DOL111RP21271 0001 6/24/2011 3:02:16 PM

ANSWERS TO QUESTIONS FROM INDUSTRY:

1. Questions related to delivery of proposal.

In section 52.212-1 (Instructions to Offerors), it states that one paper copy and one digital copy of the proposal should be submitted via courier. Then further under section 52.212-1 (B. File Packaging) it states that all completed proposals will be submitted electronically to the email address fowler.christian@dol.gov. Finally, under I. (Delivery of Offers), it states only electronic copies will be accepted by email.

Can you please confirm that delivery of the proposal is only to be done electronically to fowler.christian@dol.gov?

Can you please indicate if each Volume is to be a separate electronic file or if the entire proposal should be included in one PDF file?

Is a separate digital copy required outside of the email?

1. Answer

-Yes, Only electronic delivery should be submitted to Mr. Christian Fowler at fowler.christian@dol.gov

-Yes, Each volume shall be submitted separately (not in one PDF file) and should be numbered accordingly as instructed.

-No, There is no need to mail a separate digital copy on disc.

2. Questions related to Volume I (Technical Approach).

The Solicitation makes reference to a Quality Control Plan (QCP) but it is not included as part of the specific tasks (Part 5):

Are there specific functions required for the QCP?

Is the QCP to be included as part of Volume I or as a separate attachment?

If it is a separate attachment, is it limited in length to 3 pages?

Resumes:

Are resumes considered attachments (which are limited to a total of five, no more than three pages each), or are resumes outside of attachments and therefore not limited to three pages?

2. Answer

-No, There is no requirement for a Quality Control Plan. This has been removed in Amendment 0001

-No, Resumes are no longer a part of this requirement since the place of performance is outside of the Department of Labor.

3. Questions related to Volume II (Past Performance).

Past Performance Questionnaire:

Are the three completed questionnaires the only items that belong in this section?

How can the page limit only be 15 pages when each questionnaire is six pages and we are required to have three completed, bringing the total number of pages to 18 which would put us over the page limit?

Can you please clarify the page limit so all three questionnaires can be included?

Should the offeror be including any narrative related to past performance (outside of the questionnaires) in this section?

3. Answer

-These are new Past Performance questionnaires, so the total page count was off. Past Performance Questionnaires are now unlimited in page count.

4. Questions related to Volume III (Subcontracting Plan).

Percentage of funding to Small Businesses:

What if the offeror cannot allocate at least 60% of the contract value to small businesses due to there not being viable small businesses that can conduct the required scope of work based on the specifications of the Solicitation?

4. Answer

-The Offeror shall project the allocation requested by the Department of Labor and continue to strive each year to reach the goals required by DOL.

5. Questions related to Volume IV (Price).

Minimum and Maximum Quantities:

Section 52.216-22 (Indefinite Quantity), section (b), references that a designated minimum and maximum quantity will be included in the Schedule (Section B-1, Price/Cost Schedule), and states that "The Government shall order at least the quantity of supplies or services designated in the Schedule as the minimum." However, the Schedule only references 2,000 CP2s as an estimated quantity. There are no minimum or maximum quantities provided.

What is the minimum quantity of supplies the Government shall order?

The minimum quantity for supplies or services shall not exceed the cost amount of $2,500.

What is the maximum quantity of supplies the Government shall order?

The minimum quantity for supplies or services shall not exceed the cost amount of $3,897,309.34.

Please refer to Clause 52.216-19 –Order Limitations (Oct 1995)

Form Pages for Budget:

Are SF 1449 (Schedule of Supplies/Services), Section B-1 (Price/Cost Schedule) Base Year, Schedule B-1 (Price/Cost Schedule) Option Year 1, Schedule B-1 (Price/Cost Schedule) Option Year 2, Schedule B-1 (Price/Cost Schedule) Option Year 3, and Schedule B-1 (Price/Cost Schedule) Option Year 4 the only forms required to be submitted in Volume IV?

Yes

Are any other supporting materials required as documentation for the Schedule of Supplies/Services and Price/Cost Schedule other than the above referenced forms?

No

6. Questions related to Volume V (Solicitation, Offer and Award Documents, Certifications/Representations).

Forms needed:

Section 52.212-3 (Offeror Representations and Certifications), states that an offeror shall complete only paragraphs (b) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bnp.gov. However, it is unclear under paragraph (b) (1) and (b) (2) what is required.

Does the offeror simply need to copy the language under (b) (2) on a piece of letterhead and certify it is accurate?

No. Please fill out the sections in the clause that should be filled out.

What are the specific requirements of paragraphs b in this section?

Please refer to 52.212-3

If the offeror is up to date on ORCA, what other forms are required to be submitted?

Only what is required.

Volume V's instructions also say that the SF 1449 needs to be signed and submitted.

Is SF 1449 to be included in both Volume IV and Volume V?

No, SF1449 should only be in Volume V. Price, Volume IV, is its on volume.

7. Question: Would the DOL want access to the data base or is it only intended as a storage option?

7. Answer

- The database will act as a repository for employment contract/subcontract contractual relationship that our claims examiners would need daily access to for claims adjudication purposes.

a) Basis for Award. The Government will award a single Indefinite Delivery/ Indefinite Quantity Contract from this solicitation to the responsible offeror whose offer conforming to the solicitation is most advantageous to the Government based on the best overall proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the four evaluation factors: {Technical, Past Performance, Subcontracting Plan, and Price}. Factor I, Technical is significantly more important than Factor II, Past Performance and Factor III, Subcontracting Plan. All sub factors under Factor I, Technical are of equal importance. The Contracting Officer shall also conduct a price analysis in accordance with the techniques in FAR 15.404-1(b) (2). The non-Price factors combined are significantly more important than Factor IV, Price.

However, price will become significantly more important as non-price factors approach equality. Offerors are cautioned that the award may not necessarily be made to the lowest price offered. The Government is more concerned with obtaining superior technical features than with making an award at the lowest overall price to the Government. However, the Government will not make an award at a significantly higher overall price to the Government to achieve slightly superior technical features. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for Factor I, and its associated sub-factors (Understanding of Requirement, Key Personnel, Corporate Experience, Phase In and Phase-out Plan, Quality Control Plan, and Project Management Plan). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
