DRAFT Statement of Work (SOW) Less Lethal Vehicle Control Systems

1. BACKGROUND: The Department of Homeland Security (DHS), Customs and Border Protection (CBP) has a new requirement for the procurement of a Less Lethal Vehicle Control System to safely immobilize vehicles attempting to flee law enforcement inspection. The selected system will be installed and evaluated for its safety, effectiveness, and compatibility with CBP Port of Entry operations.

2. SCOPE: This statement of work delineates required technical, installation and maintenance criteria for the Less Lethal Vehicle Control System.

3. APPLICABLE DOCUMENTS: CBP Use of Force Policy (4500-002A)

4. TECHNICAL REQUIREMENTS:

4.1. Permanent In-Ground Tire Deflation Device

4.1.1. Shall provide an effective coverage span of 60 feet in width

4.1.2. Shall contain blade pads with housing that sits flush with the road surface

4.1.3. Shall utilize blades as the mechanism for tire puncture

4.1.4. The blades, once fully extended, shall be 2.5 inches – 3.5 inches above the top of the blade pad housing and shall provide coverage across the entire 60-foot span

4.1.5. There shall be no more than 4.25 inches between blades

4.1.6. Shall be designed and installed to cover traffic traveling in a single direction

4.1.7. Roadway components shall cause no disruption to vehicle and traffic flow while deactivated

4.1.8. System shall remain in passive mode until activated to immobilize vehicles. Once activated, system shall be fully deployed in no more than two seconds. After impact, system shall be fully deactivated in no more than two seconds.

4.1.9. Activation buttons shall be placed in primary and secondary locations identified by local subject matter experts and shall be placed in readily accessible positions that do not interfere with normal operations.

4.1.10. Audial and visual warnings for both the traveling public and officers shall be incorporated. This includes, but is not limited to permanent signage, lights, activation lights and activation alarms.

4.1.11. Shall not require replacement of parts when deployed under expected conditions

4.1.12. Shall not require repair of any components when deployed under expected conditions

4.1.13. Exterior components constructed of, or finished, using corrosion-resistant, ruggedized materials

4.1.14. Weather sensitive components shall be properly protected in weatherproof enclosures

4.1.15. In-ground components shall incorporate drainage sufficient to channel water away from all parts of the system

4.1.16. Heat trace shall be integrated with the operational

components to melt snow and ice

4.1.17. The motor that activates the blades shall be rated for no less than 75,000 cycles

5. INSTALLATION REQUIREMENTS

5.1. System purchase shall include obtainment of all required permits and approvals, installation, and on-site system training

6. SERVICE AND MAINTENANCE REQUIREMENTS

6.1. System purchase shall include 24-hour remote support

6.2. System purchase shall include repair or replacement of parts and components

6.3. System purchase shall include training booklet outlining maintenance tasks

6.4. System purchase shall include yearly visit by company representative to conduct necessary maintenance and repair or replace components

7. ADMINISTRATIVE REQUIREMENTS

7.1. Quality Control and Quality Assurance

7.1.1. No changes in design of any device or accessory shall take place without the prior approval of the COR and the CO.

7.1.2. Devices and accessories which fail any portion of the vendor’s (including manufacturers) QC processes shall be rejected and not shipped. No further attempts shall be made to correct or otherwise remediate a device or accessory which has failed any portion of the QC testing, for purposes of delivery.

7.1.3. The Government may conduct periodic random Quality Assurance (QA) testing of devices and/or accessories produced, to ensure items meet performance requirements for which the contract was awarded.

7.1.4. QA may or may not be conducted by Government personnel at a Government owned facility.

7.1.5. Devices and/or accessories which fail QA testing may be sent back to the vendor, at no cost to the Government, and replaced with an equal amount of new supplies. If a second or subsequent failure (for the same test) occurs within the same batch, this will be considered a batch failure.

The vendor shall be notified by the COR, in writing, of the nature of the failure, defect, or deficiency and the vendor shall replace the entire batch at no cost to the government.

7.1.6. Vendor shall take corrective action within seven (7) calendar days of written notification of any non-conformance. Corrective action shall include shipping of replacements for all defective, deficient, or suspect devices and/or accessories. The vendor shall also provide a written failure analysis plan to the COR within 7 calendar days of written notification. A completed failure analysis report, to include preventative measures, shall be submitted to the COR within 60 calendar days of notification of non-conformance.

7.2. Warranties

7.2.1. Vendor shall warrant all products contained in this contract to be free of defects. Vendor further warrants that the product conforms to all applicable requirements as outlined within this Statement of Work, and guarantees that the product will maintain useful shelf life under reasonable storage conditions (both CONUS and OCONUS) for a period of five (5) years from the date of product acceptance.

7.2.2. The vendor shall provide to the COR a single point of contact (including name, phone number, and email address) who will handle all warranty claims occurring under this contract.

7.2.3. The vendor shall utilize FEDEX, UPS overnight, or other trackable next day service for all warranty shipments to the government.

Exemptions, such as ground service or freight, may be authorized by the COR on a case-by-case basis. All shipping charges associated with warranty claims (both to and from the Government) shall be the vendor’s responsibility.

7.3. Production Capacity

7.3.1. The Government reserves the right to verify the company’s ability to produce at an acceptable level in accordance with the requirements. This may include a pre-award site visit.

7.4. Distribution Authorization

7.4.1. With proposal submission, the vendor (if not the manufacturer) shall provide a letter(s) from the manufacturer(s) indicating it is an authorized distributor/retailer of device(s) and their accompanying accessories.

Unauthorized distributors and retailers are unacceptable and will not be considered.

7.5. Shipping

7.5.1. All items are to be shipped Freight on Board (FOB) Destination.

7.5.2. Shipping location to be determined

7.5.3. All shipments shall be trackable. Tracking information shall be provided to the COR (or designate) upon request.

7.6. Packaging

7.6.1. Material shall be packaged, packed and marked for shipment in such a manner that will ensure acceptance by common carriers and safe delivery at destination.

7.6.2. Each pallet shall be clearly identified on the outer wrapping with the following information:

• Contract number

• Delivery/task order number

• Part/Model numbers of all items contained within that pallet

• Material Data Sheets for all items contained within that pallet

8. DELIVERABLES AND DELIVERY SCHEDULE

8.1. Order shall be delivered to the address attached to a delivery location spreadsheet provided at time of award of the contract/delivery order. The government reserves the right to modify shipping location up to the time a shipment leaves the vendor/manufacturer’s location.

8.2. The vendor shall provide notice of shipping immediately upon the product leaving the vendor’s facility. Notification shall be sent to the COR or their designate, and to the local recipient for the shipping location via email. The local recipient’s name and contact information will be included on the delivery location spreadsheet that will be provided at the award of the contract/delivery order.

9. PERIOD OF PERFORMANCE

9.1.1. To be determined.

10. SECURITY

10.1. All work under this SOW is unclassified but may require secure handling of information designated as FOUO and/or personally identifiable information (PII).

10.2. Vendor personnel who will perform work on the contract may be required to execute a non-disclosure agreement which must be delivered to the COR prior to commencing work in accordance with DHS policy for safeguarding FOUO information.
