Performance Work Statement Tuttletown Recreation Area Recycle & Refuse Collection and Disposal Services Tuttletown Recreation Area, New Melones Lake, Sonora, CA.
Dated: 6/29/2022
Part A: General Information
1. Introduction: The purpose of this contract is to provide refuse collection and disposal services to various locations at New Melones Lake operated by the U.S. Bureau of Reclamation. The Contractor shall provide all labor, materials, equipment, supplies, permits, transportation and supervision necessary to provide the refuse collection and disposal service at designated facilities at New Melones Lake. New Melones Lake is located off highway 49 in Tuolumne and Calaveras Counties, Sonora, California.
This requirement calls for placement and subsequent servicing of up to twenty-eight (28) refuse/recycle dumpsters, one (1) 2-yard refuse dumpster, two (2) 2-yard recycle dumpster, one (1) 4-yard refuse dumpster and two (2) 20-cubic yard bins at New Melones Lake. The dumpsters will be located at the Tuttletown Recreation Area, New Melones Lake Maintenance yard, and New Melones Dam. The dumpsters will be placed at assorted locations disbursed amongst restricted areas, day use, campground, parking lots and groups camping areas.
2. Area Closures: In the event that any part or the entire Park is permanently or temporarily closed, the segments of this contract pertaining to that area will not be required and therefore not utilized. Contractor shall not preform work in those areas or facilities that are closed.
3. Point of Contacts: Contracting Officer Representative (COR): New Melones Lake (209) 536-9094.
4. Estimated Quantity Line Items: All Section B, Pricing Schedule, Line Items with quantities are estimated quantities and are not guaranteed amounts. The Contractor will only be paid for work performed. At no time will the Contractor exceed the estimated quantities against the estimated quantity Line Item. The Contractor will establish a tracking system of actual quantities against the contract’s estimated quantities for each estimated quantity Line Item and will maintain the tracking system up to date throughout the life of the contract: when the actual quantity of any Line Item reaches 75% of the estimated quantity on any estimated quantity Item, the Contractor will notify the Government’s COR in writing by fax or e-mail within two (2) business days. Once the Government is notified that the actual quantity has reached 75% of the estimated quantity on any Line Item and if the Government determines that the estimated quantity needs to be increased, the Contractor will receive an official modification to the contract action signed by the Contracting Officer increasing the quantity and the amount obligated on the contract BEFORE the Contractor will proceed to work over the estimated quantity. The modification will establish the new estimated quantity that the Contractor shall not exceed without another modification. Every invoice will be accompanied by a full accounting of each Line Item being billed, the actual quantity being billed and supporting documentation to support the actual quantities.
5. Invoicing & Payment: The Contractor shall submit an itemized invoice, which shall include the unit price for each type of service provided and the number of units serviced for each type of service. Payment shall be made monthly in arrears at the contract unit price for services performed in accordance to the pricing schedule.
6. Type of Contract: This requirement shall be awarded as a firm fixed price purchase order for a base year and four (4) option years.
7. Period of Performance: This contract shall be for a Base Year and four (4) Option Years. The Option Years will be exercised based on the performance of the Contractor and the existing need for the services by the Government. The period of performance will be as follows:

8. Pre-work Meeting: This meeting shall be held at the New Melones Office within 15 business days after award of the contract and prior to the beginning of work, at a time mutually agreeable the Contractor and the Contracting Officer’s Representative. The purpose of this meeting will be to review the contract and the work to be performed. At this time, the Contractor shall be required to submit, for Government approval, the following listed items:
a. List of all supplies and materials to be used on the job with manufacturer’s recommendations on the use of all materials and material data sheets.
b. Detailed work schedules for each service area for the first month of the contract period.
c. List of employees who will be working on the contract.
d. Name, address, and telephone number of authorized supervisors.
e. Make, model, and year of all power equipment.
Part B: Work to be Preformed
1. General Information: The Contractor shall provide all labor, materials, and equipment to provide refuse collection and disposal services at the designated facilities at New Melones Recreation Areas. In addition to the above, the Contractor will be required to comply will all State, County, and Federal Laws and/or sanitary regulations governing the pick-up, hauling, and disposal of refuse hauled; and the Contractor shall be solely responsible for obtaining any licenses or permits that may be required for performance of the contract. Any costs involved in obtaining licenses or permits shall be at the expense of the Contractor.
