1 DESCRIPTION OF SERVICES

The contractor shall provide non-personal services, to include all personnel, equipment, tools, supervision, and other items and services necessary to ensure that grounds maintenance is performed in the Kaiserslautern Military Community (KMC) area consisting of Ramstein Air Base, Vogelweh Admin & Housing Area, Rod & Gun Club, Kapaun Annex, Einsiedlerhof Annex, Landstuhl Annex, Kaiserslautern Cold Storage including T-37 & T-41 Storage Facilities, Bann Communications Site, Pirmasens-Husterhöhe Communications Site and Breitenbach, in a manner that will promote the growth of healthy grass, trees, shrubs, and plants and present a clean, neat, and professional appearance. Areas map and workloads depicting the services described in this PWS are identified in the Appendices. The contractor’s performance will be based on the Contracting Officer’s Representative’s (COR), and Contracting Officer’s (CO) evaluation of the results required by the Service Summary (SS) and not the method of performance. The evaluation of results will be based on COR surveillance, tenant satisfaction, and customer complaints. Final results of the evaluations will be the determining factor for the success or failure of this contract.

The contractor shall comply with applicable federal, regional, state, and local laws and commercial standards.

The growing season at KMC is 1 February through 31 October. All damage caused by the contractor or its employees to government property and personal property (to include facilities, fences, equipment, trees and shrubs, etc.) due to contractor operations shall be repaired or replaced by the contractor within 15 days after identification/notification at no additional cost to the Government. If a plant should die or become unhealthy due to damage, the contractor will be responsible for replacing the damaged plant with a plant of the same size and type. Plant replacement shall occur within 15 days after identification or notification or as otherwise agreed to by the parties.

Fence lines identified shall be trimmed to prevent vegetation growth in the fence, including removal of vegetation growing up the links of the fence. All areas shall be trimmed concurrent with mowing.

The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for the performance of the services provided under this contract via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October through 30 September.

While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help desk.

Use and Safeguarding of Information: Information from the secure website is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.

User Manuals: Data for Air Force service requirements must be input at the Air Force CMRA link. However, user manuals for Government personnel and contractors are available at the Army CMRA link at http://www.ecmra.mil.

1.1 MAINTAIN IMPROVED GROUNDS

Improved grounds are identified in Appendix A, on area maps and/or site plans in Appendix B and in the Service Schedule in Appendix G.

1.1.1 MOW

The contractor shall mow all improved grounds to look well-manicured, with a neat and professional appearance at all times. Grass height will be maintained as identified in Appendix A, ensuring turf is uniform in appearance, free of skips, gaps, rutting, or scalping. The contractor is required to suppress upcoming vegetative succession by appropriate measures, such as blackberry bushes, wild growth small trees, etc. The contractor shall maintain swamped areas if the site condition permits safe performance. The contractor is required to pick up debris, natural and manmade, prior to mowing any area. The contractor shall remove or mulch grass clippings when visible after mowing, before leaving the work area. The contractor shall dispose of all mowing/trimming debris at the base compost facility. The use of off-site locations, other than the base compost facility, to dispose of clippings is not permitted. The contractor shall use warning signs on and off base, when performing services along roads. The contractor shall coordinate mowing and the blocking off of parking lots with the appropriate facility managers, if necessary.

1.1.2 EDGE

The contractor shall edge sidewalks, driveways, street edges, curbs, and other hard surface areas, located within the improved grounds so that the grass height matches the surrounding area’s grasses. Edging shall include the removal of vegetation from expansion joints and cracks. Grass, vegetation and weeds shall be cut back no more than 1.25 cm from the surface edged, maintaining an even contour with the edged surface, uniform in appearance and free of scalping, rutting, and uneven or rough cutting.

1.1.3 TRIM

The contractor shall trim, concurrent with mowing, grass and weeds around sandstone barriers, trees, shrubs, buildings, inside of all grassy ditch lines, fences, poles, fire hydrants, parking lots, bumper blocks, boulders and other fixed and temporary obstacles/objects on improved grounds areas. The contractor shall be particularly cautious trimming around trees, parking lots, etc. to avoid damages. The trimming height shall match the surrounding area’s grass height. The contractor shall remove or mulch grass clippings when visible before leaving the work area.

1.1.4 WEED CONTROL

Control weeds in identified improved grounds through execution of a weed control program appropriate for the area to maintain a professional appearance. The contractor shall remove weeds from pavements in concurrence with mowing, as identified in Appendices A, B and G within landscaping, to include all joints and cracks in sidewalks and curbs, located along all streets within improved areas.

