INTRODUCTION

1.3 BACKGROUND

(U) The FBI protects US citizens from terrorist attacks and violent crime as well as foreign intelligence operations, espionage, civil rights violations, public corruption, criminal organizations and enterprises, and white-collar crime. The FBI Laboratory Division provides forensic exploitation of evidence collected in support of criminal and national security investigations. The Laboratory Intelligence Unit (LIU) provides analysis of forensic exploitation to address the requirements of the FBI and the United States Intelligence Community (USIC). Additionally, the FBI’s Laboratory Division has recovered and seized improvised explosives devices (IEDs) and related materials from the Department of Defense (DoD) for forensic and technical analysis in support of the ongoing war on terrorism. Subsequently, in December 2004 the Terrorist Explosive Device Analytical Center (TEDAC), located in Huntsville, Alabama, was formally established and given the mission of forensically and technically exploiting for evidentiary, investigative and intelligence purposes IEDs used by terrorists.

(U) Intelligence is often a key element in the development of effective strategies for FBI investigations. The FBI LIU has a requirement to provide timely, all-source strategic, tactical, and raw intelligence and investigative leads related to all facets of Laboratory exploitation. This includes analysis of improvised explosive devices, facilitators, and supply chains, to support TEDAC partners, law enforcement, the USIC, and foreign partners, when necessary, in the detection, identification, and assessment of individuals associated with fabricating and placing terrorist explosive devices and providing material support to IED networks around the world.

(U) As such, the FBI has a need for trained intelligence analysts to assist in responding to requests for information from the US Government and partner agencies, producing intelligence products for dissemination to the USIC and foreign partners and helping to identify potential leads for FBI investigations.

(U) The FBI develops a number of raw and tactical analytical products, reports, briefs, and other deliverables to inform, plan, facilitate, and execute operational and investigative strategies in an effort to mitigate threats to the Homeland or US interests overseas.

1.4 OBJECTIVES

(U) The Objective of this requirement is to provide operational intelligence services in direct support of the FBI Laboratory Intelligence Unit by conducting bulk and targeted exploitation, intelligence, and data analyses to be disseminated to FBI and USIC customers as appropriate.

(U) FBI LIU seeks support services to provide raw intelligence, tactical analysis, and operational analysis, as appropriate, to support LIU’s intelligence functions and analytical needs, in furtherance of FBI investigations and operations. Analytical functions include data exploitation, tactical analysis, raw intelligence, as well as threat and targeting analysis, as appropriate.

2 SCOPE

(U) This is a non-personal services contract. The Government shall not exercise any supervision or control over Contractor employees performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in tum is responsible to the Government.

(U) LIU shall ensure that the Contract Intelligence Analysts providing the labor hours possess the knowledge, skills, and ability necessary to address the applicable analytical tradecraft, investigative, and operational standards required by the FBI’s Domestic Investigative and Operations Guide (DIOG), the Intelligence Program Policy Guide (IPPG), and applicable Directorate of Intelligence (DI) Standard Operating Procedures (SOPs). Intelligence functions may require enhanced analytical exploitation and analysis and may rely on additional SOPs as needed.

2.1 DESCRIPTION OF SERVICES

(U) During a pandemic or other emergency, the FBI understands the Contractor workforce will experience the same high levels of absenteeism as federal employees. Although the Excusable Delays and Termination for Default clauses used in government contracts list epidemics and quarantine restrictions among the reasons to excuse delays in Contract performance, the FBI expects Contractors to make a reasonable effort to keep performance at an acceptable level during emergency periods.

(U) The Office of Personnel Management (OPM) has provided guidance to federal managers and employees on the kinds of actions to be taken to ensure the continuity of operations during emergency periods. This guidance is also applicable to our contract workforce. (U) Contractor travel and allowable expenses shall be proposed in accordance with Federal Travel Regulations (FTRs) with prior approval from the COR. The Government will not reimburse travel expenses or travel time for travel to and from the Contractors’ assigned locations or within 50 miles of the government site. The Government will reimburse all reasonable travel-related expenses and client-directed travel as an Other Direct Cost (ODC) on a cost-reimbursable basis with no fee.