2. Work Locations: The following information below is the units described and the location for dumpsters and bins at the New Melones Lake:
a. Up to twenty-eight (28) recycle/refuse dumpsters are in the Tuttletown Recreation Areas, Tuolumne County.
b. One (1) 2-yard refuse dumpster and one (1) 2-yard recycle dumpster located at 6850 Studhorse Flat Rd, Administration Maintenance Yard, Tuolumne County.
c. One (1) 4-yard refuse dumpster and one (1) 2-yard recycle dumpster located at the New Melones Lake Dam, Tuolumne County.
d. One (1) 20 yard low-boy bin located as directed to the Tuttletown Recreation Area, Tuolumne County or 6850 Studhorse Flat Rd, Administration Maintenance Yard, Tuolumne County upon request up to 2 times per year.

3. Work Schedule:
a. Days of Operation: A business day shall be considered Monday through Friday. Service shall be as indicated within this statement of work unless otherwise specified by the COR. The Contractor shall be notified of schedule changes at least 72 hours in advance.
b. Hours of Operation: Work completed under this statement of work shall be accomplished between 8:00 a.m. and 4:00 p.m. unless otherwise approved by the COR. The Contractor shall notify the Park Office if the services are unable to be performed for any reason.
c. Federal Holidays: When a service day falls on a Holiday, the service shall be performed on the following day. The Eleven (11) Federal Holidays are as follows:

When one of the above designated holidays falls on a Sunday, the following Monday is observed as the legal holiday. When a designated holiday falls on a Saturday the preceding Friday is observed as a legal holiday.
4. Service Schedule: Refuse/Recycle removal servicing shall be as follows:
a. Tuttletown Recreation Area Peak-Season: From April 1 to September 30, up to twenty-eight (28) recycling/refuse dumpsters located throughout the Tuttletown Recreation Area serviced on a day approved by the COR between 8:00 a.m. and 4:00 p.m.
b. Tuttletown Recreation Area Off-Season: From October 1 through March 31, up to twelve (12) recycling/refuse dumpsters located throughout the Tuttletown Recreation Area are serviced on a day approved by the COR from 8:00 a.m. to 4 p.m.
c. Other Locations: The Administrative and New Melones Dams dumpsters do not have seasonal adjustments.
d. Additional Services: Extra collection and disposal of refuse may be required for periods of heavy use, such as during holidays, special events, and including, but not limited to, other unforeseen circumstances, such as unusual amounts of usage.
1. Requests for additional services could include extra scheduled collection and removal.
2. Requests for additional services will be made by the COR.
3. Additional servicing must be completed within 48 hours after the request is made.
5. Dumpster(s) and Bin(s) defined:
a. 2-Yard Refuse Dumpster(s): Contractor shall provide up to one (1) 2-yard refuse dumpsters for this contract. Each dumpster shall meet the following specifications:
i. Two (2) cubic yard capacity.
ii. A covered and lockable top that is hinged on one side.
iii. The dumpster shall be painted brown.
iv. The dumpster shall be signed for general trash
v. A dumpster with a drainage design that prevents water from collecting inside the dumpster.
vi. The side height shall not exceed 60 inches.
vii. Shall be serviced and repaired, painted and new safety labels applied prior to being placed back in all the recreation areas one week in advance of the peak-season
viii. Shall be sanitary, attractive, and cleaned periodically to eliminate and buildup of offensive odor.
b. 4-Yard Refuse Dumpster(s): Contractor shall provide up to one (1) 4-yard refuse dumpsters for this contract. Each dumpster shall meet the following specifications:
i. Four (4) cubic yard capacity.
ii. A covered and lockable top that is hinged on one side.
iii. The dumpster shall be painted brown.
iv. The dumpster shall be signed for general trash
v. A dumpster with a drainage design that prevents water from collecting inside the dumpster.
vi. The side height shall not exceed 60 inches.
vii. Shall be serviced and repaired, painted and new safety labels applied prior to being placed back in all the recreation areas one week in advance of the peak-season
viii. Shall be sanitary, attractive, and cleaned periodically to eliminate and buildup of offensive odor
c. 2-Yard Recycle Dumpster(s): Contractor shall provide up to two (2) 2-yard recycle dumpsters for this contract. Each dumpster shall meet the following specifications:
i. Two (2) cubic yard capacity.
