Intent to Sole Source Notice Department of Homeland Security

a) This is a notice of intent to conduct a procurement with other than full and open competition, under Federal Acquisition Regulation (FAR) 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements.” This is not a Request for Quotes or Proposals. No contract award will be made on the basis of responses to this notice. The purpose of this notice is to allow interested parties to assert and explain their capability to perform the work.

b) The Department of Homeland Security (DHS) currently utilizes Motorola land mobile radios across its operational components. The Science and Technology (S&T) Directorate is one DHS component. S&T has a requirement to purchase replacement Motorola land mobile radios, radio components, and support services for use at its headquarters and laboratory facilities. It is necessary to purchase additional quantities of the same type of radio that is currently in use so that:

1) Interoperability and encryption can be maintained;

2) S&T can continue to support the radios technically without substantial extra cost;

3) A second training regime will not have to be implemented for a second radio system;

4) Communication can continue on the current frequencies; and

5) Radios can continue to be used and exchanged between S&T and other DHS components.

c) For these reasons, S&T believes this requirement fits the definition of FAR 11.105(a)(1) that, “The particular brand name, product, or feature is essential to the government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.”

d) Interested parties must submit responses that demonstrate clear and convincing evidence of capability. All responses must explain why a product other than the one described in paragraph b) will satisfy the government’s requirement without posing the technical problems and creating extra cost as described in paragraph b), subsections 1), 2), 3), 4), and 5). Responses may be submitted until 5:00 PM Eastern on Tuesday, March 13, 2012.

Please direct responses and inquiries to William Mallison, contracting officer, at william.mallison@dhs.gov. No calls, please.

e) The government contemplates the award of a series of orders to Motorola under the rationale found in FAR 6.302-1, specifically that these are “unique supplies or services available from only one source or only one supplier with unique capabilities” as described in FAR 6.302-1(b)(1)(i). The government contemplates this procurement as a sole source action under FAR 6.302-1, not necessarily the more specific brand name justification criteria described in FAR 6.302-1(c).