(U) Video Teleconferences shall be used to the greatest extent possible. Requests for travel on other than “coach” rates and/or lodging in excess of the approved rate shall be submitted to the COR and approved by the CO prior to execution of such travel.

(U) Other Direct Costs (ODCs) are authorized. Prior to purchasing any ODCs, approval must be obtained by submitting a written estimate for the CO’s approval via the COR. This request should include what items are ODCs and why they are needed for the performance of duties.

Due to the uncertain nature of mission critical and operationally time-sensitive investigations, support by the already identified FTEs may be required outside of and in addition to the standard work hours. The Government will work closely with the Contractor to determine the best use of time and resources to meet these needs as they arise. If required, shift work for any single individual shall not exceed 12 hours in any 24-hour period. The Contractor shall provide a staffing capability to include 24/7 onsite and remote operations support after a COR request has been approved or in accordance with Government approved schedule. The Government COR will define the period and length of any operational support to include hours, days of week, start date/time and end date/time. Overtime work may be required in response to investigative needs. However, these hours shall be billed as straight time.

(U) The Government will provide Contractor personnel assigned to this contract with a typical working environment, including office furniture and furnishings, secure and unclassified telephone service, storage for classified and unclassified materials, use of the Government’s mail and courier services, and access to copiers, fax machines, personal computers (PCs) and related software.

(U) For all systems handling such data, the Contractor shall comply with all security requirements applicable to Department systems, including, but not limited, to all Executive Branch system security requirements (e.g., requirements imposed by OMB and NIST), DOJ IT Security Standards, and DOJ Order 2640.2E. The Contractor shall provide access to and information regarding the Contractor’s systems when requested by the FBI or DOJ in connection with its efforts to ensure compliance with all such security requirements and shall otherwise cooperate with the Department in such efforts. DOJ access shall include independent validation testing of controls, system penetration testing by DOJ, FISMA data reviews, and access by the DOJ Office of the Inspector General for its reviews.

(U) The use of Contractor-owned and/or personal laptops or other media storage devices is prohibited in all FBI-controlled facilities under this Requirement.

(U) Contractor staff are required to agree to, and sign, Rules of Behavior Agreement(s), Authorization for Warrantless Search, and other security agreements, disclosures, and forms required for authorized and official use of FBI technologies and systems.

(U) All PEDs brought into FBI-controlled space are subject to random searches. Searches may include the review for unauthorized information on the PED or unauthorized use of the PED. The FBI or its designated representative shall not be held responsible for the loss of information or damage to the PED resulting from these searches. PEDs with Radio Frequency (RF) capability will be stored and used at least three (3) meters from any IT processing classified national security information (3 meters = 9.8 feet).

(U) All PEDs must be registered in accordance with FBI Security Division requirements prior to use within non-SCIF FBI-controlled facilities.

(U) By acceptance of, or performance on, this contract, the Contractor agrees that, in the event of any actual or suspected breach of data (i.e., loss of control, compromise, unauthorized disclosure, access for an unauthorized purpose, or other unauthorized access, whether physical or electronic), the Contractor will immediately (and in no event later than within one hour of discovery) report the breach to the CO and the COR.

(U) The Contractor further certifies that it has a security policy in place that contains procedures to promptly notify any individual whose personally identifiable information (as defined by OMB) was, or is reasonably believed to have been, breached. Any notification shall be coordinated with the FBI and shall not proceed until the FBI has made a determination that notification would not impede a law enforcement investigation or jeopardize national security.

The method and content of any notification by the Contractor shall be coordinated with, and be subject to the approval of, the FBI. The Contractor assumes full responsibility for taking corrective action consistent with the Department’s Data Breach Notification Procedures, which may include offering credit monitoring when appropriate.
