JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH

41 USC 253(C)(6)

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Mission Support

Contracts Unit (MSCU), prepares this justification for other than full and open competition for

Department of Defense Explosives Safety Board (DDESB) approved explosives storage on behalf of Render Safe Units (RSUs), Counter IED Section (CIEDS), Critical Incident Response

Group (CIRG).

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

CIEDS requires a new award be established for the purchase of explosives storage magazines. This requires a sole source firm fixed price award. The vendor identified is

NABCO, Inc.

3. A description of the supplies or services required to meet the agency’s needs.

CIEDS has exceeded capacity on its current explosives storage magazines and is in need of expanding its available storage space. CIEDS requires the purchase of two additional explosives storage magazines. CIEDS currently possesses NABCO explosive storage magazines, but at a lesser capacity storage. The total estimated cost is $ REDACTED over the useful life of the equipment. This will allow the RSUs as well as other Render Safe personnel to fulfill its mission and properly store explosives.

4. The statutory authority permitting other than full and open competition.

The statutory authority for conducting this acquisition is 41 U.S.C. 253(c)(6). The regulatory authority is FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

NABCO, Inc. is uniquely qualified to provide these products to CIEDS based upon the distinct suitability of their product. NABCO storage vessels are the only explosives storage magazines that fit exact CIEDS’ requirements, as well as accommodate the explosives that will be stored within them. Render Safe’s mission requires storage of high explosives in close proximately to working areas and Render Safe personnel – often times, within feet.

Therefore, CIEDS requires a magazine that has the ability—in the event of an accidental detonation—to completely contain the explosion and ensure the safety of the surrounding personnel. These storage vessels are also used at Quantico by TEDAC within Laboratory

Division and are the standard product within the industry, which carries three important factors in procuring NABCO storage:

1) CIEDS/RSU already owns and operates with three NABCO magazines.

Purchasing additional NABCO vessels of the same proven design and safety standards allows CIEDS to place new magazines within a foot or less of the existing magazines with no threat of sympathetic detonation. If CIEDS cannot place the magazines within one foot of each other, CIEDS would have to spend greater amounts of money and time modifying the building to achieve the same degree of safety. This would have a negative impact on mission readiness;

2) the FBI Laboratory division TEDAC also owns two NABCO magazines. Every

FBI bomb technician is familiar with the safe operation and maintenance of NABCO magazines. Purchasing different type magazines would require additional training at a large scale; and

3) the uniformity of possessing all NABCO magazines guarantees the highest level of safety possible since they are designed to work together.

Importantly, these vessels are approved by the Department of Defense Explosives Safety

Board (DDESB) for Reduced Quantity-Distance (QD) use. DDESB has conducted testing and certification on this vessel and has deemed it safe for explosives storage.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

A Special Notice will be posted on FBO.gov.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The cost is considered fair and reasonable considering the quality product, past similar purchases, and DDESB testing and certification.

8. A description of the market research conducted and the results.

Market research conducted for these requirements consisted of first obtaining the safety requirements for the type of explosives in need of storage, and then identifying any potential vendors. These safety requirements include the ability to store up to 80 pounds of TNT or its equivalent within 15 feet of personnel, and within one foot or less of other magazines. In performing this research, and in collaboration with DDESB external testing, it was determined that there was only one vendor that can provide the requirements. This vendor is

NABCO, Inc.

9. Any other facts supporting the use of other than full and open competition.

None.

10. A listing of any sources that expressed a written interest in the acquisition.

None at time of the FBO posting.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

The FBI will continue to scan the market to identify potential sources on subsequent acquisitions.
