About this file
This is an Exemption from Competition (EFC) Request Form submitted by the Idaho Division of Purchasing (DOP) on April 22, 2025, seeking authorization to procure fleet vehicles through a non-competitive process. The requestor, Kevin Jarrett, is seeking to enter into short-term price agreements (two years) with any interested Idaho dealership that offers a fleet vehicle program and can meet state needs. Rather than conducting a formal competitive solicitation, the agency intends to work with current dealerships while simultaneously researching and developing a new solicitation methodology for future fleet vehicle procurement. The anticipated total cost for this procurement is $16,000,000.00, and the purchase is characterized as a one-time acquisition, though the underlying price agreements would be ongoing during the two-year period.
The DOP Administrator intends to approve this exemption pending legal notice, citing that competitive bidding would be impractical, unreasonable, and disadvantageous under the circumstances. The agency's justification centers on the need to maintain continuity with existing dealership relationships while conducting internal assessment of optimal procurement methods. The exemption request falls under IDAPA 38.05.01.042.05, which permits the administrator to waive competitive procurement requirements when circumstances involving special market conditions or services requiring unique contracting procedures warrant such action. The exemption will be posted for public review prior to final approval, allowing suppliers to submit relevant information supporting or contradicting the agency's claims regarding the necessity of this non-competitive approach.
