DRAFT Statement of Work (SOW) for Little Blue III

1.0 INTRODUCTION

1.1 This Statement of Work (SOW) provides Naval Surface Warfare Center Philadelphia Division (NSWCPD) the ability to support various sponsors and stakeholders for various Navy Modernization Programs utilizing the Alteration Installation Team (AIT) process. This effort shall provide blue collar installation and associated technical services for upgrading Hull, Mechanical and Electrical (HM&E) systems and deploying technologies, which improve availability, increase reliability, ship readiness, and decrease maintenance and workload requirements for machinery systems and components. The target platforms of installation are primarily on U.S. Navy Surface Ships. This SOW outlines general contractor requirements and will be supplemented by specific work statements in individual task orders. Task orders will vary in requirements, from full scope of the technical services of this SOW to narrow portions of the SOW.

1.2 SUBSAFE work will not be authorized under this contract. No industrial type work within SUBSAFE boundaries on submarine platforms will be authorized by this contract.

1.3 Government/Contractor Relationship

1.3.1 The services to be delivered under this Contract and its subsequent Task Orders are non-personal services and the parties recognize and agree that no employer-employee relationship exists or will exist between the Government and the Contractor's personnel. Therefore, it is in the best interest of the Government to define both parties’ respective obligations.

1.3.2 Contractor employees shall identify themselves as non-government, commercial company employees by introducing themselves or being introduced as Contractor personnel and displaying distinguishable company badges or other visible identification for meetings including any Government personnel. In addition, Contractor personnel shall appropriately identify themselves as Contractor employees in all telephone conversations, written correspondence and any formal and informal conversation pertaining to this contract.

1.3.3 Contractor personnel under this Task Order shall not engage in any of the inherently Governmental functions listed at FAR Subpart 7.5 or DFARS Subpart 207.5.

1.4 Employee Relationship

1.4.1 The services to be performed under this Task Order do not require the Contractor or its personnel to exercise personal judgment and discretion on behalf of the Government. Rather the Contractor's personnel will act and exercise personal judgment and discretion on behalf of their company.

1.4.2 Rules, regulations, directives, and requirements that are issued by the U. S. Navy and NSWCPD under its responsibility for good order, administration, and security are applicable to all personnel who enter a Government installation, step aboard a U. S. Navy ship or who travel on Government transportation. This is not to be construed or interpreted to establish any degree of Government control that is inconsistent with a non-personal services contract.

1.4.3 This contract does not create an employer-employee relationship and accordingly, entitlements and benefits applicable to such relationships do not apply.

1.4.4 The Government and the Contractor are responsibility to monitor contract activities and notify the Contracting Officer if there is concern the intent of this Section has been or may be violated.

1.4.4.1 The Contractor shall provide written notification to the Contracting Officer via letter or email within three (3) calendar days from the date of any incident that the Contractor considers to constitute a violation of this Section. The notice should include the date, nature, and circumstances of the conduct; the name, function, and activity of each Government employee and/or Contractor employee involved or knowledgeable about such conduct; identify any documents or substance of any oral communication involved in the conduct; and the Contractor's estimated date when cost, schedule or performance will be impacted.

1.4.4.2 The Contracting Officer will, within five (5) calendar days after receipt of notice, respond to the notice in writing. In responding, the Contracting Officer will either:

(i) Confirm the conduct is in violation and when necessary direct the mode of further performance,

(ii) Countermand any communication regarded as a violation,

(iii) Deny that the conduct constitutes a violation and when necessary direct the mode of further performance, or

(iv) In the event the notice is inadequate to make a decision, advise the Contractor what additional information is required, and establish the date by which it should be furnished by the Contractor.

2.0 BACKGROUND

2.1 The mission of the NSWCPD is to transition HM&E machinery technology to the U.S. Navy Fleet, and support various sponsors for Navy Modernization Programs. This requires development and execution of various Ship Changes (SCs) to upgrade and maintain in a more cost-effective and timely manner the system/equipment readiness of various Navy HM&E systems.

2.2 This contract primarily supports small, minimally intrusive, turnkey equipment level modernization projects that are generally accomplished pierside at the various homeports outside of Navy Chief Naval Operation (CNO) availabilities. The SC installation process consists of multiple phases including but not limited to; advance planning, ship check, assessments, fabrication, prototype/proof-in install, final design shipboard installation, testing, and completion/close-out.

2.3 This contract covers blue collar support for installations primarily on U.S. Navy Surface Ships. SCs executed under this vehicle are considered minor in scope and impact, and are considered low risk or mature thus being used to mentor and develop the awardee(s) along a path to become viable support options for greater competition for future ship repair and modernization service contracts. Tasking will consist of non-critical path modifications that are not typically complex in nature, lack intricate system arrangement(s), minimally interface with distributive system and are not crucial for meeting key readiness milestones.

