DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Lower Colorado Basin, Acquisition and Assistance Management Office.
2. Name and Address of Single Source. The Bureau of Reclamation (Reclamation), Lower Colorado Basin, proposes to enter into a sole source contract with Ellicott Dredges, LLC (Ellicott), 1425 Wicomico Street, Baltimore, MD 21230, to provide a Twin Disk transmission.
3. Description of Supplies/Services and Estimated Cost. The Yuma Area Office (YAO) currently has a requirement to purchase a transmission to replace the existing transmission that has stopped working. The current transmission is a Twin Disk (Ellicott Part #154912) transmission; therefore, the new transmission must be the same model in order to be compatible with the custom-built dredge.
Delivery is anticipated to take 15 days from date of award
4. Description of Circumstances, including why only one source is reasonably available.
IAW FAR 13.106-1(b)(1)(i), only one source will be solicited because of the urgency of this requirement. The Twin Disk dredge transmission must be delivered by April 1, 2024. This office became aware of the requirement on March 11, 2024. If the required delivery date is not met, there will be long construction delays to the Multi-Species Conservation Program (MSCP) Section 26 Conservation Area backwater development. Only this suggested source can furnish the requirement, to the exclusion of other sources, as they are the only company who has the specific transmission readily available to ship. If this requirement is not awarded to Ellicott, this will result in a yearlong construction delay of the MSCP Section 26 Conservation Area backwater development as it would take approximately 52 weeks to build a new transmission. It is imperative to acquire the only available transmission from Ellicott to eliminate any further delays to the MSCP project.
5. Determination of Fair and Reasonable Price. The anticipated cost will be considered fair and reasonable based on price analysis techniques at FAR 13.106-3(a)(2) (i) market research,
(iii) current price lists, catalogs, or advertisements, (iv) a comparison with similar items in a related industry and (vii) any other reasonable basis. Based on the market research conducted, this type of transmission is custom built to specific specifications.
