Any information (classified or unclassified) pertaining to this contract shall not be released for public dissemination except as provided by the National Industrial Security Program Operating Manual (NISPOM) or unless it has been approved for public release by appropriate U.S. Government authority. Proposed public releases shall be submitted for review and approval prior to release to the appropriate government approval authority identified here with at least office and phone contact information and if available, an e-mail address. If any difficulty is encountered in applying this guidance or if any other contributing factor indicates a need for changes in this guidance, the contractor is authorized and encouraged to provide recommended changes; to challenge the guidance or the classification assigned to any information or material furnished or generated under this contract; and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

| text: Ref 10.a: COMSEC - Classified COMSEC material is not releasable to contractor employees who have not received a final clearance at the appropriate security level. COMSEC access shall be IAW DOD 5220.22-M and AR 380-40. When access is required at Government facilities, contractor personnel will adhere to COMSEC rules and regulations as mandated by Command policy and procedures. Written concurrence of the contracting office (KO) is required prior to subcontracting. |
Ref 10e (1): SCI Access Required. No public release of information authorized, public disclosure or confirmation of any subject related to the support contract is not authorized without first obtaining written approval from the KO. Access to SCI is required for some work performance on this contract (see attached SCI ADDENDUM).
Ref 10e (2): Non-SCI information is not releasable to contractor employees who have not received a clearance at the appropriate security level. Written concurrence of the KO is required prior to subcontracting. Access to Intelligence information required for performance of this contract.
Ref 10j: CONTROLLED UNCLASSIFIED INFORMATION (CUI) information generated and/or provided under this contract shall be safeguarded and marked as specified in DoDM 5200.01, Volume 4; AR 380-5; and AR 25-55.
Ref 10k: SIPRNET, JWICS and COURIER CARD - Secret Internet Protocol Network (SIPRNET) and Joint Worldwide Intelligence Communications System (JWICS) access will only be as directed by the Government requirement activity and at government facilities only. Contractors requiring access to the SIPRNET must have a final Secret clearance or Interim TS clearance. Contractors requiring access to JWICS must have a final TS clearance and be indoctrinated for Sensitive Compartmented Information access. SIPRNET/JWICS may contain NATO information and a NATO awareness brief and acknowledgment is required for all personnel prior to being granted access to the SIPRNET/JWICS. A written acknowledgment shall be maintained by the COR. Contractors requiring courier card must have as a minimum final Secret clearance, pass all required training and coordinate with their government COR or local government POC if TDY for their request to be submitted for approval. The contractor shall not access, download or further disseminate any classified information from SIPRNET/JWICS which is outside the execution of the defined contract requirements unless specifically authorized in writing by the Government Program Manager and the KO. In the event that any special access is required, the KO must modify the requirements and DD 254.
Ref Item 11a: Contractor access to classified information shall be limited to that which is necessary to support this work effort. Contractor performance is restricted to Fort Gordon, GA, and CONUS locations as mission dictates. Government agency/activity will provide security classification guidance for performance of this contract. The contractor will comply with the provisions of DOD 5220.22-M, AR 380-5, and all applicable regulations and local policies and procedures governing the control, protection, and safeguarding of classified and sensitive (CUI) material. The Facility Security Officer will submit a visit request to the KO and CCoE G2 (SMO: W6ZRAA5) for need-to-know verification.
Ref Item 11l: Receive, Store, or Generate Controlled Unclassified Information (CUI).
General: In addition to classified information, certain types of unclassified information also require application of access and distribution controls and protective measures for a variety of reasons. In accordance with Reference (e) DoDM 5200.01 V1, such information is referred to collectively as CUI.
DISCLOSURE OF INFORMATION
(a) The Contractor shall not release to anyone outside the Contractor's organization any unclassified information, regardless of medium (e.g., film, tape, document), pertaining to any part of this contract or any program related to this contract, unless—
(1) The Contracting Officer has given prior written approval;
(2) The information is otherwise in the public domain before the date of release; or
(3) The information results from or arises during the performance of a project that has been scoped and negotiated by the contracting activity with the contractor and research performer and determined in writing by the contracting officer to be fundamental research in accordance with National Security Decision Directive 189, National Policy on the Transfer of Scientific, Technical and Engineering Information, in effect on the date of contract award and the USD (AT&L) memoranda on Fundamental Research, dated May 24, 2010, and on Contracted Fundamental Research, dated June 26, 2008, (available at DFARS PGI 204.4 (DFARS/PGI view)).
(b) Requests for approval under paragraph (a)(1) shall identify the specific information to be released, the medium to be used, and the purpose for the release. The Contractor shall submit its request to the Contracting Officer at least 10 business days before the proposed date for release.
(c) The Contractor agrees to include a similar requirement, including this paragraph (c), in each subcontract under this contract. Subcontractors shall submit requests for authorization to release through the prime contractor to the Contracting Officer.
(d) IAW DoDM 5200.01-Vol 4, Feb 24, 2012, Contractors with access to CUI shall receive an initial orientation to the DoD Information Security Program. At a minimum, on-site contractors with access to CUI shall receive annual refresher training that reinforces that policies, principles, and procedures covered in their initial CUI training and specialized CUI Training.
