5. Project Special Provisions

The following are additions or revisions to the Public Works Standards, Construction Standard Specifications

Section. Except as described below, the Public Works Standards remain in full force and effect.

5.1 SP-1 Section 103.09 Permits

103.09 PERMITS

Add the following section to 103.09

At a minimum, the contractor will be required to secure a City of Gresham Right-of-Way Permit.

5.2 SP-2 Section 106.01 Contractors Construction Schedule

106.01 CONTRACTORS CONSTRUCTION SCHEDULE

Replace 106.01 (A) with the following:

A. Contractor shall submit a proposed construction schedule to the Project Manager at or before the preconstruction conference. The Contractor shall not commence work until the construction schedule is approved by the Project Manager and the Project Manager has issued Notice to Proceed. Contractor shall submit progress schedules a minimum of two weeks ahead of construction which include the order in which work will proceed.

Add the following section 106.01(D):

D. Once the Contractor begins work on a specific street, he shall not de-mobilize and shall provide adequate labor, materials, and equipment for the vigorous and continuous performance of the work without delay or undue burden to residents until the project work is complete – including utility adjustments.

5.3 SP-3 Section 106.02 Preconstruction Conference

106.02 PRECONSTRUCTION SCHEDULE

Add the following to section 106.02:

The Contractor shall provide the following for the Project Manager\'s approval prior to or at the preconstruction conference:

Preliminary work schedule

Traffic control plans

24-hour notice

Emergency contact lists, including sub-contractors

Material submittals

City\'s Project Manager may not issue Notice to Proceed if any of these documnets are not submitted and approved.

5.4 SP-4 Section 106.04 Notice to Proceed

106.04 NOTICE TO PROCEED

Replace section 106.04 A. (1) with the following:

(1) Unless stated otherwise in the Special Provisions, upon approval of the required document submittals outlined in section 106.02, written Notice to Proceed will be given by the Project Manager within 30-days of the date of the Contract. Do not commence work under the Contract until such written notice has been given.

Notify the Project Manager forty-eight (48) hours in advance of the time and place work will be started.

5.5 SP-5 Contract Time

106.05 CONTRACT TIME

Add section 106.05 (C) and (D):

C. Upon Project Manager issuing Notice to Proceed and after all other utility work currently underway is complete, construction may start after July 7th, 2026. Contractor shall adjust scheduling at no cost to the City if needed to accommodate work underway.

D. All construction is to be completed no later than October 2nd, 2026.

5.6 SP-6 Section 106.08 Contract Incentive and Liquidated Damages

106.08 CONTRACT INCENTIVE AND LIQUIDATED DAMAGES

Add section 106.08 (E) and (F):

E. Pursuant to PWS Subsection 106.08(B), the genuine pre-estimation of the damages expected because of a delay in the completion of this project is $1,500 per calendar day. These liquidated damages apply to any deadline specified in 106.05(C), (D) and (E) above. Section 106.08(D) remains in full force.

F. Contractor shall not work on arterial streets beyond the approved work hour limits outlined in the approved Traffic Control Plan for such work. Work beyond approved work hours on arterial streets will cause the City to sustain damages; increase risk to, inconvenience, and interfere with the traveling public and commerce; and increase costs to taxpayers. Because the City finds it is unduly burdensome and difficult to demonstrate the exact dollar value of such damages, and because the City believes the required work on arterials can be accomplished within the approved work hours and the Contractor working beyond approved work hours demonstrates insufficient planning and management of the work, the Contractor agrees to pay to the City, not as a penalty but as liquidated damages, $450.00 per hour for each hour an arterial is not opened to traffic per the approved Traffic Control Plan. Section 106.08(D) remains in full force.

5.7 SP-7 Section 107.06 Survey Services

107.06 SURVEY SERVICES

The Contractor shall provide the preconstruction and construction staking required to replace each street’s wearing surface at its original grade and cross-section. Contractor shall match driveways and sidewalk ramps with paving and adjust utilities as required for a smooth finished product that meets the requirements of

605.03.20 of the GPWS. This work is considered incidental to the project and no additional payment shall be considered.