2.4 This contract provides for task orders supporting ship/system maintenance and ship/system repair services that are fully bounded and conform to NSWCPD command repair process and policy. This contract also provides for “open and inspect” accomplishment where required to establish applicability and/or conformance to configuration. Examples of allowable repair work include:

(i) Equipment/system repair that interfaces with an approved SC and would need to be fully operational in order to successfully light off and test the SC.

(ii) General maintenance items governed by NAVSEA Standard Items that are scoped below the cost effective range for solicitation on the standing ship repair contracting vehicle (MSMO) outside of an availability.

(iii) Teaming efforts with established small and large blue collar installation contractors whereas work in this environment will promote and foster learning opportunities that develop the awardee(s) knowledge and experience to become viable support option. However, teaming partners cannot bill more than 49% of the associated task order.

3.0 SCOPE OF WORK

3.1 The contractor shall provide all required labor, materials, and resources to modify shipboard and shore-based systems. Industrial services include fabrication, system/equipment pre-install testing, shipboard installations, logistics/material support, Quality Assurance inspection and completion documentation. Additionally, the contractor shall be prepared to provide all necessary resources including personnel, consumables and tooling to affect ship system installations and surface ships in locations throughout the United States. Requirements and specifications, along with Government Furnished Information/Equipment, will be provided for each individual task order.

3.2 Technical Services Required

3.2.1 Contractor shall provide teams to support Alteration Programs with blue collar installation labor and tooling for shipboard equipment modifications. The Contractor shall be able to support a minimum of three (3) simultaneous installations in different ports.

3.2.2 Contractor provided services for procuring specific, non-Government Furnished Material (GFM) required for fabricating, assembling, installing, and conducting the testing for each tasked SC.

3.2.3 Contractor adheres to In-Process Control Procedures (IPCPs) utilizing NAVSEA Standard Items and adapts their process for installing the SC to the requirements.

3.2.4 Contractor provides Quality Assurance and inspection to support the SC installation along with Objective Quality Evidence as outlined in the specific task orders.

3.2.5 Contractor will attend project meetings as required by the government task manager, visit government field and industry sites, provide written comments covering any questions and concerns with the tasking (including its drawings, written instructions, mandated procedures and QA requirements) before its planned execution, and conduct inventory reviews of both hardware and software supplied as GFM and procured directly to ensure all necessary items are available and accounted for.

3.3 Planning

3.3.1 Conduct SC Installation Planning

3.3.1.1 Provide necessary facilities, equipment, tools, security badges, and trade personnel to accomplish installation of tasked SC.

3.3.1.2 Conduct pre-installation site surveys/ship checks on designated ships with representatives of the program, ISEA or Subject Matter Experts (SME) to identify situational interferences between NAVSEA approved installation documents and specific as found conditions.

3.3.2 Ensure that all applicable personnel are briefed on their responsibilities at least five (5) and again at two (2) working days prior to starting each separately task/installation per task order placed on this contract.

3.3.3 In accomplishing this work, the contractor shall provide all required resources including the necessary facilities, equipment, consumable materials, tools and qualified/trained trade personnel to support planning, management, logistics, technical support, fabrication, and installation of the alteration components/systems/interface equipment as listed in the SOW and the technical installation instructions and reference documents.

3.3.4 Ensure compliance with all applicable safety regulations, including obeying and providing for local/specialized requirements (as applicable) of personal protection equipment (PPE) including, hardhats with chin straps, steel toed safety shoes, safety eye wear, and hearing protection.

3.3.5 Conform to shipboard routine with regard to cleanliness, personnel conduct, and the ship's security and integrity.

3.3.6 Using NAVSEA Standard Item 009-004 and REFs (4.3) & (4.40), the contractor shall develop a QA Workbook for each installation to be maintained and updated on-site. These workbooks shall be used to keep an in-process record of Quality Control Inspections. The first workbook will be provided to NSWCPD for review, no later than two weeks after contract award. A completed copy of the QA Workbooks shall be provided to NSWCPD Personnel within two weeks after completion of each installation, including a scanned/digital copy of sections 6 and 7. (CDRL A***) The QA Workbooks shall be formatted as follows, and as stipulated in REF (4.3):

Sect. 5 Ship Installation Drawing (SID) List

Sect. 6 Test and Inspection (T &I) Plan - This plan should identify areas requiring in-process inspections by annotating steps as Inspection (I), Verification (V), or Government (G) Points. This plan shall also incorporate all testing requirements.

