Draft Performance Work Statement (PWS) U.S. Border Patrol Ajo Station
Solid Waste and Trash Removal Services
1. BACKGROUND:
Ajo Station serves as an integral part of U.S. Customs and Border Protection, U.S.
Border Patrol, Tucson Sector. Ajo Station requires solid waste removal and trash pickup, as various administrative duties are conducted which generate a considerable amount of waste (trash). Solid waste removal and trash pickup services are required to maintain a clean, healthy and orderly work environment for personnel assigned to the Ajo Station.
2. SCOPE:
The Contractor shall provide solid waste removal services for the Ajo Border Patrol Station and the Ajo State Route 85 Checkpoint, Mile Marker 18, as outlined in this PWS.
The Contractor shall, during the performance of work, comply with direction from on-site Border Patrol personnel regarding access control and basic safety rules when on the premises of the station or checkpoint. The Contractor is responsible for its personnel and for familiarizing itself with safety requirements. The Contractor shall advise the Contracting Officer (CO) of any special safety restrictions established so that Government personnel can be notified of these restrictions. The Contractor shall permit safety inspections of all work being performed.
The Contractor shall operate all equipment in a safe, careful, and efficient manner. All equipment shall be in good operating condition and calibrated, if required. Contractor employees supporting this effort shall possess required licenses/certificates as required by Federal, State, and/or local authorities.
The Contractor shall safeguard the public and Government personnel, property, materials, supplies, and equipment exposed to Contractor operations and activities. The Contractor shall avoid interruptions of Government operations in the performance of this contract. The Contractor is responsible for any Government property lost or damaged as a result of the Contractor's performance of this contract.
3. COMPLIANCE WITH FEDERAL, STATE, AND LOCAL LAW
The Contractor shall comply with all Federal (e.g., OSHA and EPA), State, and local laws, directives, regulations, ordinances, codes, and other orders as applicable to this type of service.
4. SPECIFIC REQUIREMENTS:
The Contractor shall perform the following tasks:
4.1 Task 1 - Container Sizes
The Contractor shall provide trash collection containers of the following sizes and quantities: four 4-yard containers, six 6-yard containers, and seven 35-gallon containers. The containers shall have the capability to close all openings so that the trash will not overflow or leak out. The containers shall have lids capable of staying closed during high winds.
4.2 Task 2 – Weekly Trash/Waste Removal
The Contractor shall empty the trash containers three times per week at Ajo Station (Location 1) and once per week at the Ajo Checkpoint (Location 2). All pickups shall be performed between the hours of 5:00 a.m. and 5:00 p.m. on the days of the week (Monday-Friday) set forth in the Contractor’s approved schedule (see Section 5, Deliverables and Deliverable Schedule), excluding the Federal holidays listed in Table 1 below. When any such day falls on a Saturday, the preceding Friday is observed. When any such day falls on a Sunday, the following Monday is observed. If trash removal is scheduled to occur on the day of observance of a Federal holiday, the removal shall be completed on the business day either immediately preceding or following the holiday.
Any changes to the schedule must be coordinated and approved by the Contracting Officer’s Representative (COR) before taking effect.

4.3 Task 3 - Equipment and Services
The contractor shall provide all labor, tools, parts, material, equipment, transportation and incidentals necessary to deliver, set up, and prepare trash containers, and to remove trash from all Border Patrol locations identified in Section 7. The Contractor shall be responsible for maintaining its equipment in workable condition and shall not be relieved of its responsibility for performance under this contract in the event of an equipment breakdown. Any costs incurred by the Contractor for repairs shall be borne by the Contractor.
4.4 Task 4 – Transportation
The Contractor shall ensure that all drivers follow the directions provided by on-site Border Patrol personnel. The drivers shall report obstructions which interfere with accessing the containers to the on-site Border Patrol personnel.
4.5 Task 5 - Disposal of Solid Waste
The Contractor shall ensure that all solid waste collected is disposed of only at incinerators, landfills, or other facilities that are approved by the Environmental Protection Agency (EPA) as being in conformance with existing Federal, State, and local laws, directives, regulations, ordinances, codes, and other orders relating to safety and health. The Contractor shall provide the location information of the facility that will be utilized for disposal of waste.
4.6 Task 6 – Clean-up of Areas
The Contractor shall not create any litter at loading locations, during transportation, or at disposal locations. The Contractor shall clean up waste and hydraulic fluid leaks or spills caused by the Contractor's equipment while on Government property. Clean-ups shall be performed in compliance with Federal, EPA, State, and local regulations.
5. DELIVERY SCHEDULE:
Within seven (7) calendar days of contract award, the Contractor shall provide a proposed schedule of services that shall include the name of the location and the day(s) of the work week (Monday-Friday) on which services will be performed. Services must be performed on the same day(s) each week unless the scheduled day falls on a federal holiday or a schedule change is approved in accordance with Section 4.2.
6. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION:
No Government-furnished property or information will be provided.
The Government will provide adequate space to allow the driver to perform removal of solid waste from each location.
7. PLACE OF PERFORMANCE:
The places of performance for the required services are as follows:

