collections shall not be a basis for a claim by the Contractor for additional compensation.
10. EXTRA COLLECTIONS: The Contractor may be required to make extra refuse collections as a result of holidays, special events, etc. The extra collections shall be made within 24 hours after notification by the Contracting Officer or Store Director. The Contractor shall be reimbursed for extra collections at the rate specified in the schedule/contract. Extra trash compactor pickups will not exceed three (3) per year and capacity will not exceed 24 cubic yards per year.
11. MISSED PICK-UPS: The Contractor shall be required to collect refuse at missed pick-up points at no additional cost to the government. Such collections shall be within 24 normal working hours after notification by the Store Director or designated representative.
ENTERPRISE-WIDE CONTRACTOR MANPOWER REPORTING: The contractor SHALL report all contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Defense Commissary Agency (DeCA) via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: https://dodcmra.dmdc.osd.mil.
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September
30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2022. Contractors may direct questions to the help desk at: dod.ecmra-odc-supportdesk@mail.mil.