Sect. 7 Test & Inspection Records 3.3.7 The installation POA&M (CDRL A***) shall be updated weekly at a minimum whenever an installation is in progress and updates shall be provided to the OSIC & SME/Project Manager.

3.3.8 The contractor shall provide transportation, staging, and security for all contractor furnished material (CFM) & Government furnished material (GFM) in and around the installation site and at contractor facilities. Additionally all miscellaneous installation material will be ordered, staged, and stored at these local locations. The contractor shall package CFM for storage, shipping, and transportation IAW commercial practices. The outside of any container used for shipping shall visibly display the SME’s name and phone number and designation of the tasking associates (i.e: “MA-XXX” where “XXX” is the MACHALT # of the associated material for each SCD).

3.3.9 The contractor shall maintain identity of all items of material issued/shipped using a DD Form 1149. Contractor shall provide copies of the DD Form 1149s to NSWCPD Personnel upon request.

3.3.10 The contractor shall be responsible to supply all support services including crane lifts, rigging, power, air, and HAZMAT abatement & disposal independent of the ship or homeport facilities.

3.3.11 The Contractor shall provide a monthly progress & financial status report of Task Order tasking & funding. Reports shall include funding and task completion percentages, and all identified disconnects between work completion and funds expended shall be addressed. Specifically, the tracking report shall show percentage of work completed versus percentage of ceiling expended. The report shall also include a summary of final costs for all funds expended on a per-hull/ship/installation basis. The first report shall be delivered to NSWCPD thirty (30) days after the task order award and updated and submitted every 30 days thereafter until completion of all tasking. (CDRL A*** & A***)

3.3.12 Before the passage of thirty (30) calendar days after completion of each installation on a Task Order, the Contractor shall provide a Lessons Learned Report (CDRL A***) that details specific challenges encountered and mistakes made before and during the course of the installation. The report shall describe steps that were taken to mitigate impacts as well as the outcome of each situation. The Contractor shall describe steps that could have been taken to further mitigate impacts, but were not.

3.3.13 The contractor shall maintain and provide a material inventory report on a monthly basis to the MACHALT Project/Program manager, COR and SME detailing the status and location of all CFM and received GFM. (CDRL A***).

3.4 Installation Execution Requirements

3.4.1 Ensure all work scheduled and accomplishments meet schedule requirements in the POA&M (CDRL A***) discussed in paragraph 3.3.6 All discrepancies shall be coordinated and discussed with the Government OSIC, SME, and local MACHALT waterfront coordinators.

3.4.2 The contractor shall provide installation support and quality assurance per the references in paragraph 4.0. All shipboard industrial work will be accomplished IAW NAVSEA TS9090-310G (current revision), NSWCPD SOP 4720.1 (current revision), and all NAVSEA STANDARD ITEMS (current revision).

3.4.3 The contractor shall supply a Daily Work Status Report via Email that will be used to communicate work accomplished, delays or disruptions, design changes, work scheduled for the next day, and any other relevant information. Personnel shall be listed, including labor trade and hours worked that day. The Work Status Report shall be provided to the Government OSIC, SME, and local MACHALT waterfront coordinator by COB each day whenever an installation is taking place (CDRL A***, A***, & A***).

3.4.5 The Contractor shall provide copies of the Condition Reports to the Contracting Officer Representative (COR), the NSWCPD Project Manager and the OSIC/OSR as conditions are noted and provide a compilation report of all Condition Reports upon completion of the Task Order, per Ship. All Condition Reports must be submitted within 24 hours of an incident occurring or condition being found. Any Condition Report that affects the original terms and conditions of the task order requirements must be submitted with an estimate within three days of the incident occurring or condition being found. Price adjustments, if any, for both addition and subtraction of cost, must be approved by the Contracting Officer’s Representative (COR) and the Contracting Officer. This information shall be reflected in the Condition Report Tracking Database (CDRL A***)

3.4.6 The Contractor shall not use a substitute for any parts on the list of materials found in the technical instructions or ship drawings without written approval from the SME and Contracting Officer’s Representative (COR). (CDRL A*** & A***)

3.4.7 Disposition of Removed Material shall be the responsibility of the Contractor and in accordance with disposition instructions provided by the technical instructions or ship’s drawings and shall be documented via Form DD-1149.

3.4.8 All shipment tracking information shall be provided to the SME when it is known.

1.1.1.All unused or excess IAF material shall be turned over to NSWCPD or their representative at the completion of the installation. Inventory list of all materials also is required.

