DESIGN-BUILD SCOPE OF WORK

TOILET UPGRADES, PAINTING, AND ROOF ACCESS

PHOENIX JOB CORPS CENTER

PHOENIX, ARIZONA

I. GENERAL

The work involves services for the design and construction of Building No. 2 men's and women's toilet room upgrades, Building No. 1 exterior painting, and Building No. 1 roof and mechanical equipment access at the Phoenix Job Corps Center. The extent of work is described in section IV of this scope of work.

The design-build contractor shall ensure the security of operations and storage areas to preclude all breaches of security including, but not limited to vandalism and/or theft that can impact the timely and successful completion of the work. While existing center operations will be continuing during the course of the project, the design-build contractor shall not rely on any aspect of center security to guard aspects of his operations. At no time during this construction duration, up to and including the acceptance of the substantial completion walk-through, will the Department of Labor accept requests for additional security measures. The Department of Labor shall not be held to have incurred any liability for loss of, and/or damage to, materials, tools, and equipment of the design-build contractor by contract or otherwise. The Department of Labor shall not in any way be liable or responsible for damage or loss to work due to trespass or theft.

"DB Contractor Quick Reference Checklist", Attachment 1, is a required form that identifies a simplified but not all inclusive list of issues that the design-build contractor needs to address as due diligence items during the preparation of bid documents. The JCH-814 paragraphs shown provide an initial design reference; however, reference to other sources may be required to fully address the issue.

II. DESIGN REQUIREMENTS/SPECIFIC INSTRUCTIONS A.

LEGALLY MANDATED STANDARDS

The design-build contractor will conform to:

1. Code of Federal Regulations

a. Safety and Health ................................................................................. OSHA CFR Part 926.62 NE Shap 40 CFR 61 Subpart M 40 CFR 761

C-4

Because the work may disturb painted wall surfaces, the design-build contractor shall provide the services of an independent industrial hygiene consultant to conduct representative paint sampling as necessary (in buildings erected before 1979) to determine the lead content of painted surfaces affected by the renovation. If lead paint is identified on surfaces to be disturbed by renovation activities, the design-build contractor shall include the following information in the project documents:

The locations and concentrations of lead-containing paint in areas affected by the renovation.

A requirement of the contractor to comply with the OSHA Lead Standard for Construction Industry (29 CFR 1926.62), and other environmental or occupational safety and health regulations as applicable.

A statement prohibiting scraping or sanding of lead painted surfaces. Where removal or demolition of lead painted building components is required, these building components shall be removed intact wherever possible.

A requirement that all construction debris shall be disposed of in accordance with applicable solid and hazardous waste regulations. It is anticipated that lead-painted building components will be disposed as normal construction debris.

b. Disability/Accessibility .................................................................... 28 CFR Part 36

The facility/project must be in strict conformance with the Uniform Federal Accessibility Standards (UFAS) or the American with Disability Act - Accessibility Guidelines for Buildings and Facilities (ADAAG), whichever is more stringent. The design-build contractor shall conduct a thorough research of these guidelines and, without exception, comply to the fullest extent, including those guidelines pertaining to the visually and hearing impaired.

No deviations from these guidelines are allowed. However, if the design-build contractor, at any Design Review Submittal, demonstrates that the requirements would be technically infeasible or it would cause an undue burden as defined by the guidelines, the design-build contractor is obligated to bring this requirement to the attention of the Department of Labor for a decision on such requirements.

(These standards can be printed from the website at:

http://www.access.gpo.gov/nara/cfr/cfr-table-search.html

b. Where required for work performed outside the DOL property limits the design-build contractor shall assess and comply with the requirements of the State of Arizona, Maricopa County, the City of Phoenix, Arizona Public Service Co., Southwest Gas Company, and all applicable codes with respect to this project. Submission of plans/specification documents to Federal, State and local agencies for permitting purposes, where required, shall not be performed until the "Construction Ready" design submission has been accepted by DOL. Any and all regulatory agency comments received as a result of the agency review shall be forwarded to DOL for review and approval prior to their incorporation documents. Once approved by DOL, the necessary work to bring the documents into compliance with the comments shall be performed by the design-build contractor as part of this contract including any subsequent re-submittals that may be required.

c. The DOL may be required to seek permits as required by local utility companies prior to them rendering services to the project during construction. It is required that the design-build contractor will need to assess and comply with the requirements of Arizona Public Service Co., Southwest Gas Company, and all applicable codes with respect to this project. Written authorization is required from the Department of Labor prior to communications.

