6.0 TAB B – FACTOR 1 – PAST PERFORMANCE

6.1 SUBMISSION REQUIREMENTS

6.1.1 The Offeror’s construction and design entities (or prime contractor if design is to be self- performed) shall each demonstrate past performance through the submission of similar projects, using Attachment 2 and Attachment 3 at the end of this section. Each project submission shall not exceed one (1) page. If the Offeror is a joint venture, limited liability corporation or integrated design-build firm, provide past performance information for design and construction projects relevant to each of the proposed roles on this project. The construction and design entities shall each submit no more than three (3) projects each. If design is to be self-performed, the prime contractor shall submit no more than six (6) projects total. If projects were design-build, identify them as such. Offerors may identify federal, state and local government and private contracts that are similar to the Government’s requirements. Design firms may list prime contractors they have worked for or federal, state and local government and private contracts that are similar to the Government’s requirements. If the Offeror is a joint venture, and past performance cannot be provided as a joint venture, submit no more than three (3) projects each demonstrating experience relevant to their role on this project. If any firm has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer. Submit projects demonstrating recent construction past performance that have completed within six (6) years from the date of this solicitation. One (1) of the three (3) projects submitted for construction past performance may be current construction projects with completed designs and at least 75% construction progress completed.

Submit projects demonstrating recent design past performance that are fully designed within six (6) years from the date of this solicitation. Projects demonstrating design past performance may submit design build projects if the design portion of the project is complete, regardless of the construction progress.

6.1.1.1 Projects will be considered relevant to this procurement if they are similar in type, magnitude, scope and complexity, relevancy ratings are defined in para 6.2.1. Relevancy is defined as:

(a) Health care facilities, medical clinics and hospitals a minimum of 400,000 square feet of gross space

(b) Project construction value of at least $450,000,000.00

(c) Design-build construction

(d) Projects meeting one or more of the following features in terms of complexity:

i. Adherence to VA Technical Information Library (TIL)

ii. Constructed on a military installation

6.1.2 The Government will utilize Contractor Performance Assessment Reporting System (CPARS) and any other information deemed relevant to assess confidence in the Offeror’s ability to perform. Do not request Past Performance Questionnaire (PPQ) on projects that have interim or final CPARS evaluations. Do not submit any CPARS; the Government will obtain those records. The PPQ included in the solicitation (Attachment 4) is provided for the Offeror or its team members to submit to the client for each project the Offeror included in its proposal for Factor 1, Past Performance that does not have an interim or final CPARS evaluation or is a non- Federal Government project. Completed PPQ shall be submitted with your proposal. Ensure correct phone numbers and email addresses are provided for the client point of contact. If the Offeror is unable to obtain a

SECTION 00 22 10 Page 5 of 19 completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors shall follow-up with clients/references to ensure timely submittal of questionnaires. If any negative past performance information is received to which the Offeror has not previously had an opportunity to respond, the contractor will be given an opportunity to provide rebuttal. If the client requests, questionnaires may be submitted directly to the Government, via e-mail at: CESWF- IIS@usace.army.mil prior to proposal closing date. Offerors are not required to submit any additional past performance information.

6.1.2.1 PPQ's submitted for other RFP's may be submitted, but they must be included in the Offeror’s proposal;

it is not acceptable to incorporate them into the proposal by reference. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If an interim or final CPARS evaluation exists and a PPQ is provided for the same project, the CPARS evaluation will be reviewed as the official past performance record for the project, and the PPQ will not be considered by the Source Selection Board or Source Selection Authority. For projects which are underway but do not yet have an interim or final CPARS evaluation, the PPQ shall be signed by the Administrative Contracting Officer (ACO) for the contract.

6.1.2.2 Offerors may submit performance recognition documents, not to exceed five pages, received within the last six (6) years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition relevant to the submitted projects to demonstrate the Offeror’s performance capabilities and customer satisfaction.

6.1.2.3 Offerors may submit information, not to exceed five pages, on past performance issues and corrective actions taken to prevent these issues from reoccurring. Including whether these corrective actions have been implemented on contracts awarded subsequent to the performance issues, the effectiveness of the corrective actions and POC information for the subsequent contracts.

6.1.2.4 In addition to the above, the Government may review any other sources of information for evaluation of past performance. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS number of team members (Partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquires of owner representative(s), Federal Awardees Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rest with the Offeror.

6.1.3 The Offeror may provide a supplemental narrative (not project list), not to exceed two pages, explaining how any corporate experience that is not directly related to the specific project submissions above is applicable to this project and how the Government will benefit.

6.2 EVALUATION CRITERIA

The past performance evaluation results in an assessment of the Offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract’s requirements. In accordance with FAR 15.305(a)(2), the currency and relevance of the information, source of the information, context of the data, and general trends in contractor’s performance shall be considered. These are combined to establish one performance confidence assessment rating for each Offeror, “Substantial Confidence”, “Satisfactory Confidence”, “Neutral Confidence”, “Limited Confidence”, or “No Confidence”.

In determining the performance confidence rating for Past Performance, the degree of relevancy/recency of all the considered efforts, the overall performance record of the Offeror on each contract assessed, number and severity of problems, the demonstrated effectiveness of corrective actions taken (not just planned or promised), and trend data will be considered. Contracts with higher degrees of relevance will typically have a greater influence on the final performance confidence rating. Contracts with lower degrees of relevance will typically have less influence on the final performance confidence rating however, any contracts with adverse past performance could reflect larger company-wide concerns and may impact upon the past performance confidence rating. Contracts which are comparatively more recent may be better predictors of likely future success than older contracts. Past performance on the projects identified in the project forms will receive more consideration than past performance provided in the supplemental narrative. The Government will place greater value on projects performed as a prime contractor than as a subcontractor, depending upon overall role and

SECTION 00 22 10 Page 6 of 19 relevancy considerations. If any firm has multiple functions or divisions, the Government will only evaluate past performance of the division or unit submitting the offer. The resulting relevant/recent assessment conclusions will then be combined, along with the assessed quality of performance on prior contracts, to arrive at a single performance confidence rating for the Past Performance Factor.

The confidence rating will be established based on the past performance of the firms or that of its predecessor, if applicable. An entity may not establish past performance based on the past performance of its key personnel apart from that of the entity. If negative information is received, the Offeror will be given an opportunity to provide input as required by FAR 15. CPARs that are part of the official record will be utilized as if the Offeror has already had an opportunity to respond.

In the case of Offerors for which there is no information on past contract performance or where past contract performance information is not available, the Offeror’s past performance is unknown and assigned a performance confidence rating of “Neutral Confidence.” Although the Source Selection Evaluation Board (SSEB) may not rate an Offeror that lacks recent, relevant past performance favorably or unfavorably with regard to past performance, the Source Selection Advisor Council (SSAC) may recommend and the Source Selection Authority (SSA) may determine a “Substantial Confidence” or “Satisfactory Confidence” past performance rating is worth more than a “Neutral Confidence” past performance rating in a best value tradeoff as long as the determination is consistent with stated solicitation criteria.

Adjectival Rating Description Substantial Confidence Based on the Offeror’s recent/relevant performance record, the

Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

The Offeror may not be evaluated favorably or unfavorably on…