8. PERIOD OF PERFORMANCE:
The period of performance consists of one base year and four (4) option years to be exercised at the discretion of the Government. The period of performance of each period is as follows:

9. SECURITY:
a. There are no specific security classification level requirements associated with this procurement action. Information is deemed unclassified.
b. Contractor and subcontractor employees are subject to the terms and conditions of the clause entitled, “Contract Services Not Requiring a Background Investigation (May 2022).” In accordance with the clause, such employees entering a CBP-controlled facility are required to complete requisite pre-screening security checks and are subject to a criminal history and limited background check utilizing the National Crime Information Center (NCIC) system. Additionally, all such employees must be sponsored by a CBP employee or contractor who are in possession of a valid Personal Identity Verification (PIV) card. Contractors and subcontractors who have not been issued a PIV card must be continually escorted upon entering a CBP-controlled facility. The Contractor shall promptly submit the required information for background checks following contract award.
10. SPECIAL CONSIDERATIONS:
10.1 Disclosure of Information. Any information made available to the Contractor by the Government, or its customers shall be used only for the purpose of carrying out the provisions of this contract. This information shall not be divulged or made known in any manner to any persons except as may be necessary in the performance of the contract.
10.2 Changes to the SOW
No changes to this SOW or cost increases shall be incurred without written prior approval of the Contracting Officer (CO) as coordinated by the COR. Any changes or cost increases will not take effect until the CO executes a written modification. See CBP clause entitled “Contracting Officer’s Authority.”
11. Points of Contact

12. PERFORMANCE REQUIREMENTS SUMMARY

An amount equal to the daily price of refuse removal for each calendar day that the defect remains until it is remedied, beginning on the day that the Contractor is notified of the defect
Note: The identified monitoring methods listed in 30(a) through 30(e) are merely the anticipated methods and are subject to change at any time at the Government’s sole discretion.
The “daily price” is defined as the monthly refuse removal price divided by the number of calendar days in a given month. For example, if the monthly price were $5,000 per month and there were 31 days in a month, the daily price would be equal to:
$5,000.00/31 = $161.29. If a missed pickup resulted in an overflowing dumpster or unsanitary conditions and this defect was not remedied for five calendar days, the invoice deduction would be calculated as follows: $161.29 x 5 days = $806.45.
13. INVOICE DEDUCTIONS FOR DEFICIENT CONTRACT PERFORMANCE
The Contractor’s monthly invoice shall account for any payment deductions due to failure to meet the Acceptable Quality Levels (AQLs) in the Performance Requirements Summary (see Section 12).
Upon receipt of the monthly invoice, the Government COR will compare the Contractor’s proposed deductions, if any, to Government and Contractor records. A record of any discrepancy in deduction amount will be submitted to the Contractor in writing.
The Contractor may, within ten (10) business days of receipt of the written discrepancy notice, present in writing to the CO and COR the reasons why the discrepancy exists and why any or all the proposed deductions are or are not warranted. Reasons must be solidly based and must provide specific facts that justify reconsideration and adjustment of the proposed amount to be withheld. The Contractor’s failure to respond within the ten (10) day period will be considered acceptance of the Government’s proposed payment deduction(s).
Monthly payments will not be delayed pending resolution of disputes regarding proposed payment deductions. Monies for proposed payment deductions will be withheld pending the final decision from the Contracting Officer concerning disputed defects.
The taking of payment deductions does not waive or limit any right of the Government under any default, termination, or inspection clause. In addition, the Government reserves the right to seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services, over and above the deductions/disincentives authorized by the Performance Requirements Summary.
Depending on the Contractor's overall performance (for example, repeated instances of nonperformance or unsatisfactory performance), the Government may issue a Cure Notice or Show Cause letter, which may lead to termination of the contract.
