About this file
This is a Determination & Findings (D&F) document for a sole-source procurement action at or below the SAT (Simplified Acquisition Threshold) level.
The procurement involves the modernization of a Hot-Isostatic Press (HIP) Operating Control System and supporting hardware/software for American Isostatic Presses (AIP). The contracting officer has determined that only one responsible source exists and that full and open competition is not feasible. The justification for sole-source contracting rests on three primary factors: (1) Compatibility—the existing HIP system is proprietary to AIP, operates at 2200°C and 200 MPa inert gas pressure, and requires an updated operating control system that maintains form, fit, and function with the current installation; using a non-compatible operating system poses significant safety risks, as the vessel operates at pressures equivalent to 40 pounds of TNT; (2) Proprietary Rights—the original HIP system and the new updated operating control system are exclusive proprietary technology of AIP with no viable substitutes; and (3) Experimental Continuity—maintaining consistent maximum temperature, maximum inert gas pressure, and thermal/pressure time-history capabilities is necessary for continuing densification of difficult-to-sinter ceramic materials of research interest. The contracting officer has certified that the anticipated cost is fair and reasonable and that approval is in the government's best interest. The estimated total value is redacted in the document.

DETERMINATION & FINDINGS FOR OTHER THAN FULL & OPEN COMPETITION
(ACTIONS SAT AND BELOW)
1. DESCRIPTION OF PROPOSED PROCUREMENT: Hot-Isostatic Press (HIP) Operating Control System and Supporting Hardware/Software Modernization
2. PROPOSED CONTRACTOR/MANUFACTURER: American Isostatic Presses (AIP)
3. ESTIMATED TOTAL VALUE:
4. STATUTORY AUTHORITY PERMITTING CONTRACTING WITHOUT PROVIDING FOR FULL
AND OPEN COMPETITION: The statutory authority permitting sole source is 41 USC 1901(e), implemented by FAR 13.106-1(b)(1)(i):
_X_ Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
___ Unusual and Compelling Urgency ___ Industrial Mobilization; Engineering, Developmental, or Research Capability; or Expert
Services ___ International Agreement ___ Authorized or Required by Statute ___ National Security ___ Public Interest
5. JUSTIFICATION FOR THE AUTHORITY CITED ABOVE:
The item(s) listed in section one above is available from only one source and competition is precluded for reasons indicated below. There are no substitutes available.
_X_ Compatibility: The item(s) must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Describe the equipment you have now and how the new item/service must coordinate, connect, or interface with the existing system: The current system is hot-isostatic press (HIP) whose OEM is American Isostatic Presses (AIP). This HIP is capable of maximum temperature of 2200oC and 200 MPa inert gas pressure. The system consists of a thick-walled cylindrical vessel, heating elements, associated inert gas valves/fittings and handling system, operating control system, and user interface. Overall, the operational procedures and processes of this system belong uniquely to AIP. The original operating control system is outdated and no longer supported by AIP. Their new, updated compatible Operating Control System with associated hardware upgrades is required to continue the safe operation of the HIP. Use of a noncompatible operating system can not only degrade HIP performance but bring increased danger of operating it at high-pressure/high temperature conditions. At 200 MPa and the size of the vessel, the HIP is essentially a high-pressure bomb, with the equivalent explosive energy of 40 pounds of TNT if this pressure cannot be released under controlled conditions.
_X_ Proprietary: A patent, copyright, or proprietary data limits competition. The proprietary data are described as follows: The original HIP System is proprietary technology of
