Statement of Work (SOW) File Search and Class III Cultural Resource Inventory and Paleontological Resource Inventory at Fresno Reservoir Spillway Crest Raise, Hill County, Montana
1 – Background and Purpose of the Project The purpose is a contract for a file and literature search (file search) and a Class III cultural resource inventory and a paleontological resource inventory focusing on the shoreline and inundation elevations between 2575 and 2582 of Fresno Reservoir in Montana. A spillway crest raise of 7 feet is proposed to raise the operating elevation of the reservoir to 2582.00. The Montana Area Office (MTAO) of the Bureau of Reclamation will increase the capacity of Fresno Reservoir with a spillway crest raise of 7 feet. The locations of the inventory areas are in Hill County. The inventory is approximately 3600 acres in size and covers approximately 61 miles of shoreline. Access may be difficult and will be limited to public roads, public land, public boat launches, and the reservoir. It is expected watercraft will be necessary for access to some locations.
The Contractor shall conduct a cultural resource file search and a Class III cultural resource inventory of designated areas, as outlined in this Statement of Work (SOW). The file search and inventory are required for Reclamation’s obligations under Section 106 of the National Historic Preservation Act (NHPA) and will work towards fulfilling some of Reclamation’s obligations under Section 110 of the NHPA. In general, the file search, Class III cultural resource inventory, and report recommendations should be conducted using existing guidance from the Montana State Historic Preservation Office (SHPO), the National Register Criteria (36 CFR 60.4), and the National Park Service National Register Bulletins. This area is known to have been used by members of Montana’s tribes: documentation regarding that use should be part of this inventory and analysis.
The Contractor shall deliver a cultural resource inventory draft report and a final report. Final payment is contingent on Reclamation receiving acceptable deliverables. The Contractor will recommend eligibilities, avoidance procedures, and mitigations, if necessary. Electronic files with associated metadata showing survey areas and locations of newly recorded and revisited resources are required. Three copies of the final report in hardcopy, as well as three electronic versions of the final report are required. The electronic portion of mapping data shall be based on and provided as shapefiles compatible with ArcGIS Desktop 10.8.1.
The Contractor shall conduct a paleontological resource inventory of the designated areas as outlined in the SOW. The identification, evaluation, and protection of paleontological resources on public lands is mandated by the Paleontological Resources Preservation Act. MTAO has adopted the Bureau of Land Managements (BLM) data standards and SOW format for this project.
The Contractor shall deliver a paleontological resource inventory draft report and final report.
Final payment is contingent on Reclamation receiving acceptable deliverables. The Contractor will include a summary of results, number of localities identified, specific sites that look like excavation might be warranted, any evidence of theft, vandalism, or dumping, and recommendations about how best to manage the resources identified.
Location The locations of the inventory are:
T33N, R14E: Portion of Section 6, 7, 17, 18, and 19 in Hill County T33N, R13E: Portion of Section 1, 2, 11, 12, 13, 14, 24, and 25 in Hill County T34N, R13E: Portion of Section 1,6, 7, 8, 9, 15, 16, 17, 18, 22, 23, 26, 27, 35, and 36 in Hill County T34N, R12E: Portion of Section 1, 2, 3, and 12 in Hill County T35N, R12E: Portion of Section 26, 27, 34, and 35 in Hill County

2 – Assembling Existing Data Regarding the File Search for the Class III Cultural Resource Inventory
The Contractor shall conduct a file search with the SHPO. The purpose of this search is to ensure the Contractor is familiar with all previous work conducted in the general area of the project. This information will be a necessary component of the inventory report. The results are to be incorporated as an appendix to the final cultural resource inventory report. Please note that additional source material related to the history of the Fresno Reservoir area, if needed, may be supplied by the U.S. Government through Reclamation sources, such as, MTAO records and Missouri Basin Regional Office (MBRO) records. The Contractor shall contact the Contracting Officer’s Representative (COR) regarding scheduling research access to any such records, if necessary. The Contractor will be allowed to make copies of reports and other information relevant to the search and reasonable in quantity of copying. Contact the COR for authorization prior to copying. Some information is also available on Reclamation’s website. This does not limit the Contractor from accessing any other relevant information sources they need to complete the file search.