3.4.10 Wire markers shall be typed, not hand written. Cable tags shall contain the cable ID number and connector jack number (if applicable) at each end of the cable. The AIT shall manufacture and install new cable tags with associated jack numbers on all legacy cables that disturbed and/or reattached.

3.4.11 The Contractor shall provide support to NSWCPD and the designated ISEA representative for troubleshooting during the testing phase which will be scheduled following each installation/production completion and for up to three weeks after.

3.4.12 Contractor will assign a Team Leader (Site Foreman or designee) to attend a "team leader meeting" with NSWCPD program/ISEA/SME representatives for review of SC installation requirements prior to initiating work.

3.4.12.1 Prior to the start of work, the contractor shall review the technical installation instruction and reference documents for each alteration/SCD in order to gain a complete understanding of the scope of work.

3.4.12.2 Provide input to NSWCPD program representative for drafting a MOA laying out the installation schedule and ship’s force support requirements (i.e. Tag Outs, System Operation, Space Access, etc.)

3.4.12.3 Provide updates to the NSWCPD program representative and OSIC on all aspects of installation including material status, shipping schedule, installation requirements, proposed financial costs, Quality Assurance, and safety concerns.

3.4.12.4 Coordinate schedule information with NSWCPD program representative, and support the representative as they inform ship's force and other activities as necessary to ensure proper support is available and delays/conflicts are minimized.

3.4.13 Maintain a daily work schedule that is available on the deckplate and coordinate all work with Ship's Force (through the OSIC), and designated NSWCPD Personnel including the Government OSIC, SME, and MACHALT OSR waterfront coordinator. Coordination with Ship’s Force shall be through the OSIC.

3.4.14 The Contractor shall notify the Government OSIC, SME, and MACHALT OSR waterfront coordinator immediately of any technical issues, equipment deficiencies, or any other events that would potentially negatively affect an installation schedule or the cost of a task and then assist in the resolution of any discrepancies as they may occur or are identified during the availability.

3.4.15 Contractor shall provide technical and logistics support for the procurement of all materials listed in the technical instruction or ship’s drawings that are not specifically stated as GFM in the Task Order SOW, including obtaining, staging and shipping to the work site all contractor furnished material necessary for each stage of the installation.

3.4.16 Ensure all trade personnel meet certification requirements applicable to their trade according to qualification requirements in the contract.

3.4.17 Security clearances will be forwarded directly to ships and installation facilities by the Contractor. The Contractor shall request access to ships and DOD commands via DISS DBIDS/BAVR or the equivalent personnel security system used in place of performance.

3.4.18 The Contractor will attend all required ship production meetings and maintain a continuous dialogue with the Government OSIC, SME, and local MACHALT waterfront coordinators. The Contractor will not provide any production reports to the ship’s force directly but only via the Government OSIC.

3.4.19 The Contractor shall provide all general test equipment.

3.4.20 The Contractor shall be responsible for support services including, crane lifts, rigging, power, air, ventilation, welding, & HAZMAT abatement to accomplish the Task Order SOW. All rigging and lifts shall be in accordance with NAVSEA Standard Items as applicable. (Standard Items for power, vent and HAZMAT) 3.4.21 Meet all requirements of NAVSEA STANDARD ITEMS, REF (4.4) at all times.

3.4.22 During any and all installation evolutions it is mandatory the contractor ensure the following minimum requirements are met:

(i) Shipboard Industrial Safety: In conducting task order efforts, comply with applicable safety regulations (OSHA, Navy and OEM Vendor supplied). This includes a mandatory review of the System/equipment Work Authorization Form (WAF) and tag out procedures, and all shipboard electrical training. Localized training required by the cognitive authority Command must be attended and completed by all personnel working shipboard or within Command’s area.

(ii) Conform to existing shipboard routines regarding cleanliness, personnel conduct, and ship's security and integrity.

3.4.23 Ensure that all shipboard work follows the established NSWCPD processes including mandatory use of QA workbooks. These workbooks must adhere to prescribed outlines and include all necessary In-Process Control Procedures (IPCPs), personnel qualifications, personnel certifications, and POA&Ms. These workbooks are required for all shipboard industrial work. See Section *>* 3.4.24 Provide verification of certification for welders, pipe fitters, and all trades requiring certification. Personnel shall carry on their person a copy of the certification at all times during the work evolution. No welder shall be permitted to work, in connection with SCs to vessels, unless they are at the time, qualified to the standards established by the U.S. Coast Guard American Bureau of Shipping or Department of the Navy for the type of welding being performed. No welder shall be permitted to work on production or pre-fabrication applications of welding other than those for which they have qualified and been approved by (the Program Office.)