The contractor shall not use any pesticides/herbicides for the duties described in this contract. Any usage of these types of substances is prohibited and will not get any approval/waiver. For further information, please see the directions for restrictions specified in the instructions for usage (“Anwendungsbestimmung”) (see German Plant Protection Act – “Pflanzenschutzgesetz” (PflSchG) Art. 6a (1)).

1.1.5 MUNITION STORAGE AREA

The contractor shall maintain grass in accordance with Appendices A, B and G.

1.1.7 REMOVE DEBRIS/POLICE GROUNDS

The contractor shall perform general litter patrol in all areas of improved grounds, to include walkways, ditches, hedgerows, flowerbeds, perimeter fence lines, all trash receptacles identified in Appendices A, B and G. The contractor shall perform the service Monday through Saturday, every other day. This includes the removal/disposal of natural debris, (tree limbs, dry brush, rodent habitats, deceased animals, etc.), and man-made debris, to maintain a neat and professional appearance.

1.1.7.1 DEAD ANIMALS RESERVED

1.1.7.2 DISPOSAL OPERATIONS

The contractor shall dispose of all collected non-bio debris (to include trash collected from receptacles), except deceased animals, in refuse collection dumpsters located at designated Recycling Centers on Ramstein and Vogelweh. The contractor shall hand over deceased animals to Pest Management on Ramstein at Bldg. 505. The contractor shall contain all debris during transportation to prevent leaking, spilling, or blowing. The locations of the Recycling Centers are located on Ramstein at Bldg. 2045 and Vogelweh at Bldg. 2820.

1.1.7.3 RECYCLING

The contractor shall recycle all collected material for the purpose of waste reduction and cost reduction. The contractor shall sort all non-bio debris, as practicable, and place it into the appropriate dumpsters at the designated Recycling Centers. The contractor shall not place any debris in any dumpster not located at a designated Recycling Center. The contractor shall dispose of all biodegradable material, such as tree limbs, leaves, and grass clippings, at the Ramstein

Compost Facility. The location of the Ramstein Compost Facility is identified on the Ramstein Air Base map identified in Appendix B. The use of off-site locations will be at no additional cost to the Government.

1.1.7.4 TRASH RECEPTACLES

The contractor shall inspect all trash receptacles as identified in Appendices A, B and G and empty each receptacle while performing debris removal/policing grounds. The contractor shall supply black trash bags for all receptacles (various sizes). The contractor shall notify the COR of any problem areas requiring additional trash receptacles.

1.1.8 LEAF REMOVAL

The contractor shall remove leaves only in improved grass areas as identified in Appendices A, B and G to maintain a neat and professional appearance. Leaf removal is to include natural debris (i.e. tree limbs, dry brush, rodent habitats), and man-made debris. The contractor shall dispose of all debris at the base compost facility. The use of off-site locations, other than the base compost facility, to dispose of clippings and biodegradable debris is not permitted.

1.1.9 LAWN CONDITIONING

Lawn conditioning is a service rendered by the contractor based on an “as-needed” basis. When such services are needed, an additional Task Order will be issued by the CO.

1.1.9.1 FERTILIZATION

The contractor shall use fertilizer, lime and other soil amendments to achieve a soil condition suitable for the vegetation being treated. It is recommended to use an organic-mineral fertilizer with immediate and long-term effect to have a balanced nutrient ratio for a healthy growth.

1.1.9.2 AERATION

After a Task Order has been issued by the CO, the contractor shall aerate lawns on improved grounds, identified in Appendix A, during the month best suited for the grounds and type of grass. Plugs will be left on the lawn to disintegrate.

1.1.10 PEST CONTROL RESERVED

1.1.11 LAWN RENOVATION

The contractor shall renovate lawns in improved grounds and renovate deteriorated lawn areas to match surrounding areas. Lawn Renovation is a service rendered by the contractor based on an “as-needed” basis. When such services are needed, an additional Task Order will be issued by the

CO.

1.1.12 PRUNE SHRUBS, HEDGES AND OTHER PLANTS

The contractor shall prune/trim shrubs and other plants as identified in Appendices A, B and G to maintain their natural growth characteristics and to enhance the beauty and health of the plant.

Hedges shall be maintained to their natural mature height and shape. Shrubs, plants, hedges, and ground cover/vines shall be pruned/trimmed 7.5 cm away from buildings, fences, curbing, sidewalks, and other fixed obstacles. All ground cover and plants shall be kept within the bed borders. All plants around landscape and ground lights shall be pruned/trimmed to allow light usage for its intended purpose. Shrubs and hedges located on street corners, curb easements, etc.

shall be pruned/trimmed to prevent obstructing the view of oncoming traffic. Areas beneath shrubs and hedges shall be kept free (clean) of all grass, weeds, vegetation, and debris. Volunteer tree growth seedlings shall be removed at no additional cost to the Government. The contractor shall remove and dispose of all clippings upon completion of work. No trimming or cutting is allowed from March to July (bird breeding time). The contractor shall only dispose of trimmings at the base compost facility. Trimmings shall not be discarded in forested or wooded areas.

