Bidders are advised that the General Statutes of North Carolina, Chapter 133, requires that Contractor’s request for Engineer to consider substitution of materials, items or equipment must be submitted to the Engineer for approval or disapproval such that approval or disapproval shall be made by the Engineer prior to the opening of the bids. Where possible, three manufacturers are named. Where the Engineer is not able to name three manufacturers, as many as could be named are listed. The Engineer makes no guarantees that any particular named manufacturers will agree to provide equipment in accordance with the specifications for the project, successful Bidder must determine for himself that all proposed
00210-9 AUGUST, 2026
Instructions to Bidders RFB-USO Dismantling & Hazardous Materials Abatement Project Bid No. FY 27-01 manufacturers are willing to enter into a contractual relationship with the successful Bidder to provide equipment meeting the requirements set forth in the Contract Documents.
13.02 In an effort to assist the City and the prospective Bidders in reaching a common understanding as to which major manufacturer’s equipment are being proposed for this project by the Bidder, the ENGINEER has proposed a form entitled “Bidders’ Proposed Manufacturers for Selected Materials, Items and Equipment”. This form is included in the Bidding Documents with the separate bid forms. Bidder is required to place an “X” beside the selected item which indicates which manufacturer’s equipment he will be proposing to provide for this project. Bidders should note that the form has been developed to list only major materials, items and equipment specified along the names of those manufacturers who the ENGINEER believes can comply with the Contract requirements specified. Should any Bidder wish to have an “or equal” manufacturer considered and added to the listing, he must submit a request to substitute equipment no later than 15 days prior to the receipt of Bids. After this period, no future requests for substitution will be accepted as reviews of substitution after this date would cause delay to the project schedule.
13.03 For all other items not listed on the form entitled “Bidder’s Proposed Manufacturers for Selected Materials, Items and Equipment”, Bidder is required to refer to specifications for listing of acceptable manufacturers.
Should any Bidder wish to have an “or equal” manufacturer considered and added to the specifications, he must submit a request to substitute equipment no later than 15 days prior to the receipt of Bids. Within 15 days of the Bid date, no further requests for substitution will be accepted as reviews of substitution after this date would cause delay to the project schedule.
13.04 All additions of an “or equal” manufacturer will be made by Addendum.
13.05 Bidders are advised that no substitutions of materials, items or equipment will be considered after the bids are opened except in the case of unavailability of product or other conditions beyond the control of the successful Bidder.
13.06 All requests for substitution of materials, items, or equipment or equal or equivalent design shall be submitted to the Engineer in accordance with Article 6 of the General Conditions.
00210-10 AUGUST, 2026
Instructions to Bidders RFB-USO Dismantling & Hazardous Materials Abatement Project Bid No. FY 27-01
13.07 In accepting and evaluating bids in order to recommend award of the Contract to the Owner, Engineer makes no statement regarding the approval of manufacturer’s equipment as noted in contract specifications.
Upon execution of Contract, Contractor must comply with the Contract Documents requirements pertaining to Engineer’s approval of shop drawings.
13.08 Refer to General Conditions for conditions under which the Engineer will accept applications for substitution or “equal” items of materials or equipment during the Contract period.
ARTICLE 14 - SUBCONTRACTORS, SUPPLIERS AND OTHERS
14.01 If the Supplementary Conditions require the identity of other non-minority Subcontractors, Suppliers, individuals or entities to be submitted to Owner either before or after the date specified in paragraph 6.06.C of the General Conditions, the apparent Successful Bidder, and any other Bidder so requested, shall submit to Owner a list of all such Subcontractors, Suppliers, other individuals or entities proposed for those portions of the Work for which such identification is required. Such list shall be accompanied by an experience statement with pertinent information regarding similar projects and other evidence of qualifications for each such Subcontractor, Supplier, individual or entity if requested by Owner.
If Owner or Engineer, after due investigation, has reasonable objection to any proposed Subcontractor, Supplier, individual or entity, Owner may, before the Notice of Award is given, request the apparent Successful Bidder to submit an acceptable substitute without an increase in Bid price.
14.02 If apparent Successful Bidder declines to make any such substitution, Owner may award the Contract to the next lowest Bidder that proposes to use acceptable Subcontractors, Suppliers and other individuals or entities.
Declining to make requested substitutions will not constitute grounds for forfeiture of the Bid security of any Bidder. Any Subcontractor, Supplier, individual or entity so listed and against which Owner or Engineer makes no written objection prior to the giving of the Notice of Award will be deemed acceptable to Owner and Engineer subject to revocation of such acceptance after the Effective Date of the Agreement as provided in Paragraph 6.06 of the General Conditions.
14.03 Contractor shall not be required to employ any Subcontractor, Supplier, individual or entity against whom Contractor has reasonable objection.