ii. A covered and lockable top that is hinged on one side.
iii. The dumpster shall be painted green.
iv. The dumpster shall be signed for general trash
v. A dumpster with a drainage design that prevents water from collecting inside the dumpster.
vi. The side height shall not exceed 60 inches.
vii. Shall be serviced and repaired, painted and new safety labels applied prior to being placed back in all the recreation areas one week in advance of the peak-season
viii. Shall be sanitary, attractive, and cleaned periodically to eliminate and buildup of offensive odor
d. Recycling/Refuse Dumpster(s): Contractor shall provide up to twenty-eight (28) recycling/refuse dumpsters for this contract. Each dumpster shall meet the following specifications:
i. Four (4) cubic yard capacity.
ii. The dumpster will be divided into 2 equal sized areas by a fixed divider.
iii. A separate lockable lid shall be provided for each area defined above.
iv. Each lid shall provide an access hatch or door that is between 24 inches and 30 inches wide by 24 inches and 30 inches long.
v. Each access door or hatch must be self-closing and have a latch
vi. The dumpster shall be painted so the right half of the dumpster is blue, and the left half of the dumpster shall be painted brown.
vii. The right half shall be signed for recycling and the left half for general trash.
viii. A dumpster with a drainage design that prevents water from collecting inside the dumpster.
ix. The side height shall not exceed 60 inches.
x. Shall be serviced and repaired, painted and new safety labels applied prior to being placed back in all the recreation areas one week in advance of the peak-season
xi. Shall be sanitary, attractive, and cleaned periodically to eliminate and buildup of offensive odor
e. Bin(s): Contractor shall provide up to two (2) bins for this contract. Each bin shall meet the following specifications:
i. Twenty (20) cubic yard capacity
ii. Shall not have side walls that exceed 60 inches in height
iii. Shall allow for mixed waste
iv. Shall be delivered upon request and be on-site for at least seven (7) days.
v. Shall allow for 5600 lbs of material to be placed in the bin. Government shall not exceed the allowed height of waste in the bin.
6. Staging, Placement and Removal of Dumpster(s): The Contractor will typically move dumpsters that are not in use or are in closed areas to a staging area, as identified in Section 8. The COR may authorize the Contractor to leave dumpsters that are in closed areas in place. The Contractor will move dumpsters from the staging area to dumpster locations as identified in Section 2 as requested by the COR. The Contractor shall not charge the Government for moving dumpsters to or from the staging areas, and there shall be no fee associated with dumpsters stored in the staging area. Contractor shall move dumpsters to/from staging on the Contractors next normal service day, the Government will provide a minimum of 3 business day notice for dumpster movement.
7. General Specifications: General specification are as follows below and shall be completed in a professional manner.
a. Service: The Contractor shall empty dumpster as specified in the Service Schedule.
b. Unserviceable Units and Repairs: The Contractor is responsible for the upkeep of the dumpsters. At no cost to the Government, the Contractor shall replace any dumpster found to be unserviceable or not to be compliant with the specifications identified in Section 5 of this Performance Work Statement. Upon notification by the COR that a dumpster must be replaced, the Contractor shall complete the work within 3 business days, unless the COR authorizes a longer replacement period.
8. Storage/Staging: Dumpsters are to be stored/staged in an area designated by the COR. The Contractor shall not charge for moving dumpsters to or from the storage/staging area. Dumpsters in storage/staging shall not be assessed any storage fee. The Staging area will be located within the Tuttletown Recreation Area.
Part C: Contractor Responsibilities
1. Quality Control: If someone other than the person named on the official contract is performing the duties as described, it is the responsibility of the Contractor to personally inspect the worksite a minimum of every 30 days to ensure adherence to contract specifications and acceptable performance standards. Contact with the Park Office shall be made upon arrival during these visits.
2. Certification: The Contractor shall hold any licenses or certifications required by the State of California and register with Tuolumne and Calaveras Counties as needed and provide proof of any certification before the start of work. The Contractor shall be responsible for any permits required to perform services.
3. Monthly Reports: The contractor shall provide the COR monthly a report which provides the monthly total weight of refuse and recycled materials from: 1) New Melones Dam (location 30), Administration (location 29), and Tuttletown Recreation Area (locations 1-28). This data will be separated into the three (3) areas identified above.