1.1.12.1 ANNUAL PRUNING OF SPECIFIED AREAS

The contractor shall perform annual maintenance of planted areas where a regular pruning/trimming service is not provided. The contractor shall prune/trim plants to their natural growth characteristics to enhance the beauty and health of the plant. All plants shall be kept within bed borders. The contractor shall remove and dispose of all clippings upon completion of work.

The contractor shall only dispose of trimmings at the base compost facility. Annual pruning identified in Appendices A, B and G.

1.1.13 CEMETERIES RESERVED

1.1.14 ARTIFICIAL TURF RESERVED

1.1.15 SPORTS FIELD MAINTENANCE

The contractor shall maintain and improve established turf areas to promote green, healthy, and uniform lawns. Lawn treatment shall include, but is not limited to rolling, adding topsoil, aerating, adding sand and dragging, scarification, over-seeding, re-seeding, installation of sod, compacting, irrigation and fertilization. Lawn maintenance shall be performed once per year as identified by the COR. Sports fields shall be aerated and fertilized twice a year using a slow-release fertilizer.

Sports field maintenance is identified in Appendices A, B and G.

1.2 MAINTAIN SEMI-IMPROVED GROUNDS

Semi-improved grounds are identified in Appendix A, on area maps and/or site plans in Appendix B and in the Service Schedule in Appendix G.

1.2.1 MOW

The contractor shall maintain the grass height as identified in Appendix A, in all semi-improved grounds. The grass shall be maintained in a way that promotes a uniform appearance in all areas.

The contractor is required to stop upcoming vegetative succession by appropriate measures. Where possible, the contractor shall maintain adjacent areas at or near the same grass heights. The contractor shall remove or mulch grass clippings when visible after mowing, before leaving the work area. The contractor shall dispose of all mowing/trimming debris at the base compost facility.

The use of off-site locations, other than the base compost facility, to dispose of clippings is not permitted. The contractor shall maintain swamped areas if the site condition permits safe performance.

1.2.2 TRIM

The contractor shall trim, concurrent with mowing, grass and weeds around sandstone barriers, trees, shrubs, buildings, inside of all grassy ditch lines, fences, poles, fire hydrants, parking lots, bumper blocks, boulders and other fixed and temporary obstacles/objects on semi-improved grounds areas. The trimming height shall match the surrounding area’s grass height.

1.2.3 PERIMETER FENCE LINE

The contractor shall maintain inside vegetation extending two (2) meters, and outside perimeter fence extending one (1) meter as identified in Appendices A and E. The contractor shall remove all vegetation that grows in the fence mesh or fabric. This includes small trees, hedges, and brush up to ten (10) centimeters in diameter. The contractor shall identify trees, hedges, and brush over ten (10) centimeters in diameter and report these to the COR. The COR will notify Installation Management (86 CES/CEIE) prior to contractor performance. This service will apply except in designated areas outside of the fence where 86 CES/CEIA has determined that the land does not belong to the U.S./German Government.

1.3 MAINTAIN BIRD AREA STRIKE HAZARD (BASH) RESERVED

1.4 MAINTAIN UNIMPROVED GROUNDS

The contractor shall maintain grass and vegetation in unimproved grounds to prevent woody encroachment and shall mow unimproved grounds in accordance with AF COLS in Appendix A.

Maintain unimproved grounds is a service rendered by the contractor based on an “as-needed” basis. When such services are needed, an additional Task Order will be issued by the CO.

1.5 MAINTAIN VEGETATIVE BEDS, INERT BEDS, ROCK BEDS AND RELATED

AREAS

The contractor shall maintain vegetative beds, inert beds, and related areas as identified in Appendices A, B and G to present a neat and professional appearance. Maintenance activities may include but are not limited to fertilizing, watering, weeding, mulching (once per year), pruning, shrubs, hedges and other plants (please see description in paragraph 1.1.12) and removing damaged plants and shrubs.

1.6 MAINTAIN SURFACE DRAINAGE DITCHES

The contractor shall maintain greened surface drainage ditches to be free of shrubs, trees, silt and trash to prevent erosion and ensure continuous flow of water. Maintenance of surface drainage ditches is a service rendered by the contractor based on an “as-needed” basis. When such services are needed, an additional Task Order will be issued by the CO.

1.7 PERFORM SNOW/ICE REMOVAL RESERVED

1.8 SPECIAL REQUIREMENTS

Special requirements are those services rendered by the contractor based on an “as-needed” basis.

