Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this limited source justification in accordance with FAR 8.405-6(b)(1), items peculiar to one manufacturer. The acquisition referenced herein is conducted under the authority of the Multiple Award Schedule Program.

JUSTIFICATION

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requiring Agency:

DISA

Enterprise Services Directorate (ESD)

5450 Carlisle Pike

Building 312 South, PO Box 2045

Mechanicsburg, PA 17050

Contracting Office:

DITCO

2. NATURE/DESCRIPTION OF ACTION(S):

This requirement is to issue a firm-fixed-price delivery order for brand name Microsoft Software in support of the Naval Sea Systems Command (NAVSEA) Chief Information Officer (CIO). The Microsoft software includes FAST Search Server for SharePoint 2010, SharePoint Server 2010, Forefront Threat Management Gateway (TMG) Enterprise 2010, System Center Standard Single License with Software Assurance Pack Microsoft, and SQL Server Enterprise Core 2012. The recommendation is to award a delivery order against the Department of Defense (DoD) Enterprise Software Initiative (ESI) Blanket Purchase Agreement (BPA). Microsoft software is available from several authorized DoD ESI resellers. The customer has provided FY2012 Operations and Maintenance (O&M) funds under Military Interdepartmental Purchase Request (MIPR) DHQESD12MPC0695. The applicable North American Industry Classification System (NAICS) code is 541519 (sales size standard of $25.5 million).

3. DESCRIPTION OF SUPPLIES/SERVICES:

a) The brand name software allows NAVSEA to added functionality to the system, while having access to predictable resource performance and optimized reporting features found in SharePoint 2010, SQL 2012, System Console Operations Manager, Fast Search and Forefront 2010 releases. No other software company can upgrade Microsoft’s proprietary software, which is the current existing Navy architecture. Expanding NAVSEA’s licenses within the Microsoft suite of software will ensure system integrity, functionality, and scalability while leveraging the existing NAVSEA application support staff knowledge.

b) Items to be purchased and the quantity are listed below:

FASTSrch Server for SharePoint 2010 Single Microsoft Volume License (MVL)
6
SharePoint Server 2010 Single Microsoft Volume License (MVL)
11
Forefront TMG Enterprise
4
System Center Standard Single Lic with Software Assurance Pack Microsoft Volume License (MVL) 2 Processor License
25
SQL Server Enterprise Core 2012 Single Microsoft Volume License (MVL) 2 Core License
24

c) The Period of Performance (PoP) will be one year from the date of the purchase estimated to begin on September 7, 2012.

4. IDENTIFICATION OF STATUTORY AUTHORITY and DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

a) The limited source authority for this J&A is FAR 8.405-6(b)(1), items peculiar to one manufacturer. The required Microsoft components are currently installed as a part of DISA ESD Naval enterprise portal initiatives. In order to maintain compatibility and consistency with the upcoming release, as part of this procurement, it is required that the established standard Microsoft list of products be used when fielding. The Microsoft SharePoint, SQL, Fast Search, System Console Operations Manager and Forefront software is based on the defined architecture and integration of compatible Microsoft SharePoint, SQL, Fast Search, System Console Operations Manager and Forefront software to support this expansion requirement. No other commercially available products are capable of integrating with the current Microsoft SharePoint platform.

b) Market research resulted in findings that this is the only available component that will work within the DISA ESD Naval architecture. Microsoft SQL and all other products listed in

3 (b), whether available on one or more schedule contracts, is an item specific to Microsoft. While there are other manufacturers that make database software, Microsoft SQL is the enterprise database solution for the Navy. In addition, Microsoft SharePoint 2010 is an essential component to the Navy’s enterprise webhosting governance. Only the brand name Microsoft software is compatible to the existing environment.

c) NAVSEA has invested heavily in Microsoft products over the past few years. Changing manufacturers at this point would not only impact operational readiness, but would result in significant and unwarranted costs to change their current environment as well as the expertise to manage this new platform. NAVSEA is an integral part of the DISA Mission. To use another product at this point in time is cost prohibitive in manpower, software development, knowledge management and overall impact to the development and platform integration plans.

Microsoft brand named software is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular features, do not meet, or cannot be modified to meet, the agency’s needs.

5. BEST VALUE DETERMINATION:

The Contracting Officer has concluded the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs. This software, provided only by Microsoft, is required to support the enhanced capabilities needed by NAVSEA to maintain operational readiness of their ship building facility. Although ESI and the General Services Administration (GSA) have already negotiated fair and reasonable pricing, the Contracting Officer will confirm the prices are fair and reasonable based on solicited quotes received, comparison of negotiated prices, and a comparison to the Independent Government Cost Estimate (IGCE). The Government will seek additional discounts for this acquisition and resultant order.
