About this file
This is a Justification for an Exception to Fair Opportunity, Form IAW FAR 16.505(b)(2)(ii)(B), submitted by the 36th Contracting Squadron at Andersen Air Force Base, Guam. The document justifies awarding a sole-source task order to Motorola Solutions under the Tactical Communications Equipment and Services II (TacCom II) Multi-Agency Contract for Enterprise Land Mobile Radio (ELMR) system maintenance and support services at Diego Garcia. The estimated contract value is redacted. The requirement is for a firm fixed price contract covering preventative and corrective maintenance for ELMR hardware, software, and associated equipment, including radio frequency repeaters, dispatch and management systems, subscriber radios, and related infrastructure. The contract includes an initial one-year basic period with three optional one-year renewal periods and the ability to extend services up to six months under FAR 52.217-8. Services consist of recurring maintenance support (network monitoring, technical support, infrastructure repair, remote security patching, quarterly preventative maintenance inspections, equipment training, and comprehensive radio repair) and non-routine maintenance support (subscriber battery replacement, UPS battery replacement, engineering support, and emergency services).
The justification invokes FAR 16.505(b)(2)(i)(B)—the sole source exception—on grounds that Motorola is the only vendor capable of providing the required support and sustainment services due to the proprietary nature of the ELMR and ASTRO 25 system hardware, software, and firmware. The government determined that award to another source would result in substantial cost duplication, incompatibility issues, and mission risk, as no other radio manufacturer can connect with the current Motorola software in use at Diego Garcia. Market research conducted on June 25, 2025, via Sources Sought and Request for Information yielded only two vendor responses: AEG Group Inc., which indicated capability but would require licensing and partnering with Motorola as a channel partner, creating potential delays in mission-critical services; and BHPE LLC, which expressed interest but provided no capability statement. The incumbent contractor, Motorola Solutions, has provided services under Contract No. FA524020P0021 from September 2020 through September 2025. The contracting officer determined that prices would be fair and reasonable based on comparison with previous purchases and market analysis, and that implementation of this sole-source justification facilitates timely and cost-effective mission support while reducing duplication costs in spare parts and maintenance. The document includes certifications from the program manager and contracting officer affirming accuracy and completeness and notes that this justification will be made publicly available within 14 days after contract order award via the System for Award Management website.
