Summary of Wise County Rock and Base Materials Bid #27-BID-013
This is an Invitation to Bid issued by Wise County, Texas for the purchase of rock and base materials for road construction applications. The County seeks sealed bids for various aggregates including #1 Flex Base, specialty bases, washed rock in multiple sizes, rip rap in three dimensions, chip seal rock in multiple grades and sizes, minus base materials, gabion/oversized rock, and pea gravel in various gradations. Specific product gradations and sieve analysis requirements are detailed per Texas Department of Transportation 2024 Edition Standard Specifications. Sealed bids must be received by 10:00 a.m. central time on Thursday, September 3, 2026 at the Wise County Asset Control Office, 400 W Walnut, Decatur, Texas 76234. The contract will be effective October 1, 2026 through September 30, 2027 and may be canceled by either party with 30 days written notice. Wise County reserves the right to award contracts individually by respective Commissioners as ex officio Precinct Road and Bridge Commissioners based on bidder pricing and proximity to job sites. Because County needs are seasonal, no predetermined purchase quantities are guaranteed, and all purchases will be based on actual County needs.
All pricing must remain firm for sixty-day increments with provisions for price adjustments based on documented changes in liquid asphalt costs from suppliers. Bidders must disclose all ancillary costs including freight, fuel surcharges, and overtime rates within the purchase price. Invoices will be paid on a net 30 basis with no late fees assessed. The County reserves the right to award contracts to qualified local bidders within three percent of the lowest bid and may co-award contracts. Bidders must provide vendor product names matching billing department nomenclature and plant locations for material sourcing. Bids must be submitted on unmodified County forms, originally signed, with required affidavits and price forms. Funds for this contract have been approved through the Wise County budget for fiscal year 2026-2027 (October 1, 2026 through September 30, 2027), and anticipated orders beyond the current fiscal year remain subject to budget approval. All bids become property of Wise County, and bidders must comply with Texas Government Code Section 2270.002 regarding Israel boycott certification.

Pre-coated Rock
Types and grades of Pre-coated Chip Rock Grade 3 & 4 materials hereinafter mentioned must meet specifications of the Texas Department of Transportation, 2024 Standard Specifications for Construction of Highways, Streets and Bridges. For any that fall under Item 341 and special provision 341-022, no bonuses will be considered as part of this bid. Bidders unfamiliar with such specifications may obtain copies of such specifications from the Texas Department of Transportation, District #2, Fort Worth Office or TXDOT website http://www.dot.state.tx.us/business/englspec.htm. Pre-coated rock is under the specifications for chip seal (seal coat) rock.
Types and Grades of Materials Sought:
Asphalt Coated Rock Pre-Coat Grade 3 & 4 bid under specs for chip seal (seal coat) rock.
Vendor must provide Hot-Mix designs prior to production of HMAC.
The County is seeking prices for materials loaded by the bidder's personnel and equipment and hauled by Vendor or the County's personnel and equipment or by contracted means at the County’s discretion.
In order to comply with State laws concerning competitive bidding while maintaining as much continuity as possible between the County and its contracted asphalt vendor(s), Wise County has elected to utilize a "fluctuating price" contract(s) which takes the changing market conditions into consideration over the contract period.
Pricing must remain firm for sixty (60) day increments. This specification provides for a price increase every sixty (60) days, if needed, based upon price changes the bidder receives on liquid asphalt from the supplier. All bidders desiring consideration of a price increase must supply documentation in the form of current liquid asphalt invoice copies from bidder’s supplier, showing the average cost per ton for the previous sixty (60) day period. This can result in a price increase or price reduction, depending on the current liquid asphalt price. All other factors that affect the price should be incorporated into the bid price. This price must be approved by Commissioners’ Court before it will be effective.
It is extremely important that bidders note that the geographical location of the various bidders' plants where materials may be obtained will bear heavily in the Court's consideration of bids. Thus, it is essential that each bidder's bid fully and accurately detail the locations of such bidder's facilities from which the materials are to come.
Purchase contracts may be awarded individually by respective Wise County Commissioners as the ex officio Precinct Road and Bridge Commissioner, depending on that bidder's prices and proximity to County job sites, for each of the type of rock desired.
The County is seeking prices for material loaded by the bidder's personnel and equipment and hauled by the County's personnel and equipment, or by contracted means.
Since each bidder may use a different name for the various products, the bidder must supply the name that his billing department will be using for each of the products on which he is bidding.
This will eliminate any confusion on the County's part as to what product is being purchased.

Estimated Quantities
Because Wise County's needs are seasonal in nature, it is not feasible to offer prospective bidders estimated quantities needed during the year. Wise County will in no way be bound to purchase any predetermined amounts under this contract. All purchases will be based on the county’s actual needs.
General Contract Terms and Conditions
The contract price for this service must include all ancillary costs associated with the service.
The bidder reserves the right to charge any price desired as long as it does not exceed the bid price.
All invoices will be paid on a net 30 basis. No late fees or interest charges are to be assessed against the county.
Invoices must show the address and department where the service was required and the bid number. Each department/precinct must be invoiced separately.
Invoices must be sent to:
Wise County Auditor's Office P.O. Box 899 Decatur, TX 76234 940-627-5744 asstauditor@co.wise.tx.us
Funds for payment on this contract have been provided through the Wise County budget approved by Commissioners’ Court for this fiscal year only. State of Texas statutes prohibit the obligations and expenditure of public funds beyond the fiscal year for which a budget has been approved. Therefore, anticipated orders or other obligations that may arise past the end of the current Wise County fiscal year shall be subject to budget approval. The fiscal year for the County extends from October 1st of each calendar year to September 30th of the next calendar year.
The bidder must provide pricing (unit or lump sum) as requested on the bid form. Prices quoted shall remain firm for the period of the contract and shall include the cost of installation if required in the specifications, shipping, and delivery of item to the designated point unless pickup is required and stated in the bid and shall not include Federal or State of Texas sales, excise and use taxes.
The undersigned affirms they have familiarized themselves with the local conditions under which the work is to be performed and have satisfied themselves of matters that may be incidental to the work before submitting a bid.

Acceptance of same by the Court shall create a contract between the parties based upon the instructions, terms, conditions, specifications, invitation to bid, and the bid forms. Any additional terms and conditions submitted by bidders will be considered invalid. Only terms and conditions listed in the Wise County bid documents apply. Any changes to Wise County terms and conditions may result in disqualification of the bid.
Award notice will include information on form 1295 disclosure that must be completed and returned prior to any bid award being considered final, contract being signed by Wise County, any Purchase Order being issued by Wise County, or any notice to proceed with work being issued by Wise County. Continuing non-performance of the vendor in terms of specifications shall be basis for termination of the contract by Wise County. Wise County shall not pay for work, equipment, or supplies that are unsatisfactory. Vendors will be given a reasonable opportunity before termination to correct the deficiencies. However, this shall in no way be construed as negating the basis for non-performance termination.
