Federal Supply Schedule Limited Source Justification (>$650,000 and <$10,000,000)
Pursuant to the Federal Acquisition Regulation (FAR) Subsection 8 . 4 05-6 (a) ( 1) ( i) (A) and Bureau of Prisons Acquisition Policy (BPAP) Subpart 6. 304 (c) the Bureau of Prisons (Bureau) has determined that restricting consideration of schedule contractors is justified for this procurement action . This acquisition is conducted under the authority of the Multiple Award Schedule (MAS) program . The following documentation is provided for this limited source justification in accordance with FAR Subsection 8 . 405 - 6 (c) (2)
1 . Contracting Agency - U. S. Department of Justice , Federal Bureau of Prisons , Central Office , Administration Division , Acquisitions Branch , National Acquisitions & Systems Section .
This document is a Limited Source Justification .
2 . Description of Action Being Approved - Due to urgent and compelling circumstances , the procurement to be approved is a short - term , sole - source Blanket Purchase Agreement (BPA) for protective stab vests , against which field locations would place BPA calls . This would permit the Bureau to establish and implement a new , long- term BPA for a similar requirement .
The Bureau has determined , as mandated by FAR Subpart 8.405-6(c) and BPAP Subpart 6 . 304(c) , that an " urgent and compelling need exists and following the procedures would result in unacceptable delays ."
3 . Description of Supplies and Services Required to Meet the Agency ' s Needs - Inclusive of the Estimated Value- The Correctional Programs Division has a requirement to continue procuring Taurus Spike Level III stab resistant vests . The BPA currently utilized will expire on October 31 , 2014 .
The vests are needed to replace thousands of vests that are now considered to be End- of-Life (EOL) as well as to provide new emp l oyees with the protective vests . The Bureau has a requirement to extend the BPA with Armor Express from November 1 , 2014 through March 31, 2015 for a total of five months .
The new BPA is anticipated to be awarded in March 2015 and in place by April 1 , 2015 .
The estimated cost for Taurus Spike Level III stab resistant vests is $830 , 160 . 00 .
4 . Authority Cited and Supporting Rationale - This acquisition is being conducted under the statutory authority for the MAS program which are Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S . C . 251 , et seq . ) and Title 40 U. S . C. 501 , Services for Executive Agencies . In accordance with FAR 8 . 405 - 6(a) (1) (i) (A) , this justification is used because an urgent and compelling need exists , and following the procedures would result in unacceptable delays .
A sole - source BPA for Taurus Spike Level III stab resistant vests , with the period of performance of November 1 , 2014 through March 31 , 2015 , will be issued to prevent disruption and maintain safety of staff and to protect the Government ' s interest .
If vests are not available , legal recourse against the Bureau would be taken and would subject the Bureau to exorbitant administrative and litigation costs . Failing to continue to provide protective vests to staff with no viable substitution would be detrimental to the Bureau .
5 . Contracting Officer ' s Best Value Determination- The BPA and resulting BPA calls will be established in accordance with the terms and conditions of the contractor ' s GSA FSS which the GSA Contracting Officer has already determined the price to be fair and reasonable pursuant to FAR 8 . 404(d). In addition , based on a comparison of previous and current Government prices for these services , the Bureau ' s Contracting Officer has determined that the anticipated costs to the Government will be fair and reasonable and represents the best value to the Government .
6 . Market Research - At this time Armor Express is the only company capable of meeting the Bureau ' s requirement without a lag in delivery. Due to the urgent and compelling nature , time is not available to evaluate other vests to purchase . Armor Express ' Taurus Spike Level III stab resistant vests have been tested and meet the Bureau ' s requirement .
7 . Other Factors - Program Statement 5576 . 01 , National Vest Procedures , is in the final process of being released . The agency and bargaining unit (Union) have agreed that all staff assigned to High Security facilities and other select positions throughout the agency will be required to wear stab resistant vests while on duty . Accordingly , it is imperative that a BPA be avai l able which can facilitate the agency ' s needs .
r y
. This requirement is essential to staff safety and institutional security . A lapse is unacceptable . The current vest is the only one that has been satisfactorily evaluated by technical experts and approved by the Union .
8 . Statement of the Actions to Remove or Overcome any Barriers - Due to the urgency of this acquisition , no actions are available at this time which could remove competition barriers for the required vests until other products can be evaluated .
9. Contracting Officer's Certification- I hereby certify that this request for a Limited Source Justification is made in qood faith and that the supporting data and information are accurate and complete to the best of my knowledge and belief.