C-6

d. The design-build contractor shall provide a fixed price to obtain the permits.

(e.g. site problems, existing obstructions or proposed utilities, proposed contract time for construction, omissions, discrepancies, known issues that have occurred at the site or with projects of similar scopes, phasing, and coordination problems that could lead to construction difficulties), design (conformance to the negotiated scope of work) and construction quality control procedures.

Unless stated otherwise, review comments and concurrence with the required submissions do not revise the scope or intent of the project and do not constitute a request for change beyond the negotiated scope of work. In the event DOL determines that any required submission is incomplete which precludes a meaningful review, or does not adhere to the scope of work, DOL will advise the design-build contractor of the shortcomings and direct the design-build contractor to revise and resubmit the plan. No time extension will be granted as a result of such action. In the event the design-build contractor believes that any review comment requires a change to the scope of agreed work, the design-build contractor shall first consult the DOL for clarification, and shall, within 10 days of receipt of the comments provide written notice to the Contracting Officer concerning the reasons why the design-build contractor believes the scope has been changed.

Following concurrence of the design documentation at the "Construction Ready" stage(s), the design-build contractor shall prepare plan sets for use during construction. All review comments shall be resolved in writing by the design-build contractor to the satisfaction of the DOL before the design-build contractor submits the final construction plans. Each plan sheet shall have its last revised date noted on the sheet and clearly marked "Approved for Construction"

In addition to the review, coordination and specification of interior building finishes, and an interior finishes/colors submittal (color board) for the men's and women's toilet upgrades is required. This submittal is required at the "Construction Ready" stages of design. One copy of the required color board shall be submitted to the DOL and one copy submitted to the Phoenix Job Corps Center.

4. Building Design

5. Equipment

C-12

The design-build contractor shall clearly differentiate equipment that is a part of the design-build contractor's responsibility from equipment that is the Government's responsibility.

In general, only "fixed" equipment will be part of the contract. DOL will provide the "movable" equipment.

6. Optional Provisions

The design-build contractor's responsibilities shall include interface activities with the City of Phoenix and any, and all, local utility or service providers (i.e. water, electric, gas, fire alarm, etc). The purpose is for planning and informational purposes (design sizing and cost estimates) and obtaining permits. The design-build contractor shall:

a. Where required by DOL, submit the required drawings and specifications to the City of Phoenix.

b. Assist the DOL in permit document preparation.

c. Obtain and pay for permit(s) and approvals from the City of Phoenix.

(1) set of the "Approved For Construction" documents and drawings shall be mailed by the design-build contractor to the Phoenix Job Corps Center.

10. Availability of Existing Documents

Site verification of the existing conditions is required. As-built documents are not available. The design-build contractor will be responsible for verification of all the dimensions and existing system types and conditions.

E. SPECIAL CONDITIONS

1. Site Verification

Site verification of the existing conditions is required. It is the responsibility of the design-build contractor to determine if existing roofs and roof structural members are adequate and capable or not of supporting the new rooftop HVAC equipment and ductwork, and that all utilities are adequate or not for installing the new rooftop HVAC equipment. The design-build contractor will be responsible for verification of all the dimensions and existing system types and conditions.

2. Acceptance of "As Is" conditions –

Prior to performing any work at or on an existing center element, the design-build contractor shall tour that element with the designated representative of the DOL for the purpose of defining the limits of his work area and establishing existing conditions. Once the DOL and the design-build contractor agree on the "As Is" conditions, the design-build contractor may take possession of that element for the purpose of performing the work after documenting "As Is" conditions by digital media and providing DOL with a copy of such digital media. He shall protect all existing items within the work limits which are not specifically part of the work in the Contract and, at the completion of his work shall restore as necessary the work area to the "As Is" condition agreed to with the DOL prior to commencement of the work. If there is concern that the work area contains damaged elements that might appear as damage caused by the prosecution of the work, the design-build contractor shall document the damage through

C-14 memo or video tape the work area and provide a copy to the center prior to commencing any work.

Once the design-build contractor accepts the work area(s) and the "As Is" conditions (item 1 above), he is responsible for protecting and insuring everything within the work area against damage and harm. Only when the DOL executes a substantial completion certificate for the work completed in a specific work area will the design-build contractor be relieved of responsibility for the protection of that work area.
