If the Proposer fails to take appropriate and timely action to defend its claims of confidentiality, the Department may release the materials that are responsive to the demand, without redaction, to the requestor.
RFP-9
The Department is not obligated to agree with the Proposer’s claim(s) of confidentiality, and by submitting a Proposal, the Proposer agrees to indemnify, protect, defend, and hold harmless the Department from any and all claims, liabilities, damages, losses and costs, including, but not limited to, reasonable attorneys’ fees, arising from or relating to the Proposer’s determination that the redacted portions of its Proposal are confidential or otherwise protected from public inspection or disclosure. The maximum Proposal Score achievable by a Proposer for this RFP is one hundred (100) points.
27.1 Technical Proposal (Part I)
A Technical Review Committee (“TRC”) will be established to review and evaluate each Technical Proposal submitted in response to this RFP. The TRC will be comprised of at least three (3) persons who collectively have experience and knowledge in the program area(s) and service requirements for the commodities and/or contractual services sought under this RFP. The TRC members are each authorized to consult with subject matter experts for the purpose of gathering information, if needed.
The Procurement Officer will distribute to each member of the TRC a copy of each Proposer’s Technical Proposal (Part I) only. No cost information will be shared with the TRC. Each TRC member will independently evaluate each Proposer’s Technical Proposal using the criteria established in this RFP.
The maximum number of points available for each section is described below:
Technical Proposal Section
Section Description Available Points
1 Executive Summary No Point Value
2 Proposer Profile 10
3 Key Personnel and Staffing 15
4 Proposer’s Experience 15
5 Project Approach 15
6 Claims Processing 15
7 Consulting Services and Additional Services
TOTAL AVAILABLE POINTS 85
The Procurement Officer will add the scores from each TRC member for the Proposer’s Technical Proposal and divide the total by the number of TRC members to determine the Proposer’s Technical Proposal Score. The maximum Technical Proposal Score achievable by a Proposer for this RFP is eighty-five (85) points.
27.2 Cost Proposal (Part II)
The maximum Cost Proposal Score achievable by a Proposer is fifteen (15) points. The Proposer’s Cost Proposal Score will be calculated by the Procurement Officer using the formula below. (X/N) x 15 = Z
Where:
X = The Lowest Commission Percentage.
N = The percentage indicated in the Proposer’s “Commission Percentage” field of Exhibit “B” of the Proposer’s Cost Proposal.
Z = Proposer’s Cost Proposal Score
27.3 Forms (Part II)

The Department’s intended decision will be posted on the Florida Vendor Information Portal at https://vendor.myfloridamarketplace.com/ on the date specified in the Timeline (as may be modified by any subsequent Addenda).
If two (2) or more Proposers receive the highest Proposal Score as described in this RFP (“Equal Proposers”), then the Department will, using the information submitted by the Equal Proposers in Form 5 (Award Preferences Form), award the Contract to one (1) of the Equal Proposers in accordance with the applicable statutory award preference criteria described in Chapters 287 and 295, Florida Statutes.
A Proposer who fails to submit a completed Form 5 with its Proposal will be considered to have no award preference.
If no Equal Proposer has an award preference, then the Contract will be awarded to the Equal Proposer with the highest Technical Proposal Score.