3.4.25 Adhere to all environmental laws and regulations including federal, state, local, Naval, International, ship and industrial facility. When handling hazardous material and/or waste, handling reports and disposal invoices are required through local procedures. Government will not be responsible for the Contractor’s misuse of hazardous material/waste or for Contractor accident cleanup costs.

3.4.26 Contractor will rehabilitate any spaces affected by their work to original or equivalent condition which includes, but is not limited to:

(i) Cleaning, preparing, priming and painting the new and disturbed surfaces to match surrounding areas.

(ii) Replacing all deck coverings and insulation damaged incidental to installation. If more than thirty five percent (35%) of the deck surface area is damaged, replacement covering of the complete space will be specified. Replace all damaged deck covering with matching styles, colors, and grades in accordance with current requirements.

3.4.27 Contractor will repair all lagging damaged by their work and installing new lagging where appropriate.

3.4.28 Contractor will ensure the proper dressing of all cables for cable bend radius and equipment entry.

3.4.29 Perform a daily thorough cleaning of affected spaces, at end of each shift. Ensure all portable vacuums are emptied at the end of each workday.

3.4.30 Provide input for redlined changes to drawing packages and instructions (if applicable) to the government On-Site Install Coordinator (OSIC), NSWCPD Program Manager and ISEA/ SME NLT (3) days after completion of each installation.

3.5 Commonality of Systems, Subsystems, and Components - N/A

3.6 Manufacturing Phase-Out or Discontinuation of Production, Diminishing Sources, and Obsolete Materials or Components

3.6.1 The contractor shall notify the contracting officer immediately upon determining the unavailability of obsolete materials or components. The contractor may recommend a solution to include the impact on the contract price and delivery. The contractor shall not initiate any item redesign or incur any additional costs without the express, written authorization of the contracting officer

6.0 SECURITY REQUIREMENTS

6.1 The Contractor is responsible for completing all required Government mandated training to maintain security and network access to government sites and IT systems to include but not limited to:

(i) Antiterrorism Level 1 Awareness

(ii) Records Management in the DON: Everyone's Responsibility

(iii) Training and Readiness: The Active Shooter

(iv) NAVSEA Introduction to Controlled Unclassified Information

(v) Operations Security (OPSEC)

(vi) NAVSEA Counterintelligence Training

(vii) Privacy and Personally Identifiable Information (PII) Awareness Training

(viii) NAVSEA Physical Security training and Cybersecurity 101 Training

6.2 Certificates of successful completion shall be sent to the Contracting Officer’s Representative (COR) and as otherwise specified in the contract.

6.3 In accordance with the National Industrial Security Program Operating Manual (NISPOM) (DoDM 5220.22), Contractor personnel that require access to Department of Navy (DON) information systems and/or work on-site require an open investigation or favorable adjudicated Tier 3 by the Vetting Risk Operations Center (VROC). An interim clearance is granted by VROC and recorded in the Defense Information System for Security (DISS). An open or closed investigation with a favorable adjudication is required prior to issuance of a badge providing access to NSWCPD buildings. Furthermore, if the Navy Central Adjudication Facility, have made an unfavorable determination access will be denied.

6.4 Common Access Card (CAC) issuance requires the individual to have an open investigation and/or a favorably adjudicated investigation. Interim security clearance are acceptable for a CAC. Access will be denied for anyone that has eligibility pending in DISS. Vetting through the National Crime Information Center, Sex Offender Registry, and the Terrorist screening database shall be process for a contractor that does not have a favorable adjudicated investigation.

6.4.1 Within 30 days after contract award, the contractor shall submit a list of all contractor personnel, including subcontractor employees, who will have access to DON information systems and/or work on-site at one of the NSWCPD sites to the appointed Contracting Officer Representative (COR) via email. The contractor shall provide each employee's first name, last name, contract number, the NSWCPD technical code, work location, whether or not the employee has a CAC and or Standard Access Control Badge (SACB), the systems the employee can access (i.e., NMCI, RDT&E), and the name of the Contractor's local point of contact, phone number and email address. Throughout the period of performance of the contract, the Contractor shall immediately provide any updated information to the COR when any Contractor personnel changes occur including substitutions or departures.

6.4.2 Contractor personnel that require a badge to work on-site at one of the NSWCPD sites must provide an I-9 form to verify proof of citizenship. The I-9 form should be signed by the company Security Officer or the company Human Resource Department. In addition to the I-9 form, Contractors shall also bring their birth certificate, current United States Passport or naturalization certificate and state issued ID to the NSWCPD Security Officer at the time of badge request to verify citizenship. Any contractor that has unfavorable information that has not been favorably adjudicated, by Department of Defense Central Adjudication Facility (DOD CAF) will not be issued a badge. Finally, contractors shall supply a copy of their OPSEC Training Certificate or other proof that the training has been completed.

