The Diplexers (SPCL-00782) are only manufactured by K&L Microwave, Inc., and they do not have any distributors or resellers in the United States. MCTSSA requires the Diplexers (SPCL-00782), Procuring a different product would add unnecessary operational, training and integration risk, as the device must work within the intended environment or the whole purpose of this project fails. The Diplexers (SPCL-00782) are the only known proven solution that meet the requirements and which the MCTSSA Team can leverage knowledgeable subject matter expertise without incurring duplicative expenses associated with operation, training and integration.
The MCTSSA Requirements Team analyzed the literature provided by the Original Equipment Manufacturer (OEM) for the Diplexers (SPCL-00782). The Team determined that the Diplexers (SPCL- 00782) are the preferred option due to MCTSSA’s available resources that are experienced with the product. Moreover, given the testing requirements, the Team concluded that procuring a different product would result in unnecessary risk of schedule delays to train the team and potential duplication in cost if the alternate product is insufficient. Additionally, the MCTSSA Contracts team has determined that the items should be procured as Sole Source because the OEM has no authorized distributors or resellers.
B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.
C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
