Attachment 6- Solicitation Clauses Combined Synopsis/Solicitation Solicitation 36C24820Q0944

C.1 VA DIRECTIVE 1085 SMOKE-FREE POLICY

VA has announced a new national policy, Directive 1085 Smoke-Free Policy for Patients, Visitors, Contractors, Volunteers, and Vendors at VA Health Care Facilities. James A. Haley Veterans’ Hospital is changing our smoking policy in accordance with this directive to further our commitment to provide a safe and healthy environment for all. The new policy covers all smoking material, including but not limited to:

Cigarettes Cigars Pipes any other combustion of tobacco non-Federal Drug Administration (FDA) approved electronic nicotine delivery systems (ENDS), including but not limited to electronic or e-cigarettes, vape pens, or e-cigars.

Beginning October 1, 2019, smoking will no longer be permitted on the VA campus for patients, visitors, contractors, volunteers, and vendors.

Patients, visitors, vendors, volunteers and contractors are strongly encouraged to leave all smoking materials at home. To reduce the risk of ignition near oxygen or other flammable gases used in our facility, some areas may require materials to be stored during their visit.

At this time, the new policy does not cover employees; however, one is being negotiated nationally. JAHVH continues to offer tobacco treatment services for employees interested in quitting smoking. If you would like more information about tobacco treatment, please contact Dr. Rachel Williams, Employee Occupational Health Coordinator, at Rachel.Williams5@va.gov or x7628.

Our local policy (HPM 0018) is being revised to comply with the new directive. If you have any questions not addressed in the attached Q&As, please direct them to VHATAMSmokeFree@va.gov. More information on the directive is available at https://www.vapulse.net/community/smoke-free-va.

Q&As – Smoke-Free at JAHVH

How will this affect employees?

At this time, the new policy does not cover employees; however, one is being negotiated at the national level. In the meantime, JAHVH offers tobacco treatment services for employees interested in quitting smoking. If you would like more information about tobacco treatment that is offered free of charge to all employees, please contact Dr. Rachel Williams, Employee Occupational Health Coordinator, at Rachel.Williams5@va.gov or x7628.

How will this policy affect inpatients such as Spinal Cord Injured inpatients, Domiciliary and Community Living Center residents?

Attachment D – Solicitations Clauses Combined Synopsis/Solicitation Solicitation 36C24820Q0944

Evidence-based smoking and tobacco use cessation care, to include counseling and medications, has been and will be made available as part of routine care to all Veterans to help them adapt to this change. Smoking is the number-one preventable cause of morbidity and premature mortality worldwide. Studies also show that the harmful effects of smoking are not confined solely to the smoker, but impact anyone surrounding them as well. There is no risk- free level of exposure to secondhand smoke. Finally, there is a growing body of evidence that exposure to thirdhand smoke absorbed into hair, clothes, carpeting, furniture and wallboard can be reemitted unto the air if surfaces are disturbed, posing a hazard to those who inhale thirdhand smoke particles. Simply put: It is our duty to provide a healthful environment conducive to healing. Residents will not be permitted to smoke on property. Failure to comply may result in discharge/removal from residential units.

How will the policy be enforced?

VA Police will enforce the policy with verbal reminders, violation warnings and Federal citation if needed; however, employees are also encouraged to communicate this policy with courtesy and diplomacy.

What is the plan for implementation locally?

Now through and beyond Oct. 1, the Smoke-Free Workgroup is developing plans for removal of designated smoking area signage, revision of HPM 0018, patient intake procedures, confiscation protocol, offsite policies and other pertinent matters. We will continue to communicate our progress and development leading up to and following implementation on Oct. 1. Notifications will be placed in all areas throughout the hospital.

What about offsite locations – i.e., CBOCs, the Hidden River complex, Primary Care Annex?

VHA Directive 1085 applies to "all property assigned to VHA that is under the charge and control of VA." The smoking policy at each offsite location will be addressed on a case-by-case basis with the COR at each site.

Can I smoke in my car or in the parking lot?

You may smoke in your own car as long as it is not on VA property (including the remote parking lots Liberty, Freedom, Romeo and Juliet). That said, wherever JAHVH does not have jurisdiction over adjoining streets, sidewalks, parking lots or other common areas, patients, visitors, contractors, volunteers, and vendors are strongly encouraged to comply with the spirit of the directive. It is the expectation that patients, visitors, vendors, contractors, volunteers, and staff will not loiter near neighboring properties or discard litter in a way that reflects negatively on our hospital.

Who should we contact if we have questions about the Directive?

For questions about our local policy, contact VHATAMSmokeFree@va.gov. For general inquiries about Directive 1085 and its national implementation, contact vhasmokefree@va.gov.