3 – Assembling Data Regarding the Class III Cultural Resource Inventory
Limited testing and/or collection, testing, or excavation is not authorized under this inventory;
however, artificial exposure of the subsurface (metal detecting, auger probing or shovel testing) is sometimes a necessary part of Class III inventories and should be included in identification efforts if ground/surface visibility is completely obscured by heavy vegetative cover. Do not collect any artifacts if discovered. Document them, including location, and return them to their original location.
The Contractor will ensure they have obtained a current Permit for Archeological Investigations (DI Form 1991), authorized for Non-collection Cultural Resource Inventory and Recordation only, from MBRO prior to award. An application for this permit (DI Form 1926) can be applied for by contacting MBRO Archaeologist Dr. George Shannon at:

• Gather information to provide a basis for completing the file search. The results are to be incorporated as an appendix to the final cultural resource inventory report.
• Perform an on-the-ground search for all cultural resources located on the specified tracts indicated in this SOW.
• Limited testing and/or collection, testing, or excavation is not authorized under this inventory; however, artificial exposure of the subsurface (metal detecting, auger probing or shovel testing) is sometimes a necessary part of Class III inventories and should be included in identification efforts if ground/surface visibility is completely obscured by heavy vegetative cover. Do not collect any artifacts if discovered.
Document them, including location, and return them to their original location. The Contractor shall follow the standard permit conditions and special permit conditions under the Permit for Archeological Investigations (DI Form 1991) when conducting work under this contract as it relates to Inventory and Recordation only as explained in the issued permit, as well as specific direction regarding work and deliverables included in this SOW. If historic period architectural structures or remains are located the Contractor shall conduct a land title examination as part of the site identification and evaluation.
• MTAO generally follows the Consulting with the Montana State Historic Preservation Office Guidelines and Procedures regarding site definitions and site form preparation, isolated find definitions, and report format. The Contractor will follow these guidelines. These guidelines can be found at:
mailto:gshannon@usbr.gov
5 – Performing the File Search and Class III Cultural Resource Inventory Specifics
The Contractor shall:
• Perform a file search as described in Section 2 – Assembling Existing Data
Regarding the File Search for the Class III Cultural Resource Inventory of this SOW.
• Cover the area to be inventoried on foot by employing standard survey methodology. Transect intervals will be 30 meters or less. Steep landforms, such as rock faces, talus/scree slopes, and cliffs, should be inspected for the possibility of cultural remains including but not limited to human burials, rock shelters/caves, buffalo kill sites, and rock art. If transects are widened, the contractor shall document the rationale employed which justifies deviation from the standard interval distance. In all cases, coverage must be thorough. Coverage shall include to the shoreline meeting with the edge of the Fresno Reservoir.
• Identify from all surface and exposed indications all cultural properties or materials. At each site location place a site datum. No datum should be placed within road corridors where it could cause damage or harm to road users.
• Document time diagnostic artifacts, e.g., projectile points and ceramics. Include both those found on sites and those occurring in isolation. Document these in place. Do not collect.
• Artificial exposure of the subsurface (metal detecting, auger probing or shovel testing) is sometimes a necessary part of Class III inventories and should be included in identification efforts if ground/surface visibility is completely obscured by heavy vegetative cover. Also, this limited testing may be performed to establish potential for site deposition, site boundaries, or significance. This limited testing may be performed at the discretion of the field director. Do not collect any artifacts if discovered. Document them as indicated in this Section and return them to their original location.
• Locate each cultural property on a United States Geological Survey (USGS) 7.5' quadrangle topographic map.
• Record all cultural properties on Montana Cultural Resource Information System forms (CRIS) and any isolated finds on the recommended isolated find/feature form. These can be found at https://mhs.mt.gov/Shpo/Forms. Also, record previously recorded cultural properties located within unit boundaries identified for inventory. Use the Montana Stone Circle forms for recording Tipi Rings. In addition to the CRIS, record structures on the Historic Property Record Form.
• Irrigation features shall be recorded on MTAO Irrigation Feature Recording Forms as well as CRIS. An Irrigation Feature Recording Form is included in Attachment E – Forms.