6.4.3 In accordance with NSWCPD security protocol, contractor employees who hold dual citizenship will not be granted security clearance to our facilities.

6.5 This effort may require access to classified information up to the CONFIDENTIAL level. No classified data will be generated or stored by the Contractor. The Contractor is required to have and maintain a CONFIDENTIAL clearance. The requirements of the attached DD Form 254 apply.

6.5.1 The contractor is required to maintain a Facility Security Clearance (FCL) in accordance with the DD254 to perform certain work under the contract. Although it is not required at time of award, it shall be obtained within 90 DAYS after award. Otherwise the government will have no obligation to continue ordering work under the contract and may not exercise any of the available options.

6.5.2 The Contractor shall appoint a Facility Security Officer (FSO), who shall (1) be responsible for all security aspects of the work performed under this contract, (2) assure compliance with the National Industrial Security Program Operating Manual (NISPOM) (DoDM 5220.22), and (3) assure compliance with any written instructions from the NSWCPD, Security Office dorothy.d.morton.civ@us.navy.mil.

6.5.3 The contractor shall forward signed copies of DD254s provided to subcontractors to the Naval Surface Warfare Center Philadelphia Division (NSWCPD), ATTN: Security.

6.5.4 The contractor shall direct the subcontractor to obtain approval, through the prime Contractor, for the public release of information received or generated by the sub through the prime Contractor.

6.5.5 The contractor shall submit the subcontractor request for public release through the technical point of contact identified on the DD 254.

6.6 OPERATIONS SECURITY (OPSEC)

6.6.1 The Contractor shall protect critical information associated with this contract to prevent unauthorized disclosure. The NSWC Philadelphia Division's (NSWCPD) Critical Information List (CIL)/ CIIL (Critical Indicators and information list) will be provided on site, if warranted. Performance under this contract requires the contractor to adhere to OPSEC requirements. The Contractor may not impose OPSEC requirements on its subcontractors unless NSWCPD approves the OPSEC requirements. During the period of this contract, the Contractor may be exposed to, use, or produce, NSWCPD Critical Information (CI) and/or observables and indicators which may lead to discovery of CI. NSWCPD’s CI will not be distributed to unauthorized third parties, including foreign governments, or companies under Foreign Ownership, Control, or Influence (FOCI) unless such FOCI has been appropriately mitigated through measures approved by the Defense Counterintelligence and Security Agency. Questions concerning these requirements shall be directed to the PCO.

6.6.2 CUI correspondence transmitted internally on the contractor's unclassified networks or information systems, and externally, shall be protected per NIST SP-800-171, Protecting Controlled Unclassified Information (CUI) in Non-federal Systems and Organizations.

Assembled large components/systems being transported to and from testing areas, other production or government facilities (whether or not on public roadways) shall be in an enclosed van trailer or covered flatbed trailer. Component/System outside storage, staging, and test areas shall be shielded/obscured from public view wherever physically possible.

6.6.3 NSWCPD’s CI shall not be publicized in corporate wide newsletters, trade magazines, displays, intranet pages or public facing websites. Media requests related to this project shall be directed to the PCO, and the COR who will forward the required to the NSWCPD Public Release Authority for review.

6.6.4 Any attempt by unauthorized third parties to solicit, obtain, photograph, or record, or; incidents of loss/compromise of government Classified or CI, Business Sensitive, Company Proprietary information related to this or other program must be immediately reported to the contractor's Facility Security Officer and Cognizant Security Office and/or the Naval Criminal Investigative Service, and the NSWC PD Security Division (Code 105).

6.7 All Controlled Unclassified Information (CUI) associated with this contract must follow the minimum marking requirements of DoDI 5200.48, Section 3, paragraph 3.4.a, and include the acronym "CUI" in the banner and footer of the document. In accordance with DoDI 5200.48, CUI must be safeguarded to prevent Unauthorized Disclosure (UD). CUI export controlled technical information or other scientific, technical, and engineering information must be marked with an export control warning as directed in DoDI 5230.24, DoDD 5230.25, and Part 250 of Title 32, CFR. Nonfederal information systems storing and processing CUI shall be protected per NIST SP-800-171, or subsequent revisions. All transmissions to personal email accounts (AOL, Yahoo, Hotmail, Comcast, etc.) and posting on social media websites (Facebook, Instagram, Twitter, LinkedIn, etc.) are prohibited. Destroy CUI associated with this contract by any of the following approved methods: A cross-cut shredder; a certified commercial destruction vendor; a central destruction facility; incineration; chemical decomposition; pulverizing, disintegration; or methods approved for classified destruction.

