6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to an exception at 5.202(a)(3).

Requirement to post justification in accordance FAR 13.105(c), Action is a brand name restriction, under $25K, no posting required

7. Market Research: The German Military Aviation Authority (GMAA), which is the host nation authority responsible for overseeing all military aviation operations in Germany, has advised that DFS is the only authorized non-military Air Navigation Service provider in Germany and that there is no other source for civil or non-military Air Traffic Services available in Germany. Based on guidance from GMAA, market research identifying no other alternative sources is IAW AFARS 5110.002 and found to be meaningful, complete, and current.

8. Other Facts: Prior to exercise of an option period or solicitation of a follow-on contract, the Requiring Activity and Contracting Office will continue to conduct market research to verify whether the mandate to use DFS has been revised or rescinded. To date, no other sources have written to express interest in the acquisition. That contract was not competed, under authority FAR 13.106, only one responsible source. The Sole Source Justification included rationale supporting a sole source procurement based on only one responsible source. Deutsche Flugsicherung has flight organization and air control rights for all air traffic over Germany, and issues communication and data service packages to airfields to support flight control and air-to-ground communication.

Connection to these services is required to provide safe takeoff, landing and overflight for all Army air traffic in Germany. Price Reasonableness Determination: The majority of DFS’s customers are commercial airports. DFS bases their pricing on the number of landings. AFOD does not have such data, since it does not operate as a traditional airport. DFS bases their pricing for AFOD on the historical number of messages sent and received via the data connection.
