10. Other Facts: As a result of the approval of this J&A on 14 February 2019, the current bridge contract, W911S6-19-C-0004, was executed and expires on 23 March 2020. The J&A included a 3-month option period to extend performance through 23 June 2020. The projected award date was April 2020 with phase-in through June 2020 and full performance beginning 24 June 2020. However, the customer has advised that award and transition of contracts during this timeframe does not comply with the Army Test and Evaluation Command (ATEC) Office of the Secretary of Defense (OSD) budgeting/funding model which is weighted toward second quarter fiscal year obligations and sweeping funds in the third and fourth quarters. WDTC testing operations starts in earnest during the second quarter of the fiscal year and is in peak demand during the third and fourth quarters. In addition, the awardee, including subcontractors and suppliers, would need to acquire an International Traffic in Arms Regulations (ITARS) license from the U.S. Department of State before full performance.
The ITARS license process takes three to four months for which the awardee’s application must have the new contract number. Consequently, an application processing time window, prior to testing support operations, would be in the first quarter of the fiscal year. A contractor without an ITARS license would severely degrade the mission capability of DPG and ATEC due to the inability to perform essential functions authorized by the license. The initial anticipated award date of April 2020 falls short in being aligned with the customer‘s desired optimal time table. The revised anticipated award date of October 2020 with the phase-in beginning in December 2020 and full performance on 24 February 2021 meets the timelines for ITARS license application and budgeting/funding requirements. Therefore, pursuant to AFARS 5106.303-2- 90(a)(3), the original justification has to be amended to provide for an 11-month option period instead of the current 3-month option period to align the award with the customer’s needs.