When such services are needed, an additional Task Order will be issued by the CO.

1.8.1 TREES

The contractor shall prune or trim all trees as necessary. The contractor shall assist in identifying all trees that require pruning or trimming. Pruning or trimming shall be accomplished in accordance with all applicable federal, regional, state, and local laws and commercial standards.

Pruning shall include the lifting, removal, and/or cutting back of branches that conflict with normal traffic/safety. In addition, the contractor shall prune or trim trees that pose public safety hazards.

Minimum safety clearances are: 4.5 m over streets, (ensuring that all walkways are free and clear from limb obstruction), 3.5 m over driveways, 2.5 m over walk areas, 1.2 m over buildings, and 30 cm from buildings. Topping and de-horning are not permitted. Minimum clearance from high tension lines and secondary lines (i.e. electric service drops, telephone lines, and cable TV) shall be in accordance with German regulations. The contractor shall be responsible for removing all debris generated from trimming or pruning operations. No trimming or cutting is allowed from March through July (bird breeding season). The contractor shall only dispose of trimmings at the base compost facility. Trimmings shall not be discarded in forested or wooded areas. The diameter of the tree shall be determined by measuring 130 cm above the ground.

1.8.1.1 TREE CARE RESERVED

1.8.1.2 TREE STANDARDS

The contractor shall perform all tree work in accordance with contract specifications and all applicable federal, regional, state, local laws and commercial standards, unless otherwise directed by the CO. This includes the following list of German and American standards:

1.8.1.3 EMERGENCY SPOT PRUNUNG/TRIMMING RESERVED

1.8.1.4 TREE AND STUMP REMOVAL

The contractor shall perform stump and perimeter roots removal by completely removing, cutting and grinding all growth to a minimum of 20 cm below grade. This does not include tree cutting. Stump-grinding debris shall be removed the same day grinding is performed. The Contractor shall backfill with topsoil, and lay sod to match the existing ground grade and the type of grass. The contractor shall maintain the patch area IAW the manufacturer’s recommendations until the grass has become established.

Stumps identified for removal and trees identified for pruning shall be considered within the following categories: Large, Medium, Small and Sapling, as based on their diameter.

Large Tree/Stumps: Diameter 90 cm and above.

Medium Tree/Stumps: Diameter 60 cm to less than 90 cm.

Small Tree/Stumps: Diameter 8 cm to less than 60 cm.

Saplings: Diameter 8 cm and smaller.

1.8.1.5 EMERGENCY TREE AND STUMP REMOVAL

The following timeframe shall apply for emergency tree stump removal by the contractor:

Large Tree Stumps: Remove within 5 workdays from the Task Order date of issuance Medium Tree Stumps: Remove within 5 workdays from the Task Order date of issuance

1.8.2 EMERGENCY AND SPECIAL EVENT SERVICES RESERVED

1.8.5 PLANTING TREES, SHRUBS, AND VEGETATIVE BEDS

The contractor shall plant available trees, available shrubs, and vegetative beds to include but not limited to: the removal and disposal of trees, shrubs, or vegetative beds being replaced, as well as the carrying out of maintenance after planting to include a one-time irrigation, pruning, and insect and disease prevention to promote survivability. Plants are not included.

1.8.6 TOPSOIL

The contractor shall coordinate with the COR to determine the amount of topsoil necessary for any given area. After coordination, the contractor shall provide sifted topsoil and apply it evenly across the given area.

1.8.7 AERATE, ADD SAND AND DRAG

The contractor shall aerate the sports fields to maintain the field in a healthy state. The contractor shall spread the amount of sand necessary over aerated ground. After sand application, the aeration plugs and sand shall be dragged into holes.

1.8.8 OVER-SEEDING

The contractor shall perform over-seeding at the manufacturer’s recommended rate using RSM (Regelsaatgutmischung) 7.2.1 mixture seed for common grass areas and RSM 3.1 for sports fields.

1.8.9 RE-SEEDING

The contractor shall re-seed at the manufacturer’s recommended rate using RSM 7.2.1 mixture seed for common grass areas and RSM 3.1 for sports fields. After re-seeding, the contractor shall perform maintenance to include a one-time irrigation of the seeded areas to promote growth and present a green, healthy surface in accordance with standard commercial practices and the manufacturer’s recommendations.

1.8.10 HYDRO-SEEDING

The contractor shall determine the amount of hydro-seeding necessary to maintain a uniform healthy appearance during the growing season. This shall include aerating the hydro-seeded area sufficiently to allow grass to take root.

