Text3: The United States Fish and Wildlife Service (USFWS) has a request for A-E Construction Management Services for the repair of the existing Hanalei River intake. The project involves installation of micro-piles and grouted riprap armoring to repair erosion and bank scour damage around the existing intake structure at the Refuge. KPFF developed a design to provide the intake repairs and issued construction documents for the project on January 15, 2020. This scope of work is to provide construction support services for the construction of the design presented in this final drawing set. These services will include construction management and site visits (observation), geotechnical field support during construction, additional archaeological oversight and development of final as-built construction documents.
Text4: Due to the complex and specialized nature of the design, KPFF is the only firm available to provide construction management services for their own designs. This approach is in the best interest of the Government for several reasons. Awarding the order to KPFF eliminates the requirement for site visits by another AE firm and would avoid duplication of efforts.
During construction, the construction contractor may discover design deficiencies or request for design clarifications. Under normal circumstances, deficiencies and clarifications are attributable to the Engineer of Record. If awarding to a firm other than KPFF, the other A-E would be required to coordinate with KPFF to complete the CM; therefore, the CO would have to determine if the deficiency or clarification was attributable to KPFF, the other firm or both. This would cause longer delays since extra steps could be needed to resolve the deficiency.
A different firm would be unfamiliar with the plans and specifications; therefore, they would incur higher risks when pricing design services. As an example, they would not know what submittals would be required because they did not create the submittal register. In addition, if design issues were to arise during the course of construction, the firm would have to reach out to KPFF for support in resolving the issues.
A review of the industry code of ethics indicates that professional engineering organizations prohibit others from assuming the role of Engineer of Record for designs performed by others, without first notifying the design engineer. Article III, Section 7, paragraph a. of the National Society of Professional Engineers (NSPE) Code of Ethics for Engineers states:
Engineers in private practice shall not review the work of another engineer for the same client, except with the knowledge of such engineer, or unless the connection of such engineer with the work has been terminated.
The purpose of these procedures is to provide an engineer, whose design is being reviewed by another engineer, an opportunity to provide comments or explanations for technical decisions. This will allow the reviewing engineer to have the benefit of a fuller understanding of the technical considerations in the original design, in framing comments or suggestions for the benefit of the client. This provision of the NSPE Code suggests the owner-client benefits by retaining the original design engineer as the Engineer of Record due to the familiarity / knowledge of the design.
Text5: A notice of intent to sole source was posted to beta.sam.gov for 15 days. No sources responded.
Text6: The contracting officer determines that the anticipated price/cost will be fair and reasonable based on price analysis in accordance with FAR 15.404-1(b)(2)(ii). The price paid for these services is expected to continue at the same rates provided under KPFF's existing IDIQ with FWS. The labor and escalation rates were found to be fair and reasonable at the time of IDIQ award and have been utilized on many awarded task orders.
Text7: Market research was not conduced. KPFF is the only responsible source that is able to provide construction management services to the level that is required. As the drafter, KPFF has intricate knowledge of the plans and specifications that would not be available from any other vendor.
Text8: As previously cited from a review of the industry code of ethics indicating professional engineering organizations prohibiting others from assuming the role of Engineer of Record [Article III, Section 7, paragraph a. of the National Society of Professional Engineers (NSPE) Code of Ethics for Engineers].
Due to this code of ethics requirement another A-E firm would need to fully develop their own set of construction documents. The cost for this effort would be equal to the funds already spent under contract with KPFF for the development of the existing contract documents. These A-E services for the Hanalei NWR – Phase 3 – Emergency Design and Permitting for Repair of Existing Intake with KPFF has a contract value of $212,287.00. In addition to the cost of development of a compete separate set of construction documents the effort would take at a minimum 4 months to complete.
Text9: No other sources submitted interest in writing.
Text10: The original A-E Services for planning and design for the Hanalei NWR – Phase 3 – Emergency Design and Permitting for Repair of Existing Intake was procured using the A-E Short Selection Process IAW FAR 36.602-5. All nine (9) of the A/E IDIQ firms originally considered the top three most qualified were; KPFF Engineering, McMillen-Jacobs (MJA) and Stantec. The firms considered for this task order were evaluated based upon the required specialized experience in civil site development work, river intake, levee rehab/repair, NEPA compliance, technical capability, past performance and capacity.
Text2: Approval is being requested for a new firm fixed price contract. This contract is for Construction Management Services for a project with existing designs completed by KPFF. The estimated value of this procurement is $97,500.00.