6.8 When contractor employees, in the performance of their duties, are exposed to Planning, Programming, Budgeting and Execution (PPBE) data, a Non-Disclosure Agreement (NDA) with all affected contactor personnel must be executed in coordination with the COR and PCO to ensure safeguarding disclosure of this data.

7.0 PLACE OF PERFORMANCE

7.1 Task Order performance will occur on the ships in Norfolk, VA, Everett, WA, Pearl Harbor, HI, Mayport, FL and San Diego, CA as provided in individual Task Orders.

7.2 The location of shipboard work may require the contractor to travel to CONUS locations and Pearl Harbor, HI. All travel shall be conducted in accordance with FAR 31.205-46, Travel Costs, and B-231-H001 Travel Cost (NAVSEA) and shall be pre-approved by the COR (CDRL A002).

7.3 Travel required for tasks assigned under this contract shall be governed in accordance with rules set forth for temporary duty travel in the Department of Defense Joint Travel Regulations (JTR): Volume 2 for Civilian Personnel.

7.4 Travel requirements will be identified in the individual task orders.

7.5 The Government will reimburse the Contractor for allowable travel costs incurred by the Contractor in performance of the contract.

7.5.1 The contractor shall be reimbursed for the actual costs of the most expeditious means of transportation incurred by its personnel not to exceed the cost of tourist class rail or plane fare, whichever is the least expensive, to the extent that such transportation is necessary for the performance of the authorized services herein. Such authorization shall be indicated in individual task orders.

7.5.2 Per diem for travel on work assigned under this contract will be reimbursed to employees consistent with company policy, but not to exceed the amount authorized in accordance with FAR 31.205-46.

7.5.2.1 Whenever work assignments require temporary duty aboard a naval vessel, the contractor will be reimbursed at the per diem rates identified in accordance with FAR 31.205-46.

7.5.2.2 The current “maximum per diem” rates are set forth in the:

(i) Federal Travel Regulations for travel in the Continental United States

(ii) Joint Travel Regulations for Overseas Non-Foreign areas (e.g., Alaska, Hawaii, Guam, Puerto Rico, etc.)

(iii) Department of State (DOS) prescribed rates for foreign overseas locations.

7.5.3 The use of privately owned conveyance within the continental United States by the traveler will be reimbursed to the contractor at the mileage rate allowed in accordance with FAR 31.205-46.

7.5.3.1 Authorization for the use of privately owned conveyance shall be indicated in specific task orders.

7.5.3.2 Distances traveled between points shall be shown in standard highway mileage guides. Rationale for any deviations from distance shown in such standard mileage guides shall be explained by the traveler on his expense sheet.

7.5.3.3 Payment for use of privately owned vehicle outside the 50 mile limit from the contractor's facility will be limited to that equivalent to that rate of the most expeditious means of commercial transportation that would normally have been used.

7.5.4 The Contractor is responsible for making all needed arrangements for their personnel. This includes but is not limited to the following:

Medical examinations

Immunizations, Security clearances, Flight reservations, Hotel accommodations

Car/truck rental.

7.6 The number of times the Contractor may be required to travel to each location cited above may vary as Task Order requirements dictate. The numbers of trips and types of personnel traveling shall be limited to the minimum required to accomplish work as agreed to with the Technical Point of Contact.

7.6.1 Once agreed and before initiating any travel, the Contractor(s) shall submit a detailed and fully-burdened estimate that includes the number of employees traveling, their expected travel costs for airfare, lodging, per diem, rental car, taxi/mileage and any other costs or actions requiring approval.

7.6.2 The travel estimate shall be submitted to the Technical Point of Contact, Contracting Officer's Representative (COR) and Contract Specialist.

7.6.3 Actual costs, resulting from the performance of travel requirements, shall be reported as part of the Contractor's monthly status reports (CRDL ***). The reportable cost shall also be traceable to the Contractor's invoice.

7.7 All travel shall be approved before travel occurs.

7.7.1 Approval of travel must be in written format and received before any cost can be incurred.

7.7.2 The approval may be via email by the Contracting Officer (PCO) or the fully executed Task Order signed by the Contracting Officer.

8.0 GOVERNMENT FURNISHED PROPERTY (GFP)

8.1 Government Furnished Property (GFP) will be specified in individual task orders. All GFP is property of the U.S. Government and shall not be transferred to any individual or agency, public or private, without the express written approval of the originating Contracting Officer except as required for the specific performance of task orders under this contract.