1.8.11 INSTALLATION OF SOD

The contractor shall install sod and perform maintenance, to include a one-time irrigation of sod to promote growth and present a green healthy surface, in accordance with standard commercial practices and/or manufacturer’s recommendations. The sod type shall match the existing grass within adjacent areas.

1.8.12 CLEARING/GRUBBING VEGETATION

The contractor shall perform clearing and grubbing consisting of removing all vegetation in a specified area leaving nothing other than evenly groomed bare earth.

1.8.13 MULCH

The contractor shall coordinate with the COR to determine the square meters of mulch necessary for any given area. After coordination, the contractor shall apply an equally thick layer approx. 5- 10 cm. Tree bark shall be 20-60 mm.

1.8.14 CONVERTING LANDSCAPED AREAS WITH GRASS SEED

The contractor shall convert landscaped areas to grassy areas. Converting activities may include but are not limited to adding topsoil, seeding grass, fertilizing, clearing and grubbing and a one-time irrigation.

2 SERVICE SUMMARY (SS)

The contract service requirements are summarized as performance objectives that relate directly to mission critical items. The performance threshold briefly describes acceptable minimum levels of service required for each requirement. The Service Summary (SS) and the contractor’s Quality Control Plan provide information on contract requirements, the expected level of contractor performance and the expected method of Government validation and confirmation of the services provided. These thresholds are critical to mission success. Procedures as set forth in FAR 52.212- 4 (a), Contract Terms and Conditions – Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies. During the first initial 30 days of the contract, two additional errors per work shall be allowed in an effort to identify normal phase-in problems.

2.1 QUALITY CONTROL

2.1.1 QUALITY CONTROL PLAN

The contractor shall provide a written description of the quality control system to include identification of the commercial practices and procedures to be used. The contractor shall develop and implement procedures to identify, prevent, and ensure non-performance and a continuous repeat of defective service do not occur. A written Quality Control Plan, including a suggested Daily Completion Report template, shall be submitted to the CO/COR for review and feedback.

The plan shall be submitted no later than the pre-performance conference. The plan shall specifically address the contractor’s strategy to provide quality workmanship, continuous process improvement and for correcting deficiencies as required.

2.1.2 DAILY COMPLETION REPORT

The contractor shall electronically provide a daily completion report to the COR within one (1) work day after completion of work. The report shall be in English and include:

(a) Type of work performed by zone (zones identified in zone map)

(b) Name of Contractor’s Quality Control Inspector

2.2 QUALITY ASSURANCE

The Government will inspect and evaluate the contractor’s performance to ensure services are received in accordance with the requirements set forth in this contract. The CO/COR will inspect by validating the actual work performance, physically checking an attribute of the completed task, investigating customer complaints, conferring with facility managers, or otherwise inspecting the task or its results to determine whether or not performance meets the standards contained within this PWS. The CO/COR may use the Contractor’s Quality Control Plan or modified version thereof, to record validation results. Results of the validation will serve as the official Air Force record of the contractor’s performance. When a performance threshold has not been met or contractor performance has not been accomplished, the COR will initiate a Corrective Action Report (CAR) and submit it to the CO for issuance to the contractor. The contractor shall respond to the CAR IAW instructions provided and return it to the CO within 10 calendar days of receipt.

3. GOVERNMENT FURNISHED PROPERTY AND SERVICES

3.1 FACILITIES

The Government will provide the exterior spaces identified below for contractor use in support of the requirements of this contract. The exterior spaces are provided “as is.” The contractor shall obtain CO approval in advance of making any changes to the exterior spaces. Any such changes will be at no cost to the Government unless otherwise approved by the CO. The contractor shall ensure the exterior spaces are maintained in a neat, clean and professional manner. The CO reserves the right to reallocate and relocate assigned exterior spaces during the term of the contract.

Upon completion or termination of this contract, or upon such reallocations or relocations, the contractor shall return the exterior spaces to the Government in the same condition as received, except for fair wear and tear and approved modifications.

3.1.1 FLOOR SPACE

The contractor shall contact the COR concerning the optional placement of an office container on the exterior space provided.

3.1.2 EXTERIOR SPACE

Approximately 1000 square meters of exterior space are provided: 700 square meters on Ramstein Air Base and 300 square meters on Vogelweh Air Base. These areas will not be secured; however, the contractor may arrange to have temporary fencing erected around the contractor’s equipment.

All erected structures and additions shall comply with the base Architectural Compatibility Guide which can be obtained at 86th Engineering Flight, Ramstein, Bldg. 573. The contractor shall provide written notification to the CO/COR 30 days before erecting any security or area marking fencing. The contractor shall coordinate an inspection with the COR prior to acceptance of the area and again prior to turning the area back to the Government.