• Take at least two photographs of each cultural property. Noticeable changes in geography dictate that at least one photograph of each land type within the tract should be included. Standing historic structures shall be photographed on all sides to illustrate architectural features. Label all photographs and negatives with a description and orientation. A photographic record shall be maintained and included in the final submission. Use the Acceptable standards found at the https://mhs.mt.gov/Shpo/Forms
National Park Service website at:
https://www.nps.gov/subjects/nationalregister/upload/Photo_Policy_update_2013_05_15_ 508.pdf
• for film photography and documentation. Digital photography is acceptable in lieu of film photography. Digital photography must meet, at a minimum, the Acceptable standards found at the same website. Also, use these standards for FIPS 140 compliant flash drive or external hard drive* storage (in place of CD storage), storage CD disks, labels, and paper and inks used in the production of the photographs.
• Prepare scale maps of all sies based on the location of the site datum and include topographic contour lines, cultural features, basic site contents, and locations of all documented artifacts. Use of digital maps zoomed in to show the site is not acceptable when the details of the maps are pixelated and no longer identifiable.
While it is not necessary to map all artifacts, indicate areas of artifact concentration. When GPS technology is not available (i.e. no satellite coverage) all prehistoric cultural properties or historic material scatters shall be mapped by compass and tape or paced in meters. All historic period Euro-American standing structures and mining features, e.g., houses, barns, etc., shall be mapped in feet.
When utilizing GPS technology, note the type of equipment and level of accuracy employed.
• The Contractor shall obtain Smithsonian site numbers from the Montana SHPO for all cultural properties not previously assigned such numbers. Reclamation will review all site forms for adequacy prior to the submission to the SHPO for site numbers. Also, the Contractor is responsible for updating existing site forms for existing sites encountered and providing adequate site form updates. Reclamation will review all site form updates for adequacy prior to the submission to the SHPO.
• The Contractor shall deliver a draft report and a final report. The Contractor will recommend eligibilities, avoidance procedures, and mitigations, if necessary.
6 – Assembling Data Regarding the Paleontological Resource
Inventory The Contractor will contact the Bureau of Land Management (BLM). The BLM will provide the following to the contractor:
• Summary information related to known paleontological resources found Area of Potential Effects (APE) map, including a document with bibliographic citations that the contractor may wish to obtain for background information.
This information is not exhaustive. Perform additional research as required by Section 7-Performing the Paleontological Resource Inventory.
• GIS data of the currently mapped geologic units within the APE. These data are taken from publicly available maps in GIS format that were compiled by
BLM.
• A geodatabase with the BLM schema for recording locality data. Data can be collected on any computer, laptop, or mobile device, which the BLM will not supply. Readily available ESRI software must be downloaded including Collector and Survey123 for ArcGIS. Also, an online account will need to be https://www.nps.gov/subjects/nationalregister/upload/Photo_Policy_update_2013_05_15_508.pdf https://www.nps.gov/subjects/nationalregister/upload/Photo_Policy_update_2013_05_15_508.pdf created. More details on that after the contract is awarded.
• Periodic meetings to identify areas of difficulty and to ensure progress is being made.
Contact for the BLM:
Greg Liggett, State Office Paleontologist gliggett@blm.gov Montana/Dakotas State Office Bureau of Land Management 5001 Southgate Dr.

7 – Performing the Paleontological Resource Inventory The Contractor shall:
• Acquire DI Form 9003 Paleontology Permit and identify a designated repository to conduct the field work. Utilize BLM’s Recreation and Permit Tracking Online Reporting (RAPTOR). RaptorClient (blm.gov) Submit DI Form 9003 Paleontology Permit to the BOR for signature.
• Provide qualified personnel who have knowledge and experience in identifying and evaluating fossil resources (vertebrate, non-vertebrate, plant, and trace), particularly related to the geologic units involved.
• Provide all equipment and materials necessary to complete this project.
• Perform additional background research, including literature reviews and museum record search to understand all previous projects or collections made from the area.
• Conduct an on-the-ground survey of exposed outcrops within the APE that can be reasonably reached by any non-motorized means.
• The contractor should also keep records in an alternate system to guard against data loss. At a minimum, the contractor must record the information outlined on BLM form 8270-1, Paleontological Locality Form, except lines 6-12 may be skipped. Also, only one coordinate system should be given on the forms and that is the decimal degrees in NAD 1983 datum.
• Record details of localities identified including GPS location, site characterization, and formation or subformation unit; produce field maps if appropriate; and record field identification of taxa observed or collected. All localities must be recorded as points.
