About this file

This document contains a Determination and Findings for a sole source contract modification with Bell Textron Inc. to provide Czech Republic training services. The modification, valued at $15.2 million, adds scope for UH-1Y and AH-1Z courseware development, electronic classrooms, and in-country pilot, crew, and maintainer training. Work will be performed in the Czech Republic, Texas, Alabama, and includes options totaling $3.3 million exercisable from December 2024. The justification for the non-competitive award is that Bell Textron was previously selected through a Czech Republic defense ministry competition for Attack/Utility helicopters and associated support. The Naval Air Systems Command is the contracting activity.

IN REPLY REFER TO

D&F No. 21-153

DETERMINATION AND FINDINGS

Foreign Military Sales (FMS) Case EZ-P-SBF dated 21 November 2019

Authority to Waive Justification for Other Than Full and Open Competition

Upon the basis of the following findings pursuant to authority of Title 10 U.S.C. Section 2304(f)(2)(E), as referenced in the Department of Defense Federal Acquisition Regulation Supplement 206.302-4, "International Agreement," it is hereby determined that the proposed contract action may be negotiated without the justification described in Federal Acquisition Regulation (FAR) Subpart 6.3.

FINDINGS

1. The proposed contract action with Bell Textron Inc., in support of Czech Republic FMS Case EZ-P-SBF, includes Fixed-Price Type modification to an existing contract (N00019-20-C-0061) for delivery of the AH-1Z and UH-1Y Foreign Military Sales (FMS) Czech Republic training package totaling approximately $21,000,000. The training package will include AH-1Z and UH-1Y Training and Support Elements, an Electronic Classroom, and In-Country Training Services.

2. In FMS Case EZ-P-SBF modification request dated 04 March 2020, the Czech Republic Defense Ministry provided clarification that the Czech Republic held a competition for Attack/Utility helicopters and associated support upon which Bell Textron, Inc. was the successful offeror. The training package being procured via the instant contract action was included in the originally signed LOA awarded as part of the competed effort to Bell.

DETERMINATION

Based on the foregoing, the written justification for other than full and open competition described in FAR Subpart 6.3 is not required for this procurement.

TECHNICAL/REQUIREMENTS CERTIFICATION

I certify that the facts and information under my cognizance supporting this class determination and findings is accurate and complete to the best of my knowledge and belief.

Vasilios Pappas, Colonel USMC Date Program Manager, PMA-276

Section 2304(f)(2)(E), as referenced in the Department of Defense Federal Acquisition Regulation Supplement 206.302-4, "International Agreement."
