LIMITED-SOURCES JUSTIFICATION FOR A FEDERAL SUPPLY
SCHEDULE ORDER UNDER THE SIMPLIFIED ACQUISTION THRESHOLD
Doppler Systems Fixed Direction Finding Systems
1. Identification of the agency and the contracting activity, and specific identification of the document as a “limited-sources justification” (LSJ).
This limited-sources justification was prepared by the Federal Communications Commission, Enforcement Bureau, Equipment Development Group, located at 3600 Hiram Lithia Springs RD SW, Powder Springs, GA 30127.
2. Nature and/or description of the action being approved.
This acquisition is being conducted under the authority of the Federal Supply Schedule (FSS) Program (see 8.401) and FAR 8.405-6. This is a Limited Source Brand Name Class Justification.
This acquisition is for five (5) doppler Systems Fixed automatic direction finding systems and required accessories not requiring a statement of work. The description of required supplies is attached to this purchase request. This request is for a firm fixed price (FFP) task order for commercial products.
3. A description of the supplies and/or services required to meet the FCC’s needs
(including the estimated maximum potential value).
The vendor will supply five (5) each of the system components identified in the table below. The direction finding systems are manufactured and sold exclusively by Doppler Systems, LLC. There are no additional resellers available. See the attached document named “Doppler-DOR.docx” for a listing of part numbers.

4. This limited sources award is made under authority of FAR 8.405-6(a)(1)(i)(B)
The FCC Enforcement Bureau requires fixed automatic direction finding systems that are compatible with the Icom R8600 communications receiver. Icom R8600 communications receivers are used throughout the Enforcement Bureau’s Field Division for remote monitoring purposes. EB requires this compatibility in order to reduce training burdens on field agents.
Requiring the use of only one type of receiver accomplishes this goal. In addition to the receiver requirement, EB has set forth the below salient system characteristics required for use of this type of direction finding system in the field:

Market research conducted over the past several years indicates that Doppler Systems, LLC is the only manufacturer that produces a fixed direction finding system that utilizes the Icom R8600 receiver.
5. A determination by the Contracting Officer that the order represents the best value consistent with FAR 8.404(d).
Pricing for the Doppler Systems equipment is less expensive than systems produced by other manufacturers (That do not utilize the R8600 receiver). For example, a similar system from Rohde & Schwarz will cost more than $100,000. The Contracting Officer will evaluate the proposal, determine that pricing for the effort is fair and reasonable, and award a task order to the firm determined to represent the best value consistent with FAR 8.404(d).
6. A description of the market research conducted among GSA schedule contract holders and the results or a statement of the reason market research was not conducted.
Market research was performed to determine whether small businesses could provide the required components (shown in section 3 above) under GSA schedule. It was determined that this equipment can not be supplied under GSA schedule, but that Doppler Systems itself is a small business.
7. Any other facts supporting the limited sources justification.
None.
8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.
None – only one manufacturer is capable of providing the supplies required at the level of quality required. FCC has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government, as a continuing effort within FCC. FCC uses a variety of vendors, manufacturers and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure competition.