5.8 SP-8 Section 202 Traffic Control

202.03.01 GENERAL

Add the following to 202.03.01:

Contractor shall be responsible for placing ‘No Parking’ signs on streets to be resurfaced where parking is normally allowed a minimum of 48 hours before actual construction. Temporary ‘No Parking’ signs shall name the type of work, dates / times the parking restrictions are to be in effect, Contractor’s name and the phone number where more information can be found. Contractor shall provide and mount such signs on a suitable mount (e.g., type II barricade). Signs shall be placed on both sides of street approximately 100 feet apart, but at least three per block per side. Contractor shall provide photo documentation of the No Parking signs posted on each project street, at the time of placement, which includes a date / time stamp. Signs shall remain in place until resurfacing is complete. Closure time listed on ‘No Parking’ signs shall begin one hour before construction is to begin to allow for City’s code enforcement officers to contact owners of cars and to tow in cases where the owner could not be located. The parking prohibition shall be in force when access to the street surface is required, unless otherwise approved by the Project Manager.

202.03.02 TRAFFIC LANE AND SIDEWALK RESTRICTION REQUIREMENTS

Replace the following paragraph:

Do not close any traffic lanes Monday through Friday between 4:00 p.m. and 8:00 a.m. the following day unless otherwise explicitly approved by the Engineer on the traffic control plan. 2. DISCRIMINATION BECAUSE OF RELIGIOUS BELIEF

With respect to terms and conditions of employment and hiring only, the Contractor shall be deemed to have complied with the general obligation of according equal opportunity without regard to religion if every reasonable effort has been made to accommodate the particular religious beliefs or practices of an employee or applicant for employment, but such accommodation cannot be made without undue hardship to the employer.

3. DISCRIMINATION BECAUSE OF SEX

With respect to terms and conditions of employment and hiring only, the Contractor shall be deemed to have complied with the general obligation of according equal opportunity notwithstanding any rule, standard, practice, or decision which accords an employee or applicant different treatment because of sex, if such rule, standard, practice, or decision is based upon a bona fide occupational qualification which the employer cannot, without undue hardship, modify or waive to accommodate the employee or applicant.

With respect to public services, facilities, and accommodations the Contractor shall be deemed to have complied with the general obligation of according equal opportunity notwithstanding any rule, standard, practice, or decision which restricts or limits access to such on a basis of sex where:

A. Physical facilities such as restrooms, bathing facilities, dressing rooms, etc. must be segregated on the basis of sex to accord personal privacy or comply with local, state, or federal law, or ordinance, or administrative regulation; or

B. The content or subject matter of a program or service is clearly of benefit to persons of a particular sex only because it deals with medical, psychological, or sociological factors inherently linked to the characteristics of one sex only, or its effectiveness in providing benefit to persons of one sex would be unreasonably and adversely affected by the participation of persons of the opposite sex.

4. DISCRIMINATION BECAUSE OF DISABILITY

With respect to terms and conditions of employment and hiring only, the Contractor shall be deemed to have complied with the general obligation of according equal opportunity to persons who are physically or mentally disabled if every reasonable effort has been made to accommodate any physical or mental disabilities of an employee or applicant, but such accommodations cannot be made without undue hardship to the employer; or where, because of such disability, the employee or applicant cannot meet a bona fide occupational qualification that cannot be waived or modified without undue hardship to the employer.

With respect to public services, facilities and accommodations only, the Contractor shall be deemed to have complied with the general obligation of according equal opportunity to persons who are physically or mentally disabled where:

C. The purpose of the program, service, or facility is to provide a special benefit to persons characterized by a particular handicap in some respect specially related to the educational, medical, psychological, mobility, social or economic needs of persons so disabled.