3.2. UTILITIES

The contractor is allowed to connect to electricity, water, and the sewage systems if available on Ramstein Air Base for the accomplishment of work in accordance with this contract. The contractor shall not change or modify any utility system or component; or connect any contractor property, equipment or system without prior CO review and approval. The contractor shall utilize energy conservation practices in all Government facilities.

3.2.1 UTILITY CONSERVATIONS

The contractor shall adhere to all base level utility conservation practices or requirements which can be obtained at Installation Management Flight, Ramstein, Bldg. 572. The contractor shall be responsible for operating under conditions that preclude the waste of utilities.

3.3. MATERIALS RESERVED

3.4 SECURITY, FIRE, AND MEDICAL SERVICES

The Government will provide police and fire protection. In the event of a medical emergency, base ambulance services for transporting an injured employee to a local hospital are available on a cost-reimbursement basis.

3.5 TELEPHONE RESERVED

3.6 SOLID WASTE COLLECTION AND DISPOSAL

The contractor shall use existing bulk containers to dispose of trash or solid waste generated from the accomplishment of services defined in this PWS. The contractor shall adhere to all base-level recycling programs to include the disposal of yard/tree waste in specified dumpster collection stations or at the recycling collection center on base. The CO/COR shall identify these specific dumpsters for yard/tree waste.

3.7 GREEN WASTE MATERIALS

The contractor shall remove all green wastes daily from the job site, and dispose of all debris at the base compost facility. The use of off-site locations, other than the base compost facility, to dispose of green waste is not permitted.

4.0 GENERAL INFORMATION

4.1 MISSION

The overall Civil Engineer mission of the Kaiserslautern Military Community is to plan, maintain, operate, and protect the infrastructure, facilities, and environment for assigned airmen, families, and civilian employees.

4.2 BACKGROUND

Some grass areas in the KMC are fenced in and can only be accessed by appointment through the COR. A list of these areas will be provided by 786 CES/CEOES upon contract award.

4.3 DAMAGES TO GOVERNMENT BUILDINGS, EQUIPMENT, OR VEGETATION

Damages to Government buildings, equipment, or vegetation are addressed in FAR 52.237-2 – “Protection of Government Buildings, Equipment, and Vegetation”. Any damages shall be brought to the attention of the COR within one (1) hour of occurring. The contractor shall report any such damages to the COR during official duty hours at 06371-47-6919 and after duty hours to Service Call at 0631-536-6623.

4.4 ENVIRONMENTAL REQUIREMENTS

In addition to all applicable German federal, and local environmental codes and regulations, the following specific guidance is provided:

4.4.1 HAZARDOUS MATERIAL

Any hazardous haterial possibly required for performing the work described in this PWS including, but not limited to motor oil, lubricant, gasoline, pesticides, and herbicides require approval prior to be brought onto the installation in accordance with AFI 32-7086, Hazardous Material Management program. All hazardous material needs to be transported, and stored in accordance with ADR, and AFI 90-821 “HAZCOM Program”.

The contractor is required to have themanufacturer’s specific Safety Data Sheet (SDS) for each hazardous material used to perform the tasks in this PWS readily available. The contractor is responsible to train his personal on the use of the used hazardous material.

4.4.2 SPILL CONTROL

The contractor shall maintain spill control material at hand at all times sufficient to contain a worst case scenario spill, both volume- and hazard-level. If the contractor spills or releases any hazardous substance, the contractor shall immediately report the incident to the COR. The contractor shall report all spills in accordance with the Hazardous Materials Spill Prevention and Response Plan – 86 AW Plan 32-7069A(U), dated June 2015, to 86 CES/CEIE at building 572 on RAB, 06371-47- 7712 or DSN 480-7712 immediately. Any refueling or maintenance activity on contractor-owned equipment such as lawn mowers, tractors or other equipment has to be performed on an approved area equipped with a secondary containment in order to prevent any spill from reaching the environment.

4.4.3 PESTICIDES RESERVED

4.4.4 HAZARDOUS MATERIAL INVENTORY

The contractor shall provide an inventory report of all hazardous material stored and used to perform the tasks identified in this PWS. The report shall include the name and themaximum quantity of each material stored at one time. Furthermore, the contractor shall provide a report on a quarterly basis indicating the use of any hazardous material.

4.4.5 HAZARDOUS MATERIAL MANAGEMENT

Any hazardous material stored on the AF installation has to be stored in approved storage containers in accordance with Wasserhaushaltsgesetz (WHG), and FGS-Germany, Chapter 5 “Hazardous Material”, and Chapter 9 “Petroleum, Oil, and Lubricants”. The contractor shall remove all hazardous materials by the end of each work day. The contractor shall not conduct process treatments (e.g. paint thinner solvent recycling) on base.