8.2 Contractors are responsible to supply all tools and equipment, including test equipment, necessary to perform this contract. If any tools or equipment will be furnished as GFP, they will be specified in individual task orders.

8.3 Accountability for Government Property under this task order shall be managed in accordance with FAR Part 45 and DFARS Part 245 as well as the Government Property clauses in the Task Order whether acquired by the prime or subcontractors (Contractor Acquired Property), provided by the Government, or received directly from another commercial source as a deliverable from a Government issued contract.

8.4 Government Property accountability requirements are outlined in the following Directives and Instructions and shall be adhered to as applicable:

· DODI 4161.02, Accountability & Management of Government Contract Property

· DoDM 4140.01, DoD Supply Chain Material Management Procedures: Material Returns, Retention and Disposition

· DODI 5000.64, Accountability & Management of DoD Equipment and Other Accountable Property

· OPNAVINST 4440.26B, Operating Materials & Supplies and Government Furnished Material Management

· SECNAVINST 5200.43A, Property Management

8.5 Contractor shall procure and provide all materials incidental to the job, including all material not explicitly called out as GFP in the subsequent Task Orders. The contractor shall also provide all incidental/consumables including minor repair items which may be required to support re-use of existing structure/cables/wiring/mounting/fasteners.

8.6 The Contractor shall perform reporting functions and actions to maintain an accurate accounting of property. Receipt Reporting: DFARS 252.211-7007 requires the Contractor to report receipt of all GFP using the PIEE GFP Module.

8.7 FAR 52.245-1 requires the Contractor to report when GFP is returned to the

Government, and the DoD Vendor Guide requires this notification be provided by posting electronic shipping notification to the PIEE GFP Module. (CDRL ***)

8.8 FAR 52.245-1 requires the Contractor to periodically perform, record, and disclose physical inventory results. While the FAR clause SECNAVINST 5200.43A requires on-hand inventory count reports to support property type specific inventory requirements as set forth in their respective governing instructions. This report is to be delivered according to Exhibit X, Government Property Inventory Report. The Contractor shall provide support within a reasonable time after the Government’s written request to support any Government audit in which GFP, or its related documentation, is requested as part of normal audit processes. (CDRL *** Periodicity)

8.9 FAR clause 52.245-1 requires the Contractor to investigate and report to the Government all incidents of property loss as soon as the facts become known. DFARS

252.245-7002, further requires the Contractor to report lost, damaged or stolen Government property using the Property Loss functionality within the PIEE GFP Module. The Contractor shall support the Government’s process to assign liability and document loss in support of lost, damaged or stolen GFP.

8.10 The contractor must obtain a DD-1149s before removing any Government Furnished Property, including Plant, Property, and Equipment (PP&E) from NSWCPD premises for general use. For situations where the contractor picks up/replaces NSWCPD property for maintenance purposes, the contractor shall provide an equipment receipt, showing Manufacturer, Model/Part Number, Serial Number and Asset Number/Barcode, on their company letterhead to the COR. All GFP returned to the Government shall include a DD 1149 to document transfer of liability back to the Government.

8.11 SECNAVINST 5200.43A requires unused or excess GFP be properly dispositioned once identified without waiting for formal contract closeout processing. Government Property Distribution shall be in line with FAR 52.245-1(j). The contractor shall provide a written notice to the Contracting Officer when property held under this contract has not been used in 100 calendar days. All General Equipment/assets provided as GFP shall be returned to the Government for disposition at the completion of its use unless otherwise directed in writing by the Contacting Officer and the Accountable Property Officer.

8.11.1 Disposition of Removed Material shall be in accordance with the directives and instructions listed under Para 8.3 and shall be documented via Form DD-1149.

Disposition of excess or unused GFP, Contract Acquired Property (CAP)/Contractor Furnish Material (CFM) shall be returned to the Government prior to Period of Performance expiration with a DD Form 1149. The DD Form 1149 shall include the following:

• Dollar Value

• Purchase Request Number

• Item Description

• Serial Number

• Model Number

• Quantity

• Task Order Number

• Technical Point of Contact

• Assigned Unique Serialized Identification Number

• All Delivered items for which the Government’s unit acquisition cost is $5,000.00 or more shall have an IUID tag and the corresponding information uploaded into iRAPT (Invoicing, Receipt, Acceptance and Property Transfer)

8.12 Contract Closeout Reporting

8.12.1 DFARS clause 252.245-7004 directs the Contractor to provide an inventory schedule using the PCARSS system at contract end to begin the disposition and disposal process. Reports generated by PCARSS and delivered to the Government must be used to update the APSR to ensure accountability of GFP returned or disposed of by the Contractor is maintained.