5. DISCRIMINATION BECAUSE OF AGE

With respect to terms and conditions of employment and hiring only, the Contractor shall be deemed to have complied with the general obligation of according equal opportunity regardless of age where:

A. Certain positions include duties which must, by law or ordinance, be performed by persons over a certain age, and the employer cannot accommodate the employment of a person under that minimum age without undue hardship;

B. The employee or applicant has passed any applicable age established by the Congress of the United

States beyond which an employer may reject an employment application or mandate an employee\'s retirement.

With respect to public services, facilities, and accommodations only, the Contractor shall be deemed to have complied with the general obligation of according equal opportunity without regard to age where:

A. The purpose of the service, facility, or accommodation is to benefit or serve persons under 18 years of age or their adult custodians in some respect specially related to the needs of such persons; or

B. The purpose of the service, facility, or accommodation is to benefit or serve persons 65 years of age or older in some respect specially related to the educational, medical, psychological, mobility, social, or economic needs common to persons of that age group.

6. DEFINITIONS

As used in this Policy, there are several terms specifically defined in various federal, state, and local laws, ordinances, and administrative regulations applicable either because of the City\'s receipt of federal or state funds, or because they are general laws and ordinances prohibiting discrimination. In addition, judicial and administrative decisions have created an additional body of law further defining these terms in their application. Because of the magnitude and complexity of these various legal definitions and interpretations, it is not possible to provide exhaustive definitions herein. The Contractor should be guided by the following general rules:

A. Where two separate legal definitions or interpretations may apply in a given situation, the one according the greatest degree of protection to the person entitled to their protection shall govern.

B. "Disability" and "handicap" are intended to be synonymous.

C. The Contractor is entitled to advisory opinions as to the specific application of this policy from the designated representative of the City\'s Human Resources Department. The Contractor is entitled to rely on such advice only to the extent of the completeness and accuracy of the facts presented by the Contractor in requesting such advice. The City expressly disclaims any responsibility for the Contractor\'s reliance on advice which later proves erroneous or inapplicable because of facts not known to the City\'s representative who gave the advice.

D. The Contractor is cautioned that restrictions in deeds, leases, collective bargaining agreements, and other contracts may not in every case justify an otherwise discriminatory act, policy, or practice. The

Contractor must, at his own risk and expense, comply with this Policy regardless of contractual restrictions which do not justify Contractor\'s acts, policies, or practices.

7. ADVERTISING AND PROMOTIONAL MATERIAL

A. In all advertising, postings, and promotional material relating to hiring, the Contractor shall include the following statement:

" [Name of Contractor] is an equal opportunity employer and does not discriminate in hiring, promotion, layoff, discipline, transfer, compensation, or other terms of employment because of a person\'s race, religion, color, national origin, sex, age, marital status, handicap, or political affiliation."

9. GRIEVANCE PROCEDURE

During the term of this Contract, and for at least six months thereafter, the Contractor shall conspicuously display the attached "Notice: Your Rights to Have Discrimination Complaints Heard" in locations accessible to the public at its principal office and all other premises within the City of Gresham where it conducts any operations. Likewise the

Contractor shall fully cooperate with the designated representative of the City of Gresham and state and federal civil rights compliance agencies in investigating, mediating, and otherwise handling complaints or grievances concerning this Policy.

10. VIOLATIONS

Violation by the Contractor of any provision of this Policy may, in addition to any remedy accorded an aggrieved person, be cause for termination of the Contract, debarment from participation in future City of Gresham contracts, or both.

11. CONTRACTS DIRECTLY FUNDED BY FEDERAL OR STATE AGENCIES

If this Contract is funded in whole or in part by federal or state grants, there may be imposed on the Contractor the additional obligation of "affirmative action" to ensure equal opportunity, and specific standards and reporting requirements to be met. "Affirmative action", in general, means taking positive and affirmative steps to involve historically disadvantaged classes of persons in the performance of the work or participation in the benefits of this

Contract. These steps may include special recruitment efforts, specific goals as to percentages of such persons employed in certain jobs, specific goals as to percentages of such persons employed in certain jobs, specific standards for the amount of work to be subcontracted to minority-owned businesses, etc.
