Purchase Request Number: DMPMZ13146

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, as Contracting Officer, I hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the primary statutory authority : 10 U.S.C. 2304©(1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

JUSTIFICATION

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requiring Agency:

Defense Information Systems Agency BRAC Transition Program Office P.O. Box 549, Fort Meade, MD 20755-0549

Contracting Office:

Defense Information Systems Agency (DISA) DITCO-SCOTT-PL83, Information Technology Division, DISA Facilities and Construction Section PL8324 2300 East Drive Bldg 3600 Scott AFB, IL 62225-5406

2. NATURE/DESCRIPTION OF ACTION(S):

This is a requirement requested to be awarded to BONITZ/DIRTT. The scope includes whiteboard panels (530 ea) and TV mounting kits (26 ea). This contract will acquire whiteboard panels and TV mounting kits that can be utilized and configured with the demountable walls procured from BONITZ/DIRTT Environmental Solutions through the construction contract awarded for DISA’s new facility at Fort Meade. The construction contract was awarded by the Army Corps of Engineers (USACE) to Hensel Phelps Construction Company (HPCC) (Solicitation No. W912DR-07-R-0047). The new requirement will be a Firm Fixed Price, open market award.

3. DESCRIPTION OF SUPPLIES/SERVICES:

The new headquarters for the Defense Information Systems Agency (DISA) at Fort George G. Meade, Maryland was designed to maximize flexibility and ease of configuration. After a competitive evaluation and technical assessment, DIRTT demountable partitions were used for office divisions and as the power and data spline between workstations. Currently, there are over 25,000 linear feet of DIRTT walls with Spider electrical components installed within the facility.

Bonitz is the DIRTT dealership assigned by DIRTT to the DISA account. Bonitz/DIRTT would supply components of the demountable walls for use with existing demountable walls on site, including whiteboard panels and TV mount brackets. It includes the product’s design, installation and project management associated with the product.

To maintain the current demountable product and make any changes (additions, reconfigurations, deletions) in the future, DIRTT products should be used to maintain the integrity of the design and ease of maintenance. DIRTT is the sole product that can be used in the reconfigurations of existing walls. Only DIRTT products can be connected or interchanged with the existing product base..

The existing 25,000 lineal feet of DIRTT demountable walls have a warranty of 12 years and an expected life-cycle of 20 years. The 12 year warranty would be voided if work is performed by technicians not certified by DIRTT to do this kind of work. In order to ensure that the walls live up to their expected lifespan, it is important that DISA use BONITZ/DIRTT certified technicians to make changes.

BONITZ/DIRTT have over 25,000 lineal feet of demountable walls installed within the new facility. Utilizing another demountable wall vendor would not be beneficial to the government. Using another manufacturer would create an undue burden on the government as other vendors can not replicate DIRTT’s trademarked/licensed products

4. IDENTIFICATION OF STATUTORY AUTHORITY:

10 U>S>C> 2304©(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

To maintain the current demountable product and make any changes in the future, DIRTT products should be used to maintain the integrity of the design and ease of maintenance. Only DIRTT Environmental Solutions, Inc. products can be connected or interchanged with the existing product base. DIRTT has unique connections details from frame to frame and from frame to base building; in additional the DIRTT product increment is measured down to the 1/16th of and inch. The DIRTT product is designed and reconfigured using specifying software called ICE. The ICE software must be operated by a trained and certified ICE designer. The ICE software instantly creates the product specification, renderings, and elevations and bar coding which is communicated to the machines that manufacture the product. This software allows for not only easy and quick specifications but a communication device that clearly shows the end user the result in a gaming application that can be changed on site. Also the ICE drawings are uploadable to the internet, ICE VISION, for multiple viewers to experience the interiors in order to understand the scope and scale of the project. Since the ICE software creates instant 3-d rendering, DISA is able to create virtual mock-ups to show employees and stake holders several layouts of what the workspace will look like avoiding the costly time and financial outlay that actual mock-ups require.

Due to the uniqueness of the DIRTT product: connecting and nuances; leveling; systems increments and interface with base building only certified installers and designers are authorized to install and reconfigure the DIRTT product in order to maintain the Warranty.

DIRTT holds the patent on their entire product which restricts competition.

DIRTT demountable walls were part of the proposal provided by HPCC for the construction of the new facility. The construction contract (W912DR-07-R-0047) was awarded after a competitive bid process on 29 Feb 2008. USACE awarded and managed the contract. The demountable walls were evaluated as part of the offeror’s qualifications and offerings. The specifications/requirements for the demountable walls were included in the solicitation for the construction. DIRTT met all the requirements requested by the DISA.
