Items will be sold based on their appearance only. "As is" is a disclaimer of warranties or representations. "Where is" denotes that the buyer takes the item as offered for sale as found and must remove it from the point of sale, or in the case of an on-line auction from its advertised location, at the buyer’s expense.

b) ASSET IDENTIFICATION NUMBER (AIN)/ CONSOLIDATED ASSET TRACKING IDENTIFICATION NUMBER (CATS ID#): This is the asset identifier which is given to the asset at the time of seizure. This number will be provided to the contractor by the COR.

c) CONTRACTING OFFICER (CO): A person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.

d) CONTRACTING OFFICER’S REPRESENTATIVE (COR): A Government employee who provides technical direction to the contractor. The COR is designated in writing by the CO.

e) FIRM-FIXED PRICE CONTRACT LINE ITEM NUMBERS: The contract Price Schedule contains firm-fixed price line items. Only items identified in the Price Schedule are payable under this contract. The firm-fixed prices are considered payment in full for all labor, profit, overhead, G&A, fringe benefits, reports, logs, postage, printing, photographs, tools, machinery, equipment, supplies, materials, insurance, vehicles, and all other costs associated with performance of the services as specified.

3) FACILITY LOCATION & PERFORMANCE PERIOD

b) The contractor shall be fully equipped and ready to begin performance within 3 calendar days of the award date.

a) The contractor shall prepare and provide to the USMS a Sales Plan that includes:

i. Advertising and marketing strategy(ies);

vi. Registration, check out, asset pickup process, to include completion of documentation, and bid deposit collection and refund process.

5) DISPOSAL

a) The COR will provide the contractor an itemized list of all assets to be sold. The itemized list will include a minimum reserve to be met for all assets. Please note that the minimum reserve does not dictate the opening bid amount.

Advertising for Contractor Auctions

i) The contractor is required to advertise assets for sale prior to the auction.

ii) Contractor SHALL NOT DISCLOSE AIN/CATS ID# in any advertisement.

c) The USMS will provide the contractor with a photograph of each item, multiple photographs where detail of the item warrants. The contractor shall use the photographs provided to post online. A full description of each item, to include model if known, shall also be posted.

d) Viewing days shall be by appointment only. The contractor shall schedule appointments with COR review and approval.

e) The contractor shall post the Buyer’s Guide, sales terms and conditions for USMS auctions, and USMS Forfeited Property Sales Certification on the website where it can be viewed by prospective buyers.

g) The contractor shall not charge public bidders any processing fee, admission fee or any other charges or fees.

h) The contractor shall determine, with COR concurrence, the best method of bid deposit collection.

Forfeited bid deposits shall be given to the USMS at the end of the sale.

i) Items are sold “As Is, Where Is”.

j) The USMS reserves the right to remove any item from an auction at any time prior to sale and reserves the right to reject any and all bids for an item for any reason.

k) The COR will be available to approve/disapprove bids that do not meet the reserve either via e-mail or telephone.

n) The contractor shall receive and be responsible for all money collected during the auction. The USMS will not be responsible for money that is lost, stolen, received in error, designated as insufficient funds, or misapplied while in the hands of the contractor.

o) The contractor shall coordinate dates and times for pickup of items from storage location with the storage vendor.

p) Payment by winning bidders shall be received in full within five (5) calendar days of the end of the sale/auction process. All gross sales proceeds are property of the USMS and shall not be used by the contractor.

r) By using the itemized lot list provided to the COR, the contractor shall keep record of all finalized sales and send to the COR within five (5) business days of the auction.

s) The contractor shall not charge the USMS any sales fees, commissions, etc., for an asset which is not sold.