4.4.5.1 HAZARDOUS WASTE

Any hazardous waste possibly generated under this contract shall be disposed of base in accordance with the Kreislaufwirtschafts-und AbfallG, TA – Abfall und TA – Siedlungsabfall (current version), the 86 AW Hazardous Waste Management Plan, and AFI 32-7042 Waste management.

4.4.6 FINAL REPORT

The contractor shall submit a final inventory report, not later than ten (10) work days following termination/completion of this contract, of all hazardous materials used since the last hazardous usage report submitted to the CO/COR. The final inventory report shall list all hazardous materials used, the total amount of each material used, and a description of the disposition of any remaining hazardous material.

4.4.7 CONFORMANCE WITH ENVIRONMENTAL MANAGEMENT SYSTEMS

The contractor shall perform work under this contract consistent with the relevant environmental policies and objectives identified in the installation’s Environmental Management System (EMS) applicable to the contract. The contractor shall perform work in a manner that conserves water, energy and other resources to the maximum extent feasible and ensure minimum production of waste as possible, giving preference to recycling and reutilization opportunities. Furthermore, the contractor shall use less toxic materials whenever available and still reliable for the work to be performed. In the event of environmental nonconformance or noncompliance with host nation and USAF environmental laws and regulations associated with the contracted services is identified, the contractor shall take corrective and/or preventative action. In case of noncompliance, the contractor shall respond and take corrective action immediately. In case of a nonconformance, the contractor shall respond and take corrective action based on the time schedule established by the EMS Coordinator. In addition, the contractor shall ensure that its employees are aware of the Environmental Management System on base and how these requirements affect the work performed under this contract. All on-site contractor personnel shall receive the installation EMS awareness level information.

4.4.8 CONFORMANCE WITH ENVIRONMENTAL REQUIREMENTS

The contractor shall perform all work in accordance with applicable German and U.S. Air Force environmental laws, regulations and operating standards, including but not limited to the Final Governing Standards (FGS) for Germany. The contractor shall be immediately capable of understanding and addressing environmental laws and regulations as they pertain to work performed under this contract.

The FGS for Germany and other important environmental laws and requirements applicable to all contractors working on base will be provided upon request.

4.5 PERMITS, LICENSES AND CERTIFICATIONS

Unless otherwise specified in this contract, the contractor shall obtain the required permits, licenses, and certifications; provide all required notices; and comply with all applicable federal, state, county, and local laws, codes, and regulations in the performance of the requirements of this contract. The contractor shall maintain records of these requirements and make the documentation available to the Government for review.

4.6 HOURS OF OPERATION

The contractor shall perform grounds maintenance services during normal duty hours which are from 06:00 A.M. to 18:00 P.M., Monday through Saturday, excluding German federal holidays, unless otherwise required in the contract or approved by the CO. The contractor shall not perform services in residential areas, housing and dormitories, before 08:00 A.M. or after 17:00 P.M. and on American holidays. There may be situations that will require the contractor to work at times other than normal working hours. When the contractor’s work schedule conflicts with an Air Force mission requirement, the contractor shall advise the CO and reschedule the work to minimize disruption.

In case a facility or area is fenced in or secured, the contractor shall coordinate with the COR all work to be accomplished.

4.7 RECOGNIZED HOLIDAYS. The contractor is not required to provide service on German federal holidays. The contractor is required to perform services on American federal holidays except in the Military Family Housing areas. American federal holidays are listed below:

If these holidays fall on a Saturday, the preceding Friday will be observed. If these holidays fall on a Sunday, the following Monday will be observed. If a holiday falls on a scheduled service day, the contractor will be responsible for rescheduling services for the first day post the holiday observance.

4.7.1 BASE CLOSURES

Work scheduled but not accomplished because of base closure due to weather, exercises, or an actual alert, shall be accomplished as soon as possible after reopening the base.

4.8 SECURITY REQUIREMENTS

Security and base access requirements are contained in AFFARS 5352.242-9000 – “Contractor Access to Air Force Installations.” Contractor employees will be required to obtain and display identification badges. Please anticipate delays when accessing the base with commercial vehicles and allow time for commercial vehicles to reach their destination. Contractor employees shall drive only on designated routes and obey the speed limits posted throughout base. Procedures for commercial vehicle access to the base are subject to change without prior notice.