• If a locality covers a larger area, a polygon for the locality will be outlined and recorded along with the point data. The polygon data will be a separate layer.
• Photo documentation of localities and specimens should be made, as appropriate, to provide baseline information on their condition at the time of discovery. Using the BLM-supplied system, photographs can be uploaded and associated directly with the locality.
• Precision of GPS positions must be at least within 3 meters, and greater precision is desirable. Record geographic coordinates in decimal degrees to 6 decimal places using the NAD 1983 datum.
• Record non-paleontological discoveries that would be of interest to the BLM and Reclamation, e.g., trash, signs of fossil poaching, evidence of dumping of hazardous waste, https://permits.blm.gov/raptor/landing cultural resources, historic buildings, or structures, etc. Where appropriate take photographs of these to report to BLM and Reclamation.
• Contractor may at their discretion collect specimens to preserve voucher specimens documenting a locality; to preserve fossils from rare or unique taxa; or to preserve specimens in significant peril. Disturbance during such collection must not be more than a meter square of surface area. This is the limit of a survey permit authorization. Areas that would require more than a meter square ground disturbance should be recorded and reported for possible future excavations.
• All collections made must be delivered to the museum repository identified on the permit for assessment and curation if warranted.
8 – Meeting with Marias-Milk River Staff
The Contractor shall set up a time to meet with the COR and Marias-Milk River (MMR) staff to answer any questions relevant to the inventory areas at Fresno. The objectives of this site visit will be as follows:

Attachment D – Controlled Unclassified Information
Transmittal of Controlled Unclassified Information with the Bureau of Reclamation.
The Department of Interior (DOI) and the Bureau of Reclamation (Reclamation) share great concerns over the protection of our Information Technology Infrastructure and the data that Reclamation is responsible for. This includes data being transported, shipped, transmitted (i.e., emailed) or physically entering our network from an external media source. This data is referred to as Controlled Unclassified Information (CUI) and requires encryption to protect the information from unauthorized access.
The protection of external media is critical and poses one of the biggest risks to DOI for the protection of data confidentiality, integrity, and availability. External media is usually small, easy to use, connects to many systems, holds a lot of data, used in abundance, and is easily transported outside Reclamation where the potential is high for being lost or not returned to Reclamation facilities. Valuable, sensitive, or personally identifiable information (PII) data can be compromised if protection is not followed causing far reaching implications to Reclamation.
DOI has issued policies in the use of digital and non-digital media. Digital media includes, for example, diskettes, magnetic tapes, external/removable hard disk drives, flash drives (aka USB or Thumb drives), compact disks, and digital video disks or memory cards. Non-digital includes for example, paper and microfilm.
The Montana Area Office and the Bureau of Reclamation is implementing a change in the procedures regarding transport, transmission, and shipping of CUI. CUI must be placed on approved external media sources and be FIPS 140-2 Level 3 compliant or higher.
The FIPS 140 standard is used in designing, implementing, and operating cryptographic modules. A cryptographic module is the set of hardware, software, and/or firmware that implements security functions, such as algorithms and key generation. The standard also defines the methods for testing and validation of the modules.
The external media sources must also be hardware encrypted and include a pin or password for decryption and use.
Please see below for approved equipment and shipping methods.
Approved Equipment
1. The device will be a flash drive or external hard drive.
2. The device MUST have a FIPS 140-2 LEVEL 3 or higher validation and be
HARDWARE ENCRYPTED.
3. The device MUST include a password or a pin number to unlock the device.

(a) General Security Requirements:
(1) This clause addresses security requirements, including general procedural requirements, information security requirements, contractor employee suitability requirements, identification card requirements, site security requirements, vessel exclusion barriers, and information technology security requirements. Within this clause, COR means Contracting Officer's Representative. If there is no COR appointed and identified to the Contractor, the term instead will mean the Program Manager or any other authorized individual responsible for technical oversight under the contract. “Work site” means the Government facility, office, construction site, and any other area within the Government office or facility that the Contractor must access to accomplish work under this contract.
