QUESTION
NUMBER VENDOR QUESTION GOVERNMENT RESPONSE
1 Attachment 1 Part II: Section D
This table seems to contradict the dates in the RFP, SF 1449, Continuation Pages. Please advise which has precedence.
The period of performance has been corrected in Attachment 1 ‐ X‐Ray Screening Statement of Work ‐ Redacted to reflect a tentative start date of October 1, 2017. The unredacted SOW reflects the correct period of performance.
2 Attachment 1 Part II: Section A.2.1.1
51" height requirement can be met by removing the jacking feet and casters at time of installation. In installations where the 51" height is a critical dimension, can the portability requirement (A.2.1.15) be waived?
No. The portability requirement cannot be waived.
3 Attachment 3 5.4
Our interpretation is that you require a single CD‐ROM which contains: (a) All volumes, complete, in a single PDF; (b) each volume, complete, as a separate file, and (c) each Attachment as a separate PDF. Please confirm.
As stated, "The CD‐ROM shall include a copy of the proposal, cover to cover as submitted in hardcopy, incorporated into a single digital file. The CD‐ROM shall also include individual soft copy digital files of the required completed RFP attachments."
Your interpretation (b) is not necessary; there is no need to submit "each volume, complete, as a separate file" on the CD‐ROM. If you elect to do so, however, the Government will NOT find the proposal non‐responsive.
4 Attachment 3 5.5
You have added (b) Subcontracting Plan but the page limit remains at NTE 15 pages. We ask that the limit be increased to 22 pages double‐sided.
Page limitation increased to 25 pages double‐sided. Section 8.1, paragraph 1 changed from "...including a Business Proposal Cover Letter and completed Contract Line Item Number (CLIN) Structure (pages 4 through 8 of the SF1449)" to "...including completed Contract Line Item Number (CLIN) Structure (pages 4 through 8 of the SF1449)".
5 Attachment 3 5.5
The table concludes with the statement "The NTE does not include the Cover Letters and Executive Statements or Table of Contents."
Please clarify if this statement applies to all volumes. This appears to conflict with the instruction in 8.1.
This statement applies to all volumes. The statement has changed from "The NTE count does not include the Cover Letters and Executive Statement or Table of Contents" to "The NTE count does not include the Cover Letters and Executive Statement, Table of Contents, or RFP required attachments".
6 Attachment 3 5.1 Can we please have the phone number to use for shipping with a commercial carrier?
(703) 740‐8236
7 Attachment 3 5.4
Requires a 12‐pt font for "all charts, graphics, and illustrations." We ask that the requirement be changed to 9‐pt. Changed from "This applies to charts, graphs, illustrations and attachments, but does not apply to thumbnail images" to "This does not apply to charts, graphs, illustrations, attachments, and thumbnail images".
8 Attachment 3 6.3
The Product Specification Compliance Worksheet will be utilized after award to administer First Article Testing in accordance with FAR 52.209‐4 – First Article Testing – Government Testing. Please advise if the government will keep the first two systems or return them.
The Government will not keep the equipment used in the First Article Testing. Upon conclusion of testing, the Contractor shall arrange and cover the costs to transport the tested equipment back to the Contractor's facilities.
9 RFP Provisions and Clauses
52.225‐1, Buy American‐‐Supplies (May 2014) applies (BAA). It is likely that the manufacturing cost of the end product subject to BAA will be higher than the manufacturing cost of the end product subject to FAR 52.225‐5, Trade Agreement Act (TAA). With the removal of the Small Business Set‐aside, would the Government consider removing clause 52.225‐1 and inserting clause 52.225‐5?
No. FAR 52.225‐1 is a required clause and this acquisition does not meet any of the exceptions detailed at FAR 25.103. Further, because this is a Small Business Set‐Aside, the acquisition is exempt from FAR 25.4, from which FAR 52.225‐5 is prescribed.
CONTRACT SECTION
10 RFP Provisions and Clauses
52.209‐4, First Article Approval ‐ Government Testing (Sep 1989).
Recognizing that this solicitation requires all fielded units to be Buy America Act (BAA) compliant, will the Government accept “loaner” Trade Act compliant units for testing and evaluation that the manufacturer will pick up and replace with BAA‐compliant units for all future orders?
Yes. This is acceptable as the Government does not intend on keeping the equipment used in First Article Testing.
11 RFP Provisions and Clauses
52.209‐4, First Article Approval ‐ Government Testing (Sep 1989).
Will the Government extend the five‐day requirement for post‐ award testing of the first two systems to 30 days? If the five‐day day delivery requirement cannot be changed for the two testing units, will the Government accept “loaner” units for testing that were built under TAA, rather than BAA compliance?
The Government will not waive the 5‐day delivery requirement. The Government will accept non‐BAA compliant equipment for First Article Testing purposes.