4.8.1 INSTALLATION ENTRY PROCEDURES

The Contractors personnel shall obtain Base Entry Identification, Installation Common Access Card (ICAC). In order to obtain the ICAC the Contractor is required to submit a USAFE IMT 79 (Request for Base Entry Identification), Memo of Base ID request and the Security Questionnaire for a simple security check as well as a Police Good Conduct Report (Polizeiliches Fuehrungszeugnis). USAFE IMT 79, Memo of Base ID request and the Security Question forms shall be provided by the 786 CES/CEOES COR. Contractor personnel shall take the USAFE Form 79, Memo of Base ID request along with Police Good Conduct Report and the Security Questionnaire to Bldg #134 at Ramstein Air Base, to obtain the ICAC. Contractor Personnel shall only gain access to the KMC after the security check has been passed with positive result. It is the responsibility of the contractor to collect and turn-in the ICAC to the COR within one week for personnel no longer employed.

4.8.2 ESCORT

The contractor will have escorts appointed for entry into the Munitions Storage Area on Ramstein Air Base and any other area requiring escorted entry. Arrangements for escorts will be made by the COR.

4.9 PERFORMANCE OF SERVICE DURING CRISIS OR HEIGHTENED SECURITY

This service is not determined to be essential for performance during crisis according to DoDI 3020.27.

4.9.1 WORK STOPPAGES

Work stoppages may occur during the performance of the contract due to military exercises. These exercises should be expected at various times and to be of varying lengths. If possible, the CO/COR will give the contractor 24 hours’ notice of all military exercises

4.10 SPECIAL QUALIFICATIONS

4.10.1 CERTIFICATIONS

The contractor shall be a member of either the German Chamber of Commerce (Industrie- und Handelskammer) or the German Chamber of Trade (Handwerkskammer). Membership must continue throughout contract performance.

4.10.2 SITE CONTRACT MANAGER

The contractor’s on-site technical manager shall have a completed apprenticeship in horticulture.

The contractor shall provide the name and telephone number of the contractor’s on-site technical manager and alternate responsible for all requirements defined in this PWS. Upon request by the COR, the contractor shall meet or contact the COR on an as-needed basis to discuss the contractor’s upcoming items.

4.10.3 PERSONNEL LANGUAGE PROFICIENCY

All contractor personnel shall be proficient in reading, writing, understanding and speaking English at a level necessary to fully perform all required duties and tasks of their position. The CO may request demonstrations of ability to meet personnel language proficiency requirements by any reasonable method. The contractor’s on-site manager and his/her alternates shall be able to speak, read and write in the English proficiency level II (good), to fully perform all required duties and tasks of their position.

4.10.4 PERSONAL APPEARANCE

Contractor personnel shall present a neat appearance and be easily recognized. This shall be accomplished by wearing a shirt, jacket, or coveralls bearing the name of the company. Ball caps alone are not sufficient. The contractor shall ensure uniforms are kept in a well-maintained, standard, and acceptable manner as compared to commercial practice.

4.10.5 SPECIAL SITE CONDITIONS

The contractor shall ensure that their employees use only those roads authorized for carrying out their work and authorized for transport.

4.10.6 CONTRACTOR VEHICLES

All slowly moving contractor vehicles used in the performance of this contract shall be equipped with a flashing yellow or orange light and “slow moving vehicle” signs to warn passing motorists and pedestrians. All contractor vehicles shall be clearly marked with the contractor’s name and/or logo. The contractor shall ensure that the weight and design of any vehicles driven off-road do not cause any damage to the grass or cause rutting, in the event rutting occurs, the contractor shall restore the area to its original condition. The contractor shall obey all traffic control devices and stay on roads authorized for their work and transport.

4.11 INTERFACES

The contractor shall not unduly interfere with regularly scheduled Government operational activities in the performance of contract requirements. In the event a Government supervisor requests that work be interrupted, temporarily cease work in the area and report the instructions, to include the name of the Government personnel involved, to the CO/COR immediately by the most expedient means. The contractor shall notify the CO/COR verbally of disputes with customers or other base contractors and follow the occurrence up in writing.

4.12 CONTRACTING OFFICER AND CONTRACTING OFFICER REPRESENTATIVE

(QUALITY ASSURANCE PERSONNEL)

The CO will appoint a primary and alternate representative for the management of the day-to-day activities of the contract. The identity, title, and authority of this representative will be provided in writing to the contractor after contact award.

4.13 WORK CLEARANCE REQUESTS

The contractor shall obtain an approved Work Clearance Request for all work which involves excavation including minor digging. Digging permits are available through the Service Contract Office in Ramstein, Bldg. 502.

4.14 SAFETY REQUIREMENTS AND REPORTS

The contractor shall perform work in a safe manner as required by OSHA Safety and Health requirements. The contractor shall provide a verbal report to the CO as soon as possible of each occurrence of damage to Government property or an accident resulting in death, injury, occupational disease, or adverse environmental impact. The contractor shall provide a completed copy of the required Accident Investigation Reports to the CO within five (5) calendar days of each occurrence.