(2) The work performed under this contract shall only be accomplished by individuals (in the employment of the Contractor or any subcontractors) whose conduct and behavior is consistent with the efficiency of the Federal Service and the requirements of this contract, and who are acceptable to the contracting officer. If Reclamation finds a Contractor employee to be unsuitable or unfit for his or her assigned duties, the contracting officer will direct the Contractor to remove the individual from the contract and access to the Federal facility at which the contract activities are occurring.
(3) The Contractor’s employees governed by this contract may need access to sensitive information and/or sensitive areas. The Federal Government (Government) reserves the right, in its sole discretion, to determine suitability of Contractor personnel and deny access to any sensitive information or project specific area to any personnel for any cause.
(4) The Contractor is responsible for informing and ensuring compliance by its employees with any applicable security procedures of the Government facility where work may be performed under this contract.
(5) Any Contractor employee that will have access to a Federally-controlled facility or information system will be required to have a Government-issued identification card, consisting of a Personal Identity Verification (PIV) Card, a temporary identification card, or a visitor badge. (Note: within the Department of the Interior this card is known as a DOI Access Card.) During performance of the contract, the Contractor shall keep the COR apprised of any changes in personnel, or changes in personnel access or duration, to ensure that performance is not delayed by compliance with credentialing processes.
(6) A Contractor employee will not be provided access to a Government facility or information system until a Government PIV Card, temporary identification card, or visitor identification badge has been issued to the Contractor employee. For those individuals that will be receiving a PIV Card, the Government may, at its discretion, issue a temporary identification card or visitor identification badge after the electronic background investigation forms have been received and the investigation is initiated.
(7) All Contractor employees shall access the facility via the facility’s entry screening system and visibly display the Government-issued PIV Card, temporary identification card, or visitor identification badge at all times. Contractor employees must visibly wear the Government-issued identification card at all times they are on Government facilities. Contractor employees are responsible for the safekeeping of all Government-issued identification cards, whether on-site or off-site. Cards that have been lost, damaged, or stolen must be reported to the COR and DOI Access Sponsor immediately, but not later than within 24 hours. The Contractor shall return all identification cards and card keys and any other Government property and information upon completion of performance or when personnel depart permanently or for a period of 7 days or more. The Contractor may be required to turn in access control cards or identification cards on a daily basis.
(8) Misuse or loss of access control or identification cards, or failure to comply with required surrender of such cards may, at Government discretion, result in Contractor personnel being denied access to the work site, at no cost to Government. The Contractor may be charged up to $500 for each occurrence for any required replacement of Government- issued access control or identification cards due to loss or misuse. At the end of contract performance, or when a Contractor employee is no longer working under this contract, the Contractor shall ensure that all access control and identification cards are returned to the COR.
(9) All Contractor personnel, including subcontractor personnel, with access to the work site shall be U.S.

citizens working under this contract, irrespective of length of time working on the contract, the Contractor shall provide to the COR, legible and valid copies of the individual’s passport and visa (unless individual is on the Visa Waiver Program) a minimum of 14 calendar days prior to beginning work or arriving at the facility. A driver’s license is not acceptable identification. In addition, a completed form I-94 shall be submitted to the COR upon the individual’s arrival at the work facility and prior to beginning work.
(10) The Contractor shall report all contacts with entities, individuals, and counsel/representatives
(including foreign entities and foreign nationals) who seek in any way to obtain unauthorized access to sensitive information or areas. The Contractor shall report any violations of contract provisions, laws, executive orders, regulations, and guidance to the contracting officer. The Contractor shall report any information raising a doubt as to whether an individual’s eligibility for continued employment or access to sensitive information is consistent with the interests of National Security and the Public Trust.
(11) Unsanctioned, negligent, or willful inappropriate action on the part of the Contractor (or its employees) may result in termination of the contract or removal of some Contractor employees from Reclamation facilities at no cost to the Government. These actions include, but are not limited to, exploration of a sensitive system and/or information, introduction of unauthorized and/or malicious software, inappropriate release of sensitive information, or failure to follow prescribed access control policies and/or security procedures. Failure to comply with Reclamation policies, procedures, or other published security requirements may result in termination of the contract or removal of some contracted employees from Reclamation buildings and/or facilities at no cost to the Government.
(12) All provisions of this clause shall equally apply to all subcontractors. The Contractor shall incorporate the substance of this clause in all subcontracts.
(13) These security requirements apply to all sections of this Contract including Contract Drawings and other Contract Specifications as applicable.
