About this file

The document is an Invitation to Bid (ITB) issued by the Florida Department of Transportation (FDOT), District One, seeking the purchase of mitigation credits to offset wetland impacts for State Road (SR) 31 from SR 80 to SR 78 in the South Florida Water Management District's Regulatory Tidal Caloosahatchee Basin. The project, identified by Financial Project Number 441942-2, requires the procurement of mitigation credits for three wetland types: Saltwater Forested (1.13 credits), Freshwater Forested (7.08 credits), and Freshwater Herbaceous (5.35 credits). The bid is due on May 29, 2025, at 9:00 AM, with a public bid opening at 11:00 AM and an intended award posting at 2:00 PM on the same day. This is a 24-month term contract with no guaranteed quantity of mitigation credits to be purchased.

The bid solicits mitigation credits from vendors who directly own or control the credits and can provide both state and federal credits. Vendors must possess valid state and/or federal mitigation banking permits, with credits acceptable to regulatory agencies like the South Florida Water Management District, Florida Department of Environmental Protection, and U.S. Army Corps of Engineers. The Department will purchase credits from the lowest bidder or combination of bidders to meet project needs, with the option to buy from multiple vendors if a single vendor cannot provide all required credits. Pricing will be evaluated per credit based on the Uniform Mitigation Assessment Method (UMAM), with vendors required to provide current credit ledgers and permits. The contract includes provisions for reserving excess credits for future FDOT projects and requires vendors to maintain updated regulatory ledgers.

EQUAL OPPORTUNITY OFFICE

DBE Utilization The Department began its DBE race neutral program January 1, 2000. Contract specific goals are not placed on Federal/State contracts; however, the Department has an overall 10.65% DBE goal it must achieve. In order to assist contractors in determining their DBE commitment level, the Department has reviewed the estimates for this letting.

As you prepare your bid, please monitor potential or anticipated DBE utilization for contracts. When the low bidder executes the contract with the Department, information will be requested of the contractor’s DBE participation for the project. While the utilization is not mandatory in order to be awarded the project, continuing utilization of DBE firms on contracts supports the success of Florida’s DBE Program, and supports contractors’ Equal Employment Opportunity and DBE Affirmative Action Programs.

Any project listed as 0% DBE availability does not mean that a DBE may not be used on that project. A 0% DBE availability may have been established due to any of the following reasons: limited identified subcontracting opportunities, minimal contract days, and/or small contract dollar amount. Contractors are encouraged to identify any opportunities to subcontract to DBE’s.

Please contact the Equal Opportunity Office at (850) 414-4747 if you have any questions regarding this information.

DBE Reporting If you are the prime contractor on a project, enter your DBE participation in the Equal Opportunity Compliance system prior to the pre-construction or pre-work conference for all federal and state funded projects. This will not become a mandatory part of the contract. It will assist the Department in tracking and reporting planned or estimated DBE utilization. During the contract, the prime contractor is required to report actual payments to DBE and MBE subcontractors through the web-based Equal Opportunity Compliance (EOC) system.

All DBE payments must be reported whether or not you initially planned to utilize the company. In order for our race neutral DBE Program to be successful, your cooperation is imperative. If you have any questions, please contact EOOHelp@dot.state.fl.us.

Bid Opportunity List The Federal DBE Program requires States to maintain a database of all firms that are participating or attempting to participate on FDOT-assisted contracts. The list must include all firms that bid on prime contracts or bid or quote subcontracts on FDOT-assisted projects, including both DBE’s and non-DBEs.

Please complete the Bidders Opportunity List through the Equal Opportunity Compliance system within 3 business days of submission of the bid or proposal for ALL subcontractors or sub-consultants who quoted to you for specific project for this letting. The web address to the Equal Opportunity Compliance system is: https://www.fdot.gov/equalopportunity/eoc.shtm.

For the 5% preference, the Department will apply 5% to the bid price(s) of the lowest out of state vendor whose state does not grant a preference if that vendor has submitted the lowest responsible and responsive bid. The “In-State Preference” does not apply to transportation projects that use federal funds.

8) INTENDED AWARD

As the best interest of the State may require, the right is reserved to make award(s) by individual item, group of items, all or none, or a combination thereof: on a geographical district basis and / or on a statewide basis with one or more suppliers, to reject any and all bids or waive any minor irregularity or technicality in bids received. When it is determined there is competition to the lowest responsible bidder, evaluation of other bids is not required. Bidders are cautioned to make no assumptions, unless their bid has been evaluated as being responsive. All awards made as a result of this bid shall conform to applicable Florida Statute. If the Department is confronted with identical pricing or scoring from multiple vendors, the Department shall determine the order of award using the following criteria, in the order of preference listed below (from highest priority to lowest priority):