4. Dumpster Related Issues: The contractor shall contact the COR AND the Ranger Shift Lead (916-402-1285) when a dumpster cannot be serviced as the result of illegal dumping (i.e., construction debris, hazardous materials, etc..) or if a dumpster scheduled to be serviced can not be serviced because it is blocked (i.e., vehicle blocking, closed gate, etc..).
5. Accident Records: The Contractor shall maintain an accurate record of and shall report to the CO in the manner and on the forms prescribed by the CO, all accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies, and equipment incidental to work performed under this contract. Medical expenses for Contractor personnel are the responsibility of the Contractor.
6. Insurance: A copy of evidence showing the acquisition of insurance, if required by this contract, shall be submitted to the COR prior to the commencement of work.
7. Employees: The Contractor shall furnish competent, safety conscious personnel. If employees prove to be incompetent or unsatisfactory, the Contactor shall remove them immediately and replace them. For safety and security purposes, the Contractor shall submit IN WRITING the name, address and phone number of all personnel preforming services under this contract prior to the commencement of work. The Contractor shall submit IN WRITING the name of all employees discharged during this contract.
8. Equipment and Supplies: The Contractor shall furnish all equipment and supplies, such as dumpsters, etc. to satisfactorily perform the service specified herein. A list of all materials and equipment shall be submitted for approval by the COR before their use. All equipment shall be of commercial quality and in a condition to adequately and safely perform services for which intended.
9. Caution and Safety: Safety is a special requirement that cannot be overstated, all written safety procedures on chemicals and working material shall be observed and followed at all times. Wearing of hardhats is required in posted areas. The Contractor’s personnel shall abide by all Bureau of Reclamation safety rules and regulations. The Contractor shall direct any questions regarding safety to the COR.
a. Prior to work under this contract, the Contractor and designated representative for the CO will jointly prepare a Safety Action Plan/Hazard Analysis, which will become an integral part of this contract. This Plan will include, but will not be limited to, use of chemical compounds and protection or personnel, protection of areas during service, cleaning etc.
b. Prior to work under this contract, the Contractor shall submit for approval by the COR a supply “Material Safety Data Sheet” or “Occupational Safety and Health Act (OSHA) Form 20” for all cleaning agents, disinfectants and/or chemical compounds to be used within the scope of this contract. The COR retains the right to reject any material that may create a safety or health hazard.
c. The Contractor’s equipment and vehicles will meet all safety standards as required by Federal, State and OSHA standards.
d. The Contactor will not be entitled to any claim for damages resulting from the termination of operation for safety hazards or violations of safety precautions or because equipment is not of commercial quality.
e. The COR may stop work immediately if any procedure or operation under this contract is in violation with the above or is an immediate obvious safety hazard.
Part D: Government Responsibilities
1. Staging/Storage Area: The Government shall identify a designated area for the storage/staging of dumpsters within the Tuttletown Recreation Area.
2. Inspections: The Government shall inspect the Contractor’s performance in all functional areas under this contract and shall reserve the right to use whatever additional surveillance procedures are deemed appropriate. Contractor services shall be inspected using the random sampling method, the planned sampling method and/or 100% inspection method. The Government reserves the right to change or alter the type of inspection plan at its discretion at any time.
3. Performance Based Plan:
a. Monitoring Performance: During the course of the evaluation period, the COR will tack Contractor performance. Interim (mid-term) evaluations may be provided to identify strengths and weakness in the Contractor’s performance during the period being evaluated. At the end of the period, the COR will assess the Contractor’s performance in accordance with the Quality Assurance Surveillance Plan (QASP) and report to the CO.
b. COR Recommendation: The COR will consider all evaluations and any other pertinent information, including Contractor self-assessment, and will prepare a report to the CO with findings and recommendations. The Contractor will be provided a copy of the draft findings and recommendations of the COR and will be afforded the opportunity to identify factual errors. The COR’s draft recommendation is not subject to negotiation and the COR will not engage is discussions with the Contractor. Any errors identified by the Contractor will be addressed by the COR in its final report. The Contractor will be provided a copy of the final COR report at the same time the report is submitted to the CO.
c. The Quality Assurance Surveillance Plan (QASP) is one evaluation method the Government uses to perform surveillance to determine whether the Contractor meets the standards of performance as defined in the Performance Work Statement. The absence of a QASP for any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the Government under any other provision of the contract in determining the quality of the Contractor performance.
