STATEMENT OF WORK

Software licenses for Michoacan State

General Attorney

1. BACKGROUND

The State of Michoacan currently confronts a significant variety of public security issues, related to high impact crimes tied to Transnational Organization Crimes (TOC), including homicides, persons disappearances, illicit firearms, and drugs trafficking. INL aims to improve the Forensic capacities of the Mexican State Attorney General Offices (AGOs); through the accreditation of its forensic labs, providing assessment, training, technology, and professionalization; and the delivery of courtroom expert witness testimony training; this time collaborating with the State of Michoacan. INL has historically supported Mexico’s efforts to resolve criminal cases through expanding law enforcement capacities and strengthening the Mexican judicial system, addressing, and combating the criminal organizations and networks in accordance with the Bicentennial Framework goals.

2. OBJECTIVE

The Michoacan AGO genetics laboratory requires specialized software to effectively utilize and manage DNA forensic analysis on crime scene and missing persons cases. These software tools are essential for data analysis, evidence processing, equipment calibration, and ensuring the accuracy and reliability of genetic testing results.

Line # Description QTY Technical Specs

1 PlexorR Analysis Software

- Forensics v1.6.0 (updated version)

1 Plexor™ technology employs fluorescently labeled amplification primers for multicolor multiplexing. Simultaneous quantitation of autosomal, Y-chromosomal and internal positive control targets necessitates detection of at least three colors, with one target per color. Development of multicolor chemistry dictates the use of compatible real-time PCR instruments.

To best integrate this chemistry with the needs of forensic laboratories, we have limited analysis to instruments that are four-color-capable, use a 96-well plate format and produce quality data, such as those from Applied Biosystems and Stratagene. Data from these instruments can be exported for analysis in the Plexor™ Analysis Software. The Plexor™ System analysis software package, allows users of different real time PCR instruments to analyze, produce and share data in a common format. This software is available at no charge to customers using the Plexor™ System. Data are exported from the instrument software as a *.txt or *.tab file or a file with a similar format. The Plexor™ Analysis Software includes a simple Importer, which allows the user to define the run and analysis details, then select the raw data file(s) to be imported. The Importer includes optional template functions for customizing the plate layout for routine assays and plate layouts.

The vendor shall follow the invoicing procedures established by INL to allow the U.S. Embassy Mexico to reclaim the IVA/VAT taxes charged. VAT, or “IVA” as it is known in Mexico, shall be itemized in all invoices. Before the vendor may impose and collect VAT on its “tax-relief invoices,” the vendor is required to obtain a VAT Registration Identification Number from the Secretaría de Hacienda y Crédito Público (aka Hacienda). VAT issued under the name and Federal Fiscal Mexican Register of a Mexican Company is excluded from reimbursement.

The vendor shall provide the necessary invoicing to enable the USG to obtain reimbursement for VAT. This tax relief benefit is extended only to the U.S. Government – not the vendor – as a diplomatic privilege. The current tax-relief invoicing requirements are outlined in the paragraphs below.

The vendor is responsible for providing the following list of items on every “tax-relief” invoice presented to the U.S. Government. Every invoice the vendor delivers to the U.S. Government shall be in accordance with VAT Mexican Tax regulations (VAT: http://www.diputados.gob.mx/LeyesBiblio/ref/liva.htm) (Invoice requirements, article 29 A of the Fiscal Mexican Code: http://www.diputados.gob.mx/LeyesBiblio/ref/cff.htm).

Invoices for the in-country purchases described above shall not include other charges, such as “work completed” or design costs. Such invoices shall list separately or collectively the pre-tax price of any supplies or services provided in country.

As is required by local authorities, the vendor shall impose the appropriate tax rate against the pre-tax total of the purchases represented on the tax-relief invoice. The vendor shall submit the invoices associated with such purchases as supporting documentation for its in-country payment request. The USG shall only compensate the vendor for the tax amount provided on such invoices, after the completion of the contract.
