SCOPE OF WORK
78th Training Division Joint Base McGuire-Dix-Lakehurst, NJ 08640
1. General: This is a non-personal service requirement. This is a requirement for SMOKE CANDLES for a military exercise. The product is used to create the smoldering city atmosphere that occurs after a nuclear blast.
1.1 DESCRIPTION OF SERVICES/INTRODUCTION: Contractor shall provide enough SMOKE CANDLES necessary to maintain the Guardian Response 18 exercise that will be conducted during April 2018 based at Muscatatuck Urban Training Center (MUTC) in Butlerville, IN.
1.2. BACKGROUND: Guardian Response is a FORSCOM training event executed by 78th Training Division during the month of April 2018. The purpose of this exercise is to certify that units are trained to conduct Defense Support Civil Activities (DSCA) functions in support of protecting the homeland.
1.3. OBJECTIVES: The SMOKE CANDLES must be delivered to Muscatatuck Urban Training Center, 4230 E. Administration Drive, Bldg. 17, Butlerville, IN 47223 to the Attention of SFC Scott Maynard, MUTC Logistics Management NCO. All SMOKE CANDLES must be received at MUTC no later than (NLT) Noon EST on 02 April 2018.
This contract requires the Contractor to provide all supervision, labor, materials, tools, equipment, and transportation required to deliver SMOKE CANDLES that are as follows:
a. a quantity of 2,208 candles;
b. able to maintain a minimum of a three (3) minute burn time;
c. able to produce a minimum of 40,000 cubic feet of smoke (i.e. Superior Signal brand candles);
d. weather resilient, as candles are used in an outdoor environment; and
e. NOT a medical threat, as candles are used by training units operating without respiratory protection in the smoked areas.
1.4 CONTRACTOR MANPOWER REPORTING (CMR). The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Department of the Army via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/, and then click on “Department of the Army CMRA” or the icon of the DoD organization that is receiving or benefitting from the contracted services.
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013. Contractors may direct questions to the help desk by clicking on “Send an email” which is located under the Help Resources ribbon on the right side of the login page of the applicable Service/Component’s CMR website.
Contractor shall submit payment request using the following method(s) as mutually agreed to by the Contractor, the Contracting Officer, the contract administration office, and the payment office, WAWF.
1.5 Availability of Funds (Apr 1984). Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
1.6 GENERAL INFORMATION
a. Government Remedies: The contracting officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items”.
b. The Contractor shall comply with local, state, and Federal Occupational safety and health requirements and provide copies of accidents, and citations to the Contracting Officer within 72 hours of occurrence within seventy-two (72) hours of occurrence.
c. The vendor will provide an invoice upon completion of each task order. The vendor will submit the invoice in (WAWF) for payment. The vendor will provide a copy of the invoice to the Government COR to validate and submit charges in (WAWF). The COR will provide the contractor with the appropriate state sales tax exemption forms for their records.
d. Quality Control: Quality control is the responsibility of the Contractor. The Contractor is responsible for the delivery of quality services/supplies to the Government (see Far 52.246-1, Contractor Inspection Requirements).
1.6.1 Quality Assurance:
a. The Government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is a Government-only document primarily focused on what the Government must do to ensure that the contractor has performed all duties in accordance with the requirements of the contract.
b. The Government shall perform inspections that will not unduly delay the work. The COR appointed to monitor contract performance will routinely inspect contractor performance during the execution of this contract. The objective of the surveillance plan is to evaluate how the Contractor is performing in key areas. The primary method of surveillance will be planned sampling. The sampling may be random or detailed to 100% as needed to ensure quality work is being performed. The inspections will be random as needed. Contract Manager: The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.
c. Contractors must ensure that all contractor products are suitably marked and that contractor participation is appropriately disclosed.
d. The Government reserves the right to seek election of remedies if any of the services do not conform to contract requirements. The Government may require the Contractor to perform the services again, in accordance with contract requirements, at no increase in contract amount. When the defects in services are not corrected by re-performance the Government may:
(1) Require the contractor to take necessary action to ensure that future performance conforms to contract requirements.
(2) Reduce the contract price to reflect the reduced value of the services performed.
e. If the Contractor fails to take prompt corrective action to ensure future performance in conformity with contract requirements, the Government may:
(1) By contract or otherwise, perform the services and charge to the contractor any cost incurred by the Government that is directly related to the performance of such service.
(2) Terminate the contract for default.
1.6.2 Federal Government Holidays: Contractor is required to perform services during the term of the contract, to include during all Federal, State, and local holidays.
1.6.3 Hours of Operation: The contractor is responsible for conducting training during the term of the contract. Contractor must be able to perform during Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must maintain an adequate work force at all times for the uninterrupted performance of all tasks defined within this statement of work when the Government facility is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the work force are essential.
1.6.4 Place of Performance: Muscatatuck Urban Training Center, IN
1.6.5 Type of Contract: Reserved.
1.6.6 Security Requirements: Some areas are restricted to personnel who have not been properly cleared by federal law enforcement. Consequently, personnel without clearances shall be provided with a U.S. Government escort during times when contractor personnel are performing work under this contract in a restricted area. To avoid unnecessary delays in the performance of service in restricted areas, the contractor shall arrange for a U.S. Government escort into those areas by coordinating a time/hour with the building/site coordinator. If the coordinator's alternate is not available, the Contractor shall coordinate with the COR. The Contractor shall notify the COR when the Contractor's personnel are unable to perform work because escort personnel are not available.
1.6.7 Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5, Post Award Orientation. The Contracting Officer, COR, and other Government personnel, as appropriate, may meet periodically with the hotel to review the hotel's performance. At these meetings, the Contracting Officer will apprise the hotel of how the government views the hotel's performance and the hotel will apprise the Government of problems, if any. Appropriate action will occur to resolve outstanding issues. Upon award of the contract, the government will host a post award meeting. Within 10 days of the award of this contract the vendor will be provide the date, time and location of the post award meeting. Progress meetings will be held at least once a year.
1.6.8 Contracting Officer Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection to contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements including Government drawings, designs and specifications; monitor Contractor’s performance and notify both the Contracting Officer and Contractor of any deficiencies; coordinate availability of Government furnished property; and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.6.9 Key Personnel: The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of the person and an alternate, who shall act for the contractor when the manager is absent, shall be designated in writing to the contracting office. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The cell number and email address of the contract manager and their alternate be provided to the government and updated as changes occur. The contract manager or alternate shall be available at all times once notification of the event kick-off. The government shall be notified immediately if there are any changes to the designated contract manager or alternate.
