National Acquisitions Section Federal Supply Schedule

Limited-Sources Justification

This procurement is being conducted in accordance with the ordering procedures of Federal Acquisition Regulation (FAR) Subpart 8.4 – Federal Supply Schedules. Under FAR 8.405-6 Limiting Sources, Contracting Officers (CO) are required to document the circumstances when soliciting limited-source justification. Therefore, in accordance with FAR 8.405- 6(a)(1)(i)(a), “An urgent and compelling need exists, and following the procedures would result in unacceptable delays.”

In accordance with FAR Subpart 8.405-6(c)(2) this justification includes the following information:

1.Identification of the agency and the contracting activity –

U.S. Department of Justice, Federal Bureau of Prisons (Bureau), Central Office, Administration Division, Acquisitions Branch, National Acquisitions Section (NAS).

2. Nature and/or description of the action being approved –

This action will be issued pursuant to the terms and conditions of the General Service Administration (GSA) Federal Supply Schedule (FSS) contract. This requirement will be a Blanket Purchase Agreement (BPA) to allow the Bureau to continue receiving uninterrupted Foreign Language Translation and Interpretation services. The current BPA was competed through the GSA eBuy online procurement tool.

3. A description of supplies and services required to meet the agency’s needs – (including the estimated value) –

The Counter Terrorism Unit (CTU) has a continuing need for Foreign Language Translation and Interpretation services.

The current BPA, 15B70019FU4T50028, with Advanced Language Systems International, Inc. (ALSI), expired on June 30, 2019. The Bureau has a wide range of unique requirements for foreign language translation and interpretation services for individuals committed to its custody. These services include translation of written or oral records containing technical content, which may be academic, scientific, or legal in nature, as well as communications containing nuance, slang, colloquialism, and codes. Foreign language translation and interpretation services are considered mission critical in maintaining timely monitoring of inmate communications. The language translation requirement applies to inmates who have been identified as required monitoring.

The period of performance will be from July 01, 2019 until June 30, 2020. The estimated cost is not expected to exceed $12,000,000.00.

4. The authority and supporting rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service –

FAR 8.405-6(a)(1)(i)(a), which states, “An urgent and compelling need exists, and following the procedures would result in unacceptable delays.” The rationale for using the urgent and compelling procedure is due to unforeseen circumstances causing an urgent need for mission critical services. The incumbent vendor is able to continue to perform the services without a gap or delay. Furthermore, this delay was not caused by circumstances that were reasonably foreseeable; this BPA is necessary to ensure continuity of services.
